COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11-5A-5D, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
which the sign(s) had been posted.

RE: N/W Corner Eagle/Victory Road Comprehensive Plan Map Amendment —Letter of Intent
Dear Mayor and Council;
As representative for the seven property owners located at, and adjacent to the northwest corner of
Eagle Road and Victory Road, please accept this application for a Comprehensive Plan Map
Amendment for these properties that total approximately 15.5 acres. This application request for
amendment to the current land use designation will demonstrate a need for the City of Meridian to re-
designate the area extending approximately'/4 mile west on Victory Road from its intersection with
Eagle Road, to a mixed use designation. The current land use designation is Low Density Residential.
This letter is included with the land use application for Comprehensive Plan Map Amendment,
together with filing fees and various exhibits. The enclosed application has been submitted in
accordance with the requirements of the Meridian Zoning Ordinance.
As the City of Meridian continues to expand south of the Interstate, the need to re-examine land use
designations will continue. In the area near the Eagle Road, Victory Road intersection, a serious look
at the impacts of residential growth must be considered. As ACHD prepares major improvements to
this intersection, including lane widening and signalization, this application requests that the City
evaluate the existing Low Density Residential designation on this enclave of property that sits as its
own "island" adjacent to more intensive uses. The 15 plus acres is surrounded by residential
developments Thousand Springs, Tuscany, and Medford Place, in addition to the Mixed Use
development that is in the planning stages on the east side of Eagle Road. It is also important for the
City to consider the lack of an appropriate amount of service related commercial property in the area
that will be essential to the residential growth that is currently developing on South Eagle Road,
Locust Grove, Victory Road and beyond.
This application includes a request for a Comprehensive Plan Map designation of Mixed Use
Community for the eight parcels. A concept plan, together with an application for annexation and
zoning for the three parcels at the immediate comer, will be accompanying this amendment, and will
be included as part of the public hearing process.

COMMITMENT OF PROPERTY POSTING

COMMUNITY PROPERTY AGREEMENT
THIS AGREEMENT, entered into this 8'h day of May, 2006, by and between LYNN
BRINTON ASAY, husband, and SUZANNE WILLIAMS ASAY, wife, residents of the County
of Ada, state of Idaho, is made relative to certain property in which the parties, either jointly or
separately, have any interest and the disposition of those interests upon the death of either of the
parties hereto as provided by Idaho Code Section 15-6-201. The undersigned husband and wife
agree to the following:
1. MARRIAGE: The parties were married on November 18, 1981, and ever since
said date have been, and now are, husband and wife.
2. DEVOLUTION OF REAL PROPERTY: It is agreed that, upon the death of
either the husband or the wife, all right, title, and interest of the decedent in the following-
deseribed real property (whether such property is separate property, community property, or
quasi -community property in character) shall pass to and absolutely vest in the surviving spouse
insofar as is permitted pursuant to the provisions of Idaho Code Section 15-6-201, as may then

4. DEVOLUTION OF PERSONAL PROPERTY: It is further agreed between
the parties that, upon the death of either the husband or the wife, all right, title and interest of the
decedent (whether separate property, community property, or quasi -community property in
character) in and to any personal property in which the decedent has any interest shall pass to and
absolutely vest in the surviving spouse insofar as is permitted pursuant to the provisions of Idaho
Code Section 15-6-201, as may then be in effect.
5. WPARATE CHARACTER OF PROPERTY: As is per itted by Idaho Code
Section 32-906, it is hereby agreed that any and all interests in property, real or personal,
transferred to the surviving spouse pursuant to this Agreement shall thereafter be the separate
property of said survivor. All subsequent income, rents, issues, profits, gains, and/or
appreciation thereon shall also be the separate property of said survivor.
6. LIABILITIES: It is understood between the parties hereto that all real and
personal property described in the preceding paragraphs hereof shall, upon the death of the first
of the parties to die, vest in the survivor as between the parties hereto absolutely insofar as is
permitted under the provisions of Idaho Code Section 15-6-201, subject to any and all liabilities
imposed upon such survivor under the provisions of said Section
7. NOTICE OF NEED TO AMEND: It is also understood by and between the
parties hereto that, in the event the parties either transfer the above -described real property or
acquire other real property the disposition of which they wish to be governed by this Agreement,
this Agreement must be amended or replaced by the parties.
