A 8' path was requested from the sidewalk that is parallel to McMillian Road. We were told by the developer that in the development agreement dated February 4, 2008 pg. 3 5.5.1.1 the requirement for the path was removed due to the relocation of the irrigation canal to the north side of the street. The developer has informed us that all of the utility easement have either relocated or vacated. All driveways, circulation isles and site infrastructure shall be installed by the developer prior to or concurrent with the construction of the Maverik station. Maverik is only responsible for the construction on their lot. On the Final Plat Landscaping plan for the woodland springs subdivision our lot show 20 trees (see included plat). Our proposed landscaping plan shows a total of 32 trees. It is my understanding that we can relocate the trees and clustering is allowed as long as the number of trees is not less than that required by the Final Plat Landscaping Plan.
