RE: Vacation of Utility Easements
To whom it concerns:

Consulting, Inc.
In working to develop the Verona No. 2 and 3 Subdivisions we have found some of the existing
utility easements within their boundaries to be unnecessary. The utility easements which the
developer wishes to have vacated do not contain any actual utility infrastructure. This has been
verified by a survey done on the area's utility mark -outs. It is also the intent of the developer to
adjust existing lot lines. Therefore, the easements along these lot lines are no longer needed.
Scaled site plans showing the easements that are to be vacated as well as the easements that
are to remain have been provided. Relinquishments of easement letters from all applicable
utilities have been obtained and included with this application. No persons or parties, which
we know of, will be affected by the vacation of these easements.

SPECIAL WARRANTY DEED
FOR VALUE RECEIVED, PRIMELAND DEVELOPMENT COMPANY, L.L.P., an Idaho
limited liability partnership, the Grantor, does hereby grant, bargain, sell and convey unto
PRIMELAND INVESTMENT GROUP, LLC, an Idaho limited liability company, the Grantee,
whose address 3120 West Bellflower, Suite 300, Meridian, Idaho, the following described premises
situate in Ada County, Idaho, and more particularly described in Exhibit "A" attached hereto and
incorporated herein by reference.
TOGETHER WITH all and singular easements, licenses, permits, water rights, the tenements,
hereditaments and appurtenances thereunto belonging or in anywise appertaining, the reversion and
reversions, the remainder and remainders, rents, issues and profits thereof, and all estate, right, title
and interest in and to the said property as well as law as in equity of the Grantor.
TO HAVE AND TO HOLD the said premises, with their appurtenances unto the Grantee,
and Grantee's heirs and assigns. EXCEPT those to which this conveyance is expressly made subject
as set forth below and those made, suffered or done by the Grantee or Grantor's predecessors in title,
easements ofrecord or use, and except general taxes and assessments (including irrigation and utility
assessments, if any) for the current year.
Grantee is relying solely upon Grantee's inspections as to the condition of the Property.
Grantor and Grantor's agents, employees and attorneys are not making, have not made and expressly
disclaim any representations or warranties, express or implied, with respect to any aspect, feature or
condition of the property, including, without limitation, the existence of hazardous waste, or the
suitability of the property for Grantee's intended use. Grantee shall independently verify all
information regarding any aspect or feature of the property provided by Grantor. Grantor does not
guaranty the accuracy of any information provided by Grantor, its agents, employees or attorneys.
Grantee is purchasing the Property in "AS IS" "WHERE IS" condition, subject to all faults (whether
they be physical, environmental or otherwise), including both latent and patent defects.
Grantor makes no covenants or warranties with respect to title, express or implied, other than
that previous to the date of this instrument, Grantor has not conveyed the same estate to any person
other than Grantee and that such estate is at the time of the execution of this instrument free from
encumbrances done, made or suffered by Grantor, or any person claiming under Grantor, subject to
taxes not yet due, any and all easements, restrictions, agreements and other matters of record, and
any and all matters which would be disclosed by a survey or physical inspection of the Property and
improvements thereon, as of the date of this instrument.
SPECIAL WARRANTY DEED - 1
Grantee, by execution of this Special Warranty Deed, acknowledges Grantee's acceptance
of the conveyance herein in accordance with the terms hereof and agrees to be bound by the
restrictions set out herein.

release and abandon that certain portion of the Easement over the following described lands:
The blanket easement on Lots 1, Block 12 and Lot 36, Block 10 as provided by Note 10 of the plat. The
S ft public utility easement on each side of the common interior lot line of Lots 35 and 36, Block 10. The S ft
public utility easement on each side of the common interior lot line of Lots I and 2, Block 12. The 10 ft public
utility easement along the west side of Lots I and 2, Block 12, all within Verona Subdivision No. 2.
ALL RIGHTS and privileges under the above -described document in and to the remaining lands
covered by the Easement and any and all prescriptive or other rights the Grantee has acquired through
occupancy and use over time of said remaining lands shall remain and continue in the Grantee and shall not be
affected in any way hereby.
