Discovery Way, Suite 200 Boise, ID 83713 Phone 208.323.5393 Fax 208.658.2371 aford@roselawgroup.com www.roselawgroup.com RE: CAVANAUGH RIDGE SUBDIVISION - Rezone; Development Agreement Modification; Preliminary Plat; Phase One Final Plat and Private Street Applications Honorable Mayor and Members of the City Council: On behalf of our Client, Affinity Bank, please accept the following applications for the proposed Cavanaugh Ridge Subdivision [formerly approved as Reflection Ridge Subdivision]: ❖ A rezone request of zoning 91.08-acres from R-4 to R-8; ❖ A Development Agreement modification request to reflect the new project name; the proposed zoning to R-8; the new preliminary plat and the new ownership of the project; ❖ A revised Preliminary Plat request for the overall Cavanaugh Ridge Subdivision; ❖ A Phase One Final Plat request for Cavanaugh Ridge Subdivision and ❖ A Private Street Application request for the proposed private alleys in Phase One Site History: To give some site history for the Council, M&H Development obtained approval of this property as a single-family residential subdivision in 2006. The project was known as Reflection Ridge Subdivision. Corinthian Communities purchased the property from M&H Development and began construction of the Phase One Final Plat. Unfortunately, Corinthian Communities was unable to finish the construction work on Phase One and ultimately failed to record the final plat prior to the expiration of the overall approvals for the project. We estimate that approximately 80-90% of the first phase has been completed however site vandalism has occurred and that percentage will decrease. The property ultimately went into foreclosure and Kastera Development purchased the property. Kastera Development submitted applications to reinstate the land use approvals, unfortunately, Kastera Development was unable to move forward on this project and as noted, Affinity Bank, the applicant on this matter, is in the process of foreclosing on the property. It is the applicant's intent with the aforementioned applications to reinstate the overall approvals for the project, to be now known as Cavanaugh Ridge Subdivision. Due to changes in Meridian's Unified Development Code since the original approval as Reflection Ridge Subdivision and due to the City's request for some slight modifications to the overall preliminary plat, some minor modifications have occurred to the layout which will be discussed later in the forthcoming sections. Unfortunately since the annexation and zoning have occurred, the Meridian Unified Development Code standards for the R-4 zone have changed thus; the originally approved lots no longer meet the standards for the current R-4 zone. To allow the same Preliminary Plat and Final Plat to be re -approved by the City Council, City Staff has recommended that the applicant apply for a rezone to a zoning designation of R-8 in order to comply with current standards in the City's Code. By having a the property zoned to R-8, the same Preliminary and Final Plats can proceed to construction and recording of the first phase final plat without a Planned Unit Development process in accordance with the City's Code and Comprehensive Plan. Development Agreement Modirications• A modification to the original Reflection Ridge Subdivision Development Agreement will be necessary to reflect the change of ownership; the development name; the proposed zoning change from R-4 to R-8; the revised legal description and exhibits for the proposed rezone; and the revised preliminary plat and landscape plan exhibits as discussed further in this letter of application. The recorded instrument number for the original Development Agreement is # 106108230 and is dated July 06, 2006. The applicant understands that certain amenities and building elevations were approved as part of the Reflection Ridge Subdivision Development Agreement. The applicant is committed to providing those same amenities as presented and to adhering to the proposed building concepts as were also presented and approved. Cavanaugh Ridge Subdivision Preliminary Plat• The preliminary plat for Cavanaugh Ridge Subdivision reflects the previously approved Reflection Ridge Subdivision with the following exceptions: ❖ A 40-foot wide access easement has been provided along the western property boundary to the south property boundary. This easement is on the south side of Reflection Ridge Drive at the request of Meridian City Staff; ❖ The total proposed lot count has decreased from 255 buildable lots to 252 buildable lots for a new overall proposed gross density of 2.77 dwelling units per acre; and ❖ A landscape island has been provided within the westernmost knuckle on Reflection Ridge Drive to meet the requirements of the City of Meridian Unified Development Code. The proposed preliminary plat does not propose any variances as it will conform to the standards of the R-8 zoning district. Further, two private streets are proposed as part of this development. Prior to the previous owner stopping work on the project and prior to the vandalism of the site, it was estimated that approximately 80-90% of the site improvements had been completed. It is the applicant's intent to finish the improvements of the site and to record the first phase as soon as possible. The proposed final plat is identical to the original final plat for Reflection Ridge Subdivision Phase One. As required per the Final Plat checklist, the applicant makes the following "Statements of Conformance": ❖ Statement of Conformance with the former Reflection Ridge Phase One Final Plat Conditions of Approval: The applicant accepts and agrees to implement each of the applicable conditions of approval for was formerly known as Reflection Ridge Phase One Final Plat. Details of proposed amenities for Cavanaugh Ridge Phase #1: During our recent neighborhood meeting (July 24, 2008) it was suggested that a neighborhood playground be developed in lieu of the proposed volleyball court and basketball court near Locust Grove Road (Block 3, Lot 1). A more suitable location for the playground was suggested for Block 2 Lot 1. The new playground location would be more accessible to the residents of Cavanaugh Ridge and be further away from busy Locust Grove Road. Given this feedback, we would like the flexibility to change from a grass volleyball court to a children's playground at a more suitable location. We would also like the flexibility to move the location of the basketball court and add different amenities that would enhance the appeal of Cavanaugh Ridge. At a minimum we will honor the Reflection Ridge plan and have a minimum of four (4) amenities within Cavanaugh Ridge Phase #1. After attendees signed in and enjoyed refreshments, Larry Tiernan (Project Manager for Kastera Development) started the meeting at approximately 6:05 p.m. by introducing members of the Kastera staff. Other Kastera representatives on hand were Wayne Forrey, Ben Haught and Ben Forrey. 2. Larry completely described the Cavanaugh Ridge project and how it would blend into and complement the original Cavanaugh Subdivision. The required approval process, including Applications for Preliminary Plat, Final Plat (Phase 1), Rezone (Phase 1) and Development Agreement Modification was discussed, along with a proposed schedule for the approval process and Phase 1 construction. 3. A neighbor who lives along the South boundary of the project, about 500' west of Locust Grove Rd., would like a gate in the common fence between Cavanaugh Ridge and her home. She wants to access the park and trail areas. 4. The neighbor directly to the south of the Cavanaugh Ridge entrance, Vaughn James, mentioned that there is a drainage problem at that area and should be fixed as part of Cavanaugh Ridge. Larry told Mr. James that ACHD is aware of the issue (in fact they brought up in the ACHD pre - application meeting on July 22) and it will be addressed as part of this project. 5. Mr. and Mrs. James mentioned that they would like to sell their seven (7) acre parcel to Kastera. 6. All of the neighbors mentioned that the amenity package presented by Kastera for Cavanaugh Ridge is "just fine." Mr. James commented that "You guys are doing the right thing." 7. The neighbors to the south in the East Slope Subdivision had no objection to the proposal to possibly locate a child play area on the open space parcel along the south boundary of Cavanaugh Ridge adjacent to their subdivision. The idea of having "tot lot" play equipment in that area was fine with them. 8. There was discussion about providing an entrance off of E. Wrightwood Dr. to the seven (7) acres parcel to the south. Larry mentioned that he had spoken to Becky McKay, the engineer who had worked with the party who had previously had the parcel to the south under contract, about a curb cut to the south. When the parcel to the south develops, the developer will be required by ACHD to connect to Wrightwood Dr.; this connection will serve as the parcel's ingress/egress from Locust Grove Rd. 9. After all comments and questions had been addressed by the Kastera Development team, all of the neighbors in attendance were taken on a tour of the Cavanaugh Community Center by Ben Forrey. 10. Kastera recently acquired the financing and soon will complete the acquisition of the deed to the Reflection Ridge Project on Locust Grove Rd. 7/30/2008 Page 2 of 2 •1 in Meridian. The project was originally entitled by M&H Development and was sold to Corinthian Homes, but Corinthian filed for bankruptcy protection last year with the project construction nearly complete. We are purchasing the project with the intent of completing it as previously approved, and hopefully making some significant improvements. Unfortunately, the approvals for the entitlements for Reflection Ridge (overall Preliminary Plat and Final Plat for Phase 1) have expired, and we have to take the project through the entire entitlement process again. We have had the necessary pre -application meetings, a neighborhood meeting, and we are trying to submit our application packages by this Thursday, July 31. There is one issue with which I need your help. Reflection Ridge is adjacent to our other project, Cavanaugh, which fronts on Victory Rd. and extends to Meridian Rd. We would like to merge Reflection Ridge into Cavanaugh, thus making a 'bigger and better' Cavanaugh project. For our applications, we would like to change the name of Reflection Ridge to Cavanaugh Ridge For that we would need your approval. The Final Plat for Reflection Ridge has been approved, but not signed yet, and we are re -submitting a Final Plat Application for Phase 1. After attendees signed in and enjoyed refreshments, Larry Tiernan (Project Manager for Kastera Development) started the meeting at approximately 6:05 p.m. by introducing members of the Kastera staff. Other Kastera representatives on hand were Wayne Forrey, Ben Haught and Ben Forrey. 2. Larry completely described the Cavanaugh Ridge project and how it would blend into and complement the original Cavanaugh Subdivision. The required approval process, including Applications for Preliminary Plat, Final Plat (Phase 1), Rezone (Phase 1) and Development Agreement Modification was discussed, along with a proposed schedule for the approval process and Phase 1 construction. 3. A neighbor who lives along the South boundary of the project, about 500' west of Locust Grove Rd., would like a gate in the common fence between Cavanaugh Ridge and her home. She wants to access the park and trail areas. 4. The neighbor directly to the south of the Cavanaugh Ridge entrance, Vaughn James, mentioned that there is a drainage problem at that area and should be fixed as part of Cavanaugh Ridge. Larry told Mr. James that ACHD is aware of the issue (in fact they brought up in the ACHD pre - application meeting on July 22) and it will be addressed as part of this project. 5. Mr. and Mrs. James mentioned that they would like to sell their seven (7) acre parcel to Kastera. 6. All of the neighbors mentioned that the amenity package presented by Kastera for Cavanaugh Ridge is "just fine." Mr. James commented that "You guys are doing the right thing." 7. The neighbors to the south in the East Slope Subdivision had no objection to the proposal to possibly locate a child play area on the open space parcel along the south boundary of Cavanaugh Ridge adjacent to their subdivision. The idea of having "tot lot" play equipment in that area was fine with them. 8. There was discussion about providing an entrance off of E. Wrightwood Dr. to the seven (7) acres parcel to the south. Larry mentioned that he had spoken to Becky McKay, the engineer who had worked with the party who had previously had the parcel to the south under contract, about a curb cut to the south. When the parcel to the south develops, the developer will be required by ACHD to connect to Wrightwood Dr.; this connection will serve as the parcel's ingress/egress from Locust Grove Rd. 9. After all comments and questions had been addressed by the Kastera Development team, all of the neighbors in attendance were taken on a tour of the Cavanaugh Community Center by Ben Forrey. 10. After the Community Center tour, Larry thanked the neighbors for their attendance, and the meeting ended at approximately 7:15 p.m. COMMITMENT OF PROPERTY POSTING Per Unified Development Code (UDC) 11-5A-5D, the applicant for all applications requiring a public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing. Kastera recently acquired the financing and soon will complete the acquisition of the deed to the Reflection Ridge Project on Locust Grove Rd. 7/3 0/2008 Page 2 of 2 in Meridian. The project was originally entitled by M&H Development and was sold to Corinthian Homes, but Corinthian filed for bankruptcy protection last year with the project construction nearly complete. We are purchasing the project with the intent of completing it as previously approved, and hopefully making some significant improvements. Unfortunately, the approvals for the entitlements for Reflection Ridge (overall Preliminary Plat and Final Plat for Phase 1) have expired, and we have to take the project through the entire entitlement process again. We have had the necessary pre -application meetings, a neighborhood meeting, and we are trying to submit our application packages by this Thursday, July 31. There is one issue with which I need your help. Reflection Ridge is adjacent to our other project, Cavanaugh, which fronts on Victory Rd. and extends to Meridian Rd. We would like to merge Reflection Ridge into Cavanaugh, thus making a 'bigger and better' Cavanaugh project. For our applications, we would like to change the name of Reflection Ridge to Cavanaugh Ridge For that we would need your approval. The Final Plat for Reflection Ridge has been approved, but not signed yet, and we are re -submitting a Final Plat Application for Phase 1.
