Re: The 10 at Meridian/ Meridian City File No.H-2021-0025
Dear Ms. Allen:
We are the owner of the property immediately south of the proposed project known as"The 10
at Meridian." We did not receive notice of the neighborhood meeting for this project.
However,when we learned of the project,we contacted the developer to discuss our main
concern.
Our main concern is that the project has been designed with Cobalt Drive located almost
entirely on our property leaving it to us solely to construct this road. Not only would it be
unfair to put the burden of constructing this public road on us (especially when we would have
access to only one side of the road), this location is contrary to the guidance of the Meridian Ten
Mile Specific Area Plan',Meridian and Ada County Highway District's policy that developers
design and construct project roads to and through their projects.
The location of Cobalt Drive is also contrary to the Development Agreement that encumbers
our property and which was adopted by the City of Meridian.2 We are very much aware that
the Development Agreement entered into by our predecessor in interest conceptually depicts
Cobalt Drive located on our property.3 However, the text of the Development Agreement is
absolutely clear that this location is conceptual only, and that neither Meridian nor ACHD are

approving roads and accesses until specific development plans are brought forward 4 Further,
when those specific development plans are brought forward-such as The Ten at Meridian-
the Development Agreement states that they are to comply with the guidance of the Ten Mile
Specific Area Plan, traffic conditions at the time of application,and the Meridian regulations
and ACHD policy in effect at the time of application. The Ten at Meridian,at least in so far as
the Iocation of Cobalt Drive is shown, does not comply with the applicable plans,regulations or
policies.
There are a number of public roads that will traverse our property, which we will have to
construct. These roads place a great burden on our property. We should not have to also
construct on our property the road associated with our neighbor's project to the north.
In compliance with the Ten Mile Specific Area Plan,Cobalt Drive should be located entirely
north of our property. We ask the Planning&Zoning Commission to reject the design of The
Ten at Meridian at least as concerns the location of Cobalt Drive.

ACHD's staff report in Meridians file for application H-2021-0025 is only in connection with the
annexation and rezone requests. As noted in ACHD's report,site specific conditions will not be
established until ACHD has reviewed the specific development application. This begs the question
whether the hearing before the Planning&Zoning Commission is premature. Note also that The Ten
at Meridian project plan presented to ACHD for its review depicts Cobalt Drive as straddling the
property boundary versus loading all of Cobalt Drive on our property. We find this curious and
wonder how it came to pass that,following ACHD's review of the annexation and rezone for The Ten
at Meridian, the location of Cobalt Drive was shifted entirely to our property.
