On June 26, 2008, planning staff approved a certificate of zoning compliance for a
McDonald's Redbox located at 3415 W. Cherry Lane. Although the plans comply with current
code, there is concern that the proposed 24 hour use conflicts with the assurances the neighbors
were given during talks with the developers. We are requesting City Council review this decision
to ensure that the neighborhood's concerns are fully addressed.

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11-5A-5D, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
which the sign(s) had been posted.

Conditions of Approval: Project is subject to all current City of Meridian ordinances and all other
conditions of approval issued for this site. The issuance of this CZC does not release the applicant
from any previous requirements of other permits issued for this site, including but not limited to,
CUP-04-054 and CZC-07-118.
Site Plan: The Site Plan prepared by Thomas, Dean & Hoskins, Inc., on June 12, 2007 (revised
August 6, 2007), labeled Sheet 3 of 12 Cad No. L06024-03.DWG, is approved (stamped
"Approved" on June 26, 2008 by the Meridian Planning Department) with the following note:
1) The proposed location of the Redbox appears to displace the bike rack on the
original Certificate of Zoning Compliance (CZC-07-118) Site Plan approved by the
Meridian Planning Department, July 16, 2007, labeled sheet 3 of 10 Cad No. L06024-
03.DWG. Per UDC 11-3C-5, the required bike rack shall be relocated as close as
possible to the building entrance.
The details of the rental machine prepared by Lingle Design Group, Inc., on February 29, 2008,
labeled Sheet A2, are approved (stamped "Approved" on June 26, 2008, by the Meridian
Planning Department) with no changes. The approved site plan is not to be altered without prior
written approval of the Planning Department.
Sidewalks: All sidewalks shall be constructed in accordance with 11-3A-17. The sidewalks
surrounding the rental machine shall have a minimum clearance width of 5 feet for
pedestrian/handicap access to the entrance of the restaurant and the rental machine. Sidewalks
shall be constructed/maintained prior to occupancy.
Li htin : Lighting shall not cause glare or impact the traveling public or neighboring
development and comply with lighting standards as defined in UDC 11-3A-11.
Signnage: No signs are approved with this CZC. All business signs will require a separate sign
permit in compliance with UDC 11-31).
Handica-Accessibili : The structure and site improvements associated with this proposal must be
in compliance with all federal handicap -accessibility requirements.
ACHD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit.
If any changes must be made to the site plan to accommodate the ACHD requirements, a new site
plan shall be submitted to the City of Meridian Planning staff for approval prior to the issuance of a
building permit.
Certificate of Occupancy: All required improvements must be complete prior to obtaining a
Certificate of Occupancy. All changes in occupancy need to comply with the requirements of the
Building Department. It is unlawful to use or occupy any building or structure until the Building
Official has issued a certificate of occupancy. A certificate of occupancy or temporary certificate of
occupancy is obtained from the Building Department (208) 887-2211 after inspections are complete
and the field inspection record is returned to the Building Department.
Plan Modifications: Except for the change mentioned above, the approved Site Plan stamped
"Approved" on June 26, 2008, is not to be altered without prior written approval of the Planning
Department. No significant field changes to the site and/or landscape plans are permitted; prior
written approval of all changes is required.
