The City signed the FCO's associated with this CUP on August 7, 2008. The amendment we are requesting is to allow a 24-hour Maverik store to operate on the proposed Lot 1 Block 1 within the Woodland Springs Subdivision. The Final Plat was previously approved by the City. Nearly all Maverik stores are operated as 24 hour stores and the availability of 24 hour operation to meet market demands is crucial to Maverik. The nearest 24 hour convenience store is located over two miles from the proposed site. Allowing Maverik to be open 24 hours will assist the surrounding neighborhood by meeting any late night or early morning shopping needs. Maverik has employees in the store during the night, cleaning, baking, stocking and providing other services. Providing 24 hour operations will make this a truly `convenient store' for the surrounding neighborhood at times when employees are already present. ANNEXATION & ZONING HISTORY With the previous approval of the annexation, rezone and preliminary plat of Woodland Springs Subdivision the development agreement specified that all lots except the Maverik site have restricted hours (6 a.m. — 11 p.m.). A Maverik convenience store has been shown on the corner since the initial annexation and preliminary plat submittal. The City Council restricted hours on the surrounding lots and proposed businesses within Woodland Springs, while specifically excluding any restriction for the hours of operation on the lot containing the proposed Maverik. The lots and businesses with restricted hours provide a buffer from the corner lot and the surrounding residential neighborhood. A copy of the color presentation exhibit is attached as exhibit "A". C08008 Maverik CUP Amendment Narrative 081808.doc ZONING REVIEW The Planning and Zoning commission indicated that store hours should be limited because it is in a neighborhood commercial zone; the site serves the neighborhood. However, the neighborhood commercial zoning designation doesn't restrict hours of operation for commercial uses. Therefore, based upon Meridian's Land Use Schedule and the Woodland Springs Development Agreement, a retail store, restaurant, and a health care/social services are among the many permitted land uses that are allowed 24 hour operations on the corner lot. LAND USE INFORMATION The Maverik site is located away from existing residential by over 1,000 ft to the north, over 500 ft to the south, over 400 ft to the east and over 1,200 ft to the west. The nearest existing residential subdivision is approximately 215 ft to the northwest. In evaluating most of the existing 24 hour convenience stores throughout Meridian we found that five out of seven have residential areas closer than the proposed Maverik site (see exhibit `B"). The proposed Maverik location has relatively significant separation from residential areas which assists in minimizing any impacts. BUFFERING A significant amount of landscape buffering is proposed around the Maverik site and the surrounding commercial area (see exhibit "C"). Maverik has landscape buffers along Locust Grove (25 ft wide) and McMillan (40 ft wide) roads. Additionally, Maverik has a significant amount of landscaping around the store itself. (See exhibit "D"). Further, as shown in exhibit "A" there are a couple of retail and office buildings proposed surrounding the Maverik location. These other buildings have restricted hours (6 a.m. — 11 p.m.) providing more buffering to surrounding residential areas. CRIME According to the Meridian Police Department's 2007 statistics, crime at a convenience stores/gas station is much lower than residential land uses, retail establishments, schools and other commercial uses. In 2007, convenient stores/gas stations don't register as a top ten crime generator by land -use. Convenience stores/gas stations are not even on the yearly top ten list for offenses over the past three years. I have attached bar graphs showing the yearly top crime generators by land use in Meridian City as exhibit "E". In coordination with the traffic engineer, approximately 65% of the vehicle trips associated with Maverik will be `pass -by' trips. These `pass -by' trips are traffic that is already on the roadways traveling to final destinations other than Maverik. Therefore, the majority of vehicles frequenting the proposed Maverik will not increase the traffic volume on the surrounding roadways. Additionally, the night time hours are typically the lowest volume times on the roadways, making impacts from 24 hour operations minimal. CONCLUSION For the above reasons Maverik is requesting the allowance of 24 hour operations. Again, the allowance of 24 hour operations is crucial to Maverik business operations.
