RE: Tradewinds Subdivision ALT - (A-2021-0087)
Dear Mrs. Alberoy:
This letter is to confirm the Director approved your request for alternative compliance to Unified
Development Code (UDC) 11-3A-7A.b., which dictates the regulations for fences abutting
pathways and common open space lots.
The applicant is requesting alternative compliance to allow the HOA Board to place an 8-foot
wrought iron fence around the basketball court located on Common Lot 1, Block 3 of
Tradewinds Subdivision Phase 1. The basketball court is located next to the drainage ponds
where the children’s basketballs continue to bounce into the ponds causing them retrieve the
balls out. The HOA Board feels the ponds pose a danger to the young children retrieving the
basketballs due to the significant amount of water they continue to hold most of the summer. The
applicant is proposing to add a planter bed around the mailboxes with two five (5) gallon shrubs
and install a 6’-8” bench south of the mailbox to mitigate for the fence height.
The Director has approved your request for alternative compliance to Unified Development Code
UDC 11-11-3A-7A.b. for the subject property based on the required Findings listed in UDC 11-
5B-5E, as follows:
1. Strict adherence or application of the requirements are not feasible; or
The Director finds that strict adherence to the requirements of UDC 11-3A-7A.b is
feasible but not desirable by the applicant due to the safety concerns of the children
retrieving their basketballs from the drainage pond.
2. The alternative compliance provides an equal or superior means for meeting the
requirements; and

The Director finds the proposed alternative provides an equal means for meeting the
requirement as depicted on the fencing outline submitted of the basketball court and
site plan of the additional landscaping and bench to be installed.
3. The alternative means will not be materially detrimental to the public welfare or
impair the intended uses and character of surrounding properties.
The Director finds the alternative means of compliance will not be materially
detrimental to the public welfare or impair the intended uses and character of
adjacent properties.
The Applicant, Director, or a Party of Record may request City Council review of a decision of
the Director. All requests for review shall be filed in writing with the Planning Division of the
Community Development Department on or before July 7, 2021, within fifteen (15) days after
the written decision is issued, and contain the information listed in UDC 11-5A-6B.
If City Council review of the decision is not requested, the action of the Director represents a
final decision on a land use application. You have the right to request a regulatory taking
analysis under Idaho Code 67-8003.
