The original Development Agreement was approved January 8, 2008, but as of this date has not been recorded. Our interest in the Development Agreement relates to the currently proposed Meridian Family Eyecare development of the property, CUP-07-022. The section of the Development to be modified is the requirement for a cross -access agreement to the property to the East of this site. We are requesting that this requirement be deleted from the Development Agreement. The reasons for deleting the cross -access agreement are : 1) The proposed development places a building along the East side of this property, in the area of the proposed cross -access. This is the only location on the property which will allow a building of feasible side, the required parking and access, and the retaining of nearly all of the existing mature trees. 2) No cross -access agreement existing on the property to the East; thus, the cross -access agreement on this property would be of no value and could not be used for actual physical access between the two properties. 3) Sufficient, convenient, and appropriate access to both this property and the property to the East exists from both West 1 st and West 2nd Streets, without access from Cherry Lane. 4) The cross -access in not needed to allow appropriate development of both of the properties in question, and in fact would severely limit the development potential for either property. 5) A cross -access would be of very little if any benefit to the public, since the properties in question are very small. The potential for a large volume of traffic between the two adjacent properties does not exist. 6) Pedestrian access between the adjacent properties is convenient and logical, with the existing Cherry Lane walk. Again, the potential for a large volume of pedestrian traffic between the properties does not exist, because of the small size of both properties. We enclose herewith a Preliminary Site Plan illustrating the proposed Site development. We have reviewed this at length with the planning staff, and have come to the conclusion that this is by far the most feasible We respectfully request approval of this request for modification of the existing Development, as explained herein. COMMITMENT OF PROPERTY POSTING Per Unified Development Code (UDC) 11-5A-5D, the applicant for all applications requiring a public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
