Mayor & City Council:
On August 23, 2005, a Development Agreement (DA) was approved by City Council
with the annexation (AZ-05-019) of the property on the northwest corner of S. Eagle
Road and E. Overland Road, known as Dorado Subdivision. The DA was recorded on
September 2, 2005, as Instrument No. 105127512.
The Development Agreement was entered into between the City of Meridian and Kimball
Properties, LLP (Owner/Developer). As a signing party on the DA, the City of Meridian
requests approval of a modification to the DA as follows:
Section 5.1
3. A five foot perimeter landscape buffer will be allowed for Lots], 2, 3, 4114,
15, and 16 with the owner/developer having the following options:
a. Provide a surety for this landscaping until conditional use approval is
granted, or
b. Install the required landscaping for Lots 1, 2, 3, 4214, 15, and 16 with all
other perimeter landscaping, and install alternative compliance
landscaping upon conditional use approval (if required). Alternative
compliance will include a 6-foot high fence and added landscape.
When the subject property was annexed by the City, the developer was in negotiations
with the residential property owner at 1476 S. Loder Place, abutting the west boundary of
the site (adjacent to Lot 14), to purchase the property and eventually develop it
commercially. The City, as well as the developer and property owner, assumed the
property would be purchased and converted to commercial use in the future. For this
reason, the DA provision requiring a 6-foot high fence and added landscape as alternative
compliance for a reduced buffer width did not include Lot 14, as no buffer is required
between commercial properties. The property ended up not being sold to the developer
and is still a residential property.
The other commercial lots (Lots 1, 2, 3, and 15) in Dorado Subdivision that abut the
residential properties in Overland Way Subdivision were allowed a reduction in buffer
width with the stipulation that a 6-foot tall fence and added landscape be installed
adjacent to the residential properties. Because Lot 14 abuts a residential property, the
City is requesting that the fence and added landscape requirement noted above include
Lot 14. Lot 4 also abuts a residential property and was not included in the original DA,
the City requests that the fence and additional landscape requirement also apply to this
lot.

4. USES PERMITTED BY THIS AGREEMENT:
4.1 The uses allowed pursuant to this Agreement are only those uses allowed
under "City's" Zoning Ordinance for the C-G Zoning district as codified at
Meridian City Code Section 11_ 7-2M
4.2 No change in the uses specified in this Agreement shall be allowed without
modification of this Agreement.
CONDITIONS GOVERNING DEVELOPMENT OF SUBJECT PROPERTY:
5.1. "Owner/Developer" shall develop the "Property" in accordance with the following
special conditions:
l . Notwithstanding the status of the property as a planned development, no new
buildings are approved for construction on that part of the property that is
identified as lots 1, 2, 3, 15 & 16 on the preliminary plat except pursuant to an
application for conditional use permit submitted to and approved by City prior
to submittal of any Certificate of Zoning Compliance application and/or
building permit. If the property within Overland Way Subdivision adjoining
said lots to the north and west ceases to be used for residential purposes, this
requirement shall be deemed waived with respect to any of said lots which
abut such adjoining property.
2. Allow five foot landscape buffer along the west perimeter of lots 13 & 14.
3. A five foot perimeter landscape buffer will be allowed for lots 1, 2, 3, 15 and
16 with the owner/developer having the following options:
a) Provide a surety for this landscaping until. conditional use approval is
granted, or
b) Install the required landscaping for lots 1, 2, 3, 15 and 16 with all other
perimeter landscaping, and install alternative compliance landscaping upon
conditional use approval (if required). Alternative compliance will include a 6
foot high fence and added landscape.
4. ow a maximum height variance of 60 feet for the hotel use.
5. Drive thrus as an allowed use for banks and restaurants.
6. Allowed uses are restaurant, retail, hotel, banks and office.
7. Alternative compliance allowing for the right -in -only entrance off of Eagle
Road to be considered part of the 35 foot wide landscape buffer.
8. Allow a detached sidewalk to be considered part of the 35 foot wide landscape
buffer along Eagle.
9. There is currently a 20 foot landscape buffer separating lot 1 from Loder
Street- Applicant will provide an additional five of landscaping to the existing
landscape buffer.

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11-5A-5D, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
which the sign(s) had been posted.
I am aware of the above requirements and will comply with the posting requirements as stated in
UDC 11-5A-5.
