Please accept the attached application for a utility easement vacation. In regards to the
above referenced subdivision plat I am requesting the relinquishment of any claim or
interest in the original 10 feet wide utility easement originally granted on the southern
property line of Lot 3 Block 1 Devon Park Subdivision No.2. Please review the attached
subdivision plat, I have high lighted the proposed vacation. Fairview Lakes LLC is the
record owner of Devon Park Subdivision No.2.
Devon Park Subdivision No.3 is a resubdivision of Lot 2, Block 1, Devon Park
Subdivision No. 1 and Lot 3, Block 1, Devon Park Subdivision No. 2. Devon Park
Subdivision No. 3 will provide utility easements. All of the utilities have been installed.

WHEREAS, by subdivisio plat recorded in Plat Book 91, at Page 10854 through Page 10856 on April
25, 2005, as Instrument Numbei105050375, in the records of Ada County, State of Idaho, Devon Park
Subdivision No. 2, granted to IDAHO POWER COMPANY an easement (the 'Basement") for the construction,
operation and maintenance of certain power line facilities upon the following premises located in Ada County,
State of Idaho, to -wit:
Devon Park Subdivision No. 2 — A resubdivision of Lot 1, Block 2, Devon Park Subdivision No. I and a
portion of the Southwest Quarter of the Southeast Quarter of Section 6, Township 3 North, Range I East, B.M.,
City of Meridian, Ada County, Idaho.
AND, WHEREAS, it is no longer necessary or desirable that a certain portion of the Easement be
retained.
NOW, THEREFORE, in consideration of the premises, IDAHO POWER COMPANY does hereby
release and abandon that certain portion of the Easement over the following described lands:
The 10 ft public utility easement on the South boundary line line of Lot 3, Block 1, in Devon Park
Subdivision No. 2.
This partial release only becomes effective upon recordation of Devon Park Subdivision No. 3.
ALL RIGHTS and privileges under the above -described document in and to the remaining lands
covered by the Easement and any and all prescriptive or other rights the Grantee has acquired through
occupancy and use over time of said remaining lands shall remain and continue in the Grantee and shall not be
affected in any way hereby.

Subject. Vacation Applications - Devon Park Subdivision No 2 and Kobe Subdivision
I have received your requestfor Vacation of the Utility Easements in the above mentioned
Subdivisions.
The Devon Park Subdivision has a utility easement only. The City of Meridian and Idaho
Power have applications that must be submitted to have the easement vacated. ACHD has no
interest in the easements and no vacation with the District will be required.
The proposed Kobe Subdivision has a Utility and Drainage Easement. This easement requires
the applicant to follow the Vacation and Exchange Procedures for Public Right -of- Way that is
available on our website. As you are already aware, this procedure also requires approval
from the various cities as well as an Idaho Power application.

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11-5A-5D, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
which the sign(s) had been posted.
