Location, size of property and existing zoning: The site consists of 2.2 acres and is currently zoned I-L.
The property is located at 3131 & 3163 E. Lanark St., on the SWC of N. Eagle Rd. and Lanark St.
Adjacent Land Use and Zoning:
1. North: Vacant land, zoned C-G
2. East: Eagle Road and retail (R.C. Willey's), zoned C-G
3. South: Vacant land, zoned I-L
4. West: Industrial uses, zoned I-L
Applications: RZ of 2.2 acres from I-L to C-G
Summary of Proposed Streets and/or Access: Access is provided from Eagle Road via Lanark Street. No
new access points or streets are proposed or approved with this application.
Landscaping: Landscaping is not required with the subject RZ; however, landscaping in accordance
w/UDC standards will be required with approval of any future CUP or CZC application.
Off -Street Parking: Off-street parking exists on the site in excess of the amount required by the UDC
Comprehensive Plan Designation: Industrial
Compliance with Comprehensive Plan: Yes (The land use categories and locations depicted on the map
are conceptual. For this reason, the Planning Director has determined that the proposed C-G zoning
district is generally consistent with the Comprehensive Plan because of the adjacent commercial uses and
zoning to the north and east of the subject property and because of the property's location on Eagle
Road. Further, Planning Staff believes that commercial uses are more appropriate than industrial uses
adjacent to transportation corridors such as Eagle Road for aesthetic reasons.
Compliance with UDC: Yes, per the conditions in the staff report
Proposed DA requirements:
• Drinking establishment uses shall be prohibited.
• A new trash enclosure shall be constructed that complies with UDC standards. Chainlink fencing,
with or without slats does not quay as a screening material, per UDC 11-3B-5M.
• Construct a min. 5' wide sidewalk adjacent to Lanark along the N. boundary of this site.
• Construct a 10-foot wide multi -use pathway on the west side of Eagle Road along the E.
boundary of the site within the ROW or a public use easement and install street lights consistent
with the Eagle Road Corridor Study.
• Comply with current UDC standards w/establishment of a new use on this site.
• Obtain Fire Department approval for a turn around on the site that meets code requirements.
• A Design Review application is required w/any future CUP/CZC application for this site.
• A CZC application shall be submitted for a change in use of the site.
History of Previous Actions:
• This property was platted as Lots 1 & 2, Block 2, of Olson & Bush Industrial Park Subdivision.
• A ROS (#7190) was recorded in 2005 that changed the configuration of Lots 1 and 2, Block 2.
• A CZC was approved in 2005 for a 6K square foot office/warehouse building on the southern
portion of this site.
• A RZ from I-L to C-G & CUP for a drinking establishment in a C-G district was denied in 3/08.
Outstanding Issues for Commission: Determine if C-G zoning is appropriate for this site.
