Lance Lance Evans, AICP Hawkins Companies 208.908.5577 (m)208.401.6608 11 /25/2008 November 25, 2008 Bill Parsons City of Meridian Planning Department Bill- outlined below is the Development Agreement Language with Hawkins Company redlines and comments for three development agreement items. We are comfortable with the other 16 items. 14. The annfirant is re uestin access to Meridian Road at three locations* two ri ht- in/ri ht-out access oints and one right-in/right-out., left -in access as shown on the conce t lan. Exce t for one ri ht-in/ri ht-out access oint at the uartw mile as recommended b the Plannin and Zonin Commission an additional access points are subiect to continued discussions between the Citv of Meridian and the applicant and the nendmg variance ann1ication (VAR 8 008) access points shall be terminated prior to issuance of the first occupancy existing this development. P Y permit in Hawkins Companies Comment: Access to the site from Meridian Road is critical to the successful operation of the center, and critical to the success of retailers within the development. The proposed access drives will be designed to a higher safety standard than those typically existing on Eagle Road. We believe the design of the drives, the precedent set by similar variance requests, and the applicant's willingness to surrender 4 of its 7 deeded access points will ultimately merit approval of these access points shown. 18. The applicant shall construct half of the collector/backage road from Amity Road or Harris Street to the center west/cast drive aisle prior to the issuance of first certificate of occupancy for the respective phase if a plat has not been recorded. of fifst 19. The applicant shall coordinate with the Northwest Pipeline Company "NPC" ree ardinu construction and development within the NPC gas line easement_ "Easement") pursuant to the terms of the Easement and the regulations vernma federalhave been M plan Hawkins Companies Comment: Federal regulation and terms of the easement agreement already govern the roles and responsibilities of each party. We do not believe that the additional burden upon the applicant is necessary and will create a situation where the NPC has final and ultimate control in determining how the site may be developed. Following the commission meeting, we met again with NPC and each party has gained a better understanding for the development for the site and potential obligations. In fact, no upgrades may be required as there are testing, variance and wavier opportunities for NPC through the federal regulations. We will continue to work with and coordinate development activity with NPC. Sincerely, Lance Evans, AICP Hawkins Companies
