Fairview Avenue Boise, Idaho 83712 In regards to the above referenced conditional use application, Fairview Lakes LLC is requesting a hearing with the City of Meridian City Council to appeal the decision rendered by the City of Meridian Planning and Zoning Commission. The appeal will address the conditions of approval for MCU-08-002. History: Fairview Lakes was developed as a mixed use planned unit development. The major components consist of a commercial/retail development, office park and Grace @ Fairview Lakes retirement center. Because of the changing real estate market the development has gone through several conceptual changes to adjust to market needs. The file numbers and applications that are related to this appeal are listed: CUP-02-014 Original conceptual approval for the whole development CUP-04-049 Detailed approval for the construction of four commercial Buildings CUP-06-032 Modifications for Buildings on Lot 3 and 4 Block 3 of Devon Park Sub. No.I CZC-07-027 Certificate of Zoning Compliance approval for the subject retail building Alternative Application was submitted on June 10, 2008 Compliance MCU-08-002 Conditional Use Modification to address the alternative compliance BP-2007-1020Building Permit issued 7/16/07 A building permit was issued on July 16,2008 with the attached CZC-07-027. The building plans that were approved for construction were significantly different from the elevations and site plan that was shown on CZC-07-027. The building was constructed in accordance to the approved construction documents. Upon final inspection to obtain the final occupancy permit the contractor was informed that he needed to install an additional landscape island to conform to the CZC requirements. The approved CZC did not show any landscape parking islands required in the front of the building. Prior to the construction of this facility Fairview Lakes constructed the Hastings building. The structure was similar in street frontage as the proposed strip center, no landscape islands were required in front of that facility. The parking that was provided in front of the Hastings building was divided by concrete patios. Fairview Lakes submitted an alternative compliance application for an additional amenity in lieu of the required five foot landscape island. Fairview Lakes submitted the addition of a large patio area in front of the proposed building. The application was denied and Planning and Zoning requested that I submit a conditional use modification to clean up the changes in the site plan and building layout of the overall plan. The conditional use modification that was submitted requested the alternative compliance and it addressed the over all site plans and showed the building modulation. Fairview Lakes proposed two amenities in lieu of the five foot landscape island. The addition of the concrete patio in front the existing strip center and the increase in size of 3,150 square feet on the water feature courtyard proposed in Phase II. At the Planning and Zoning hearing on October 16, 2008 Fairview Lakes verbally committed to add another concrete patio at the other end of the existing fagade to break up the parking to meet the requirements of the ordinance and add additional evergreens in the rear of the building to further buffer the rear elevation. No verbal testimony was given against the design of the building that was built. The motion that was suggested addressed the windows on the west facade were shown on the CZC, but not included in the revised building design that was constructed. Newton - Huckabay recommended leaving the existing building as is. Newton-Huckabay also suggested the planter be added and a texcote on the exterior walls would be a reasonable compromise. The report that was written and adopted did not address the recommended modifications. I have attached and highlighted comments made at the Planning and Zoning hearing that support the items I have outlined. I have included the applicants submittal letters for both the alternative compliance and the modification to the conditional use. In summary I am requesting City Council reconsider my conditional use modification application. In lieu of the approved report from Planning and Zoning I am requesting the following alternatives: 1. Concrete patios to be installed at the sign panels located on each end of the strip center. 2. Phase II buildings to be modulated as submitted MCU-08-002 3. Phase II water feature court yard be increased in size of 3,150 square feet. 4. Three pine trees to be added to the rear building elevation of the strip center 5. The strip commercial buiding to remain as constructed The state of the economy has been very difficult on the development community in general. I felt our nitch in the real estate market was to provide a quality product for a fair price. When I designed the commercial center I decided to upgrade the building to masonry construction with steel trusses and a metal deck to provide a long term quality building. I believe are rents that we are quoting are among the cheapest on Fairview Avenue. In twenty/twenty hind site if I would have known that our wall finish would become an issue I would have designed and constructed the building closer to the CZC that was approved. Because of our location we can not demand the type of rents provided other developments. I felt the upgrade of the building elevations and the type of construction far out weighed the issue of a rear wall finish. I believe that our cooperation on pedestrian path extensions and green belt enhancement, have shown that we are a good partner with the City of Meridian. I ask for your support on this matter. My -- Moe: So, my opinion is that, quite frankly, the comment in regards to the western elevation and not putting the windows in -- I don't have a problem putting in -- not putting in those windows, but I do want to see the stucco on the back. And the planter, that as well. So, I guess I could live with the stucco and planter and not worry about the windows. Newton-Huckabay: What about -- is this thing tied to the finish that's on the Hastings building, the texture paint and stuff? I mean --- Marshall: The text coat. * Newton-Huckabay: The tex coat. Thank you. Rohm: I think that's a good compromise. Newton-Huckabay: I think that's -- I mean given that I -- in my opinion, the front facade of the building -- and I have thought this when I drive by it -- is closer to what we originally envisioned with the very first CUP, what we finally ended up with, and I think that it's a -- I think that it contributes to the Fairview Lakes development and looking a little more higher quality than it would have -- would have otherwise. I would think the tex coat would be a reasonable compromise and so -- Moe: On your -- the windows? Newton-Huckabay: I would recommend leaving that as is. Moe: And the planter? JT Newton-Huckabay: I think he should build the planter. Moe: Those are the issues. We need some type of a motion. Newton- H ucka bay: Okay. Rohm: I think you hit the nail on the head. Moe: I think any one of you three. Newton-Huckabay: I just want to say one thing to Mr. McDaniels and sorry, Jack -- I don't know your last name. That I read your letter and I thought it was very thoughtful and I believe I understand your concerns and I just want you to know that there is no Meridian Planning & Zoning Commission October 16, 2008 Page 61 of 64 specific action that we can take to change the right of the developer to come in with changes. So, we just hope that we make thoughtful consideration of those changes and that at the end of the day it will come together, so did want to let you know that I appreciate you coming out and that we are not ignoring what you have to say. Does that comport with my cohorts here? After considering all staff, applicant, and public testimony, I move to approve file number MCU 08-002 as presented in the staff report for the hearing date of October 16th, 2008, with the following modifications to the conditions of approval. Sonya, I'm not going to attach these to numbered conditions. Will you be able to make the changes anyway? Okay. That the west end of the building will not be required to put the -- any additional windows as was originally proposed in the CZC. That in lieu of the stucco on the -- on the perimeter of the building where what's required on the CZC, a tex coat will be applied. Victory Road: Item 10: Continued Public Hearing from October 2, 2008: PP 08-010 Request for Preliminary Plat approval for 255 residential building lots and 26 common area lots on 91.08 acres in an R-4 and proposed R-8 zoning district for Cavanaugh Ridge by Kastera Development, LLC — east of S. Meridian Road and south of E. Victory Road: Moe: At this time I'd like to open the continued public hearing for RZ 08-005 and PP 08- 010 for the sole purpose of continuing those to the regularly scheduled meeting of the P&Z on November the 20th. But, again, we went on to compliance that we had an approved building permit set that had been approved by the City of Meridian with an attached CZC then. I'm assuming that this building department review that was, you know, different than what we had, but we just went with the city's compliance that, you know, we specifically called out materials, what was paint, what was stucco, what was stone, and, then, built what was -- was in our drawings and the only thing that we knew that we didn't comply with was missing a landscape island in front of our building. In regards to the last item, 1.4 -- and it says applicant shall be responsible to obtain a CZC from the planning department for the proposed changes. And, again, I'm assuming what we would be doing is applying for a CZC after the building has already been built and so I don't know if that sets some kind of precedent about the zoning staffs ability to require some things after the fact. I don't know where that goes. I have never been in this kind of situation. Because, again, you know, if I knew that we were going to get into the situation we are in, we would have cut the asphalt and put in the five foot landscape island, you know, because, you know, one is we had to re -notice a couple times, you know, we didn't have enough signs, so we redid that. So, I mean we have been working on this probably for three or four months just to try to get through this little five foot landscaping_ In kind of summary, you know, one of the things that I would be willing to do as a concession to all these things is that, you know, where we have kind of the three main sign panels, so we have one here, we have one here in the center, and we have one here, we have already added ted here, we are o increase�theize of this patio, modulate this ui ing, andscaping in phase two. We would also be willing to go ahead an add a separate patio in front of this other sign panel here, so, again, it breaks up these parking spaces, so we only have five or six spaces in between each one of these islands. But, yo nr%vu I didn't_have any intention of coming here and defending our project as far a e Ir quality of what we are doing and cleslyl I done, because it's built. You know, I'm hoping that I was just here to -- to meet the compliance of a five foot landscape island. So, if you have any questions, I'd be more than happy to -- Moe: Doug, I guess I'm right back on my main focus earlier. When the CZC was approved -- Tamura: Uh-huh. Moe: -- how, then, did those plans get changed to something else that went into the building department to -- for permitting and, then, construction? Tamura: What we submitted for the CZC was this building right here and, again, we had a deeper bay in here, because we thought we had a Dollar Store that was going to take this space right here, but, then, when that fell through, you know, not -- in discussion with the realtors, I said, well, should we go ahead and fill those deeper bays and they said, well, we think you're all going to shoot yourself in the foot by having that extra depth that -- you know, that everyone wants more frontage than depth on square footage and they said just make everything a maximum 60 feet deep and so we said, bj-t� I2 Nr +t v6 June 10, 2008 Planning & Zoning Department City of Meridian 660 E. Watertower Meridian, Idaho 83642 RE: Alternative Compliance Devon Park Sub. No.I CZC-07-027 Please accept the attached application for an Alternative Compliance. Please review the attached approved site plan for CZC-07-027. The landscape plan that was installed was according to the approved site plan for CZC-07-027. Please note the proposed landscape islands on the west end and the proposed future landscape island on the east end that was to be installed in Phase III. We modified the landscape islands on the west end of the retail strip shops to accommodate the landscaping as required.( see the attached site plan that shows the current landscaping and the location of the proposed patio) I was not aware of the requirement of interior landscape islands. Phase I of Fairview Lakes was the construction of the Hastings retail building. The front of the building is similar in overall length, as the proposed retail strip. We installed a combination of sidewalks, patios and parking, but was not required to install any interior landscape islands. In lieu of trying to add an additional landscape island, I would like to propose the addition of a 18 feet wide patio and bike rack located as shown on the attached site plan to break up the existing parking lot in front of the building. I apologize for the over sight, I was unaware of the landscape requirement, I tried to the follow the conditions of approval as outlined in the CZC-07-027. No -I CUP-06-032 Please accept the attached application for the modification of the above referenced CUP. Because of the difficult times in the retail leasing market Fairview Lakes LLC has modified the retail center to be predominantly a strip center. The first phase of the retail center has been constructed, please see the attached photographs. Fairview Lakes LLC is proposing an alternate landscape plan in lieu of a parking island. We have installed a 18 feet patio with a bike rack and bench to break up the parking in front of the current retail center. In phase II the required court yard was increased 3,150 square feet. The proposed landscape courtyard will include a water feature. The building elevations and heights will remain similar to the existing structure. Please note the building modulation has changed to reflect the building that was built. The buildings were modulated to provide a larger court yard area for phase II. All other conditions of CUP 06-032 shall remain the same, including the approval of the two drive up windows. The proposed project is located at 950 E. Fairview Avenue in the Devon Park Subdivision.
