Watertower, Suite 202 Meridian, ID 83642 Re: Paramount 16 Subdivision Final Plat Modification Dear Ms. Veatch: I appreciate the guidance you provided in the Final Plat approval process for Paramount 16 Subdivision. However, a problem of significance was encountered during that process which needs to be corrected. Specifically: Site Specific Condition No. 5, as approved by the City Council on April I", requires fencing of the park site (Lot 16, Block 40) by the developer. Fencing of Paramount common areas is optional and may be installed by the homeowner, builder, or developer as noted in "Point Two" of my attached April 15` 9:36 AM e-mail to you concerning Condition 5. Your 9:56 AM response (second attachment) signaled agreement with the requested wording modification. Thus, we believed that all plat issues had been addressed. Later in the day, you reviewed the Paramount 16 Park plan —an outdated version that I had submitted in error —without the correct, qualifying note that the 'fence may be installed by owner, builder or developer. " That error led to your 3:34 PM email message (third attachment) stating that language would be added to Condition 5 requiring the developer to install the fencing adjacent to the park. Unfortunately, I was out of the office and did not see that message and was not able to pass it on to Jay walker so that he could address the issue at the City Council meeting that evening. We propose to resolve this matter by amending Condition 5 as proposed by my 9:36 AM e-mail to read as follows: 5. All fencing installed on the site must be in compliance with UDC 11-3A-6 and 11-3A-7. Temporary construction fencing to contain debris shall be installed at the subdivision boundary where permanent fencing does not exist or construction debris shall be regularly removed in accordance with an approved trash management agreement. (Note. As a result, the last sentence of the approved Condition 5 reading, "Fencing along the common area shall be installed prior to release of the first building occupancy for this subdivision " would be deleted.)
