Through the Conditional Use Permit process, limitations can be placed on any conditional use including limiting capacity or, in most cases, limiting hours of operation and the number of children (when it is a daycare). All of these things are difficult to enforce regardless of fire code occupancy because any City does not have the capacity to have a Police Officer or Code Enforcement Officer stationed at every bar or daycare to ensure they are complying with their conditions of approval. In a large way, it is based on good faith. The recourse is powerful though because if the owner is found to be in violation of their conditions of approval, the conditional use permit can be revoked which would essentially end their business. In the case of The Oasis, I am sure that the Police will be making random trips to verify the business is operating appropriately because of the concerns raised and the contentious nature of the project as well as the Applicant’s continued cooperation and involvement with the Police to ensure Meridian PD are aware of everything. Meridian PD reviewed their safety plan, including our SWAT Captain, and have signed off on the plan noting that it was very detailed and well thought out. Furthermore, part of it is on the nearby residents to call code enforcement or the Police if they believe the business is over capacity or operating past their allowed hours. The conditions of approval are very important to understand so I hope all of the neighbors read my staff report and will read the most up to date conditions of approval in the findings that are set to be approved this Thursday. They can be found online in the public records here. These have not yet been signed, to be clear. But as noted, they are slated to be approved this Thursday. Broadway Ave Meridian, Idaho 83642 Greetings, I am writing to state my strong opposition to The Oasis CUP H-2021-004, at the Corner of Eagle Rd and Ustick which would allow The Oasis Night Club to operate. Nearly all the residents of the surrounding neighborhoods strongly oppose this CUP change owing to the traffic and safety concerns, likely increase of police presence, and parking shortages based on capacity. I am in support of new businesses coming to our area, although this is the wrong location for a nightclub. The Oasis Night Club would bring a potential of 500 individuals and their vehicles to an already overwhelmed intersection that will disproportionately surge during evening rush hours, causing severe traffic issues during critical times for the existing neighborhoods including Summerfield, Champion Park, Verado, Centrepoint Square, The Brickyard and Jackson Square. There have been fatal accidents at this intersection due to traffic. Between 2014-2018 the intersection sustained 190 crashes and 49 injuries. If allowed, this CUP will increase the accident fatalities in this area. An estimated 5,000 school-aged children live in the surrounding area, and increasing the traffic hazard for these children is not only reckless, but it shows a complete disregard for our city’s mission. According to several studies, including the 2013 study from the District of Columbia Crime Policy Institute (DCPI) alcohol-related crimes increase by 25% when in close proximity to bars or nightclubs. The percentage of crimes increases dramatically after 9 p.m. when The Oasis will have peak hours. Finally, The Oasis boasts a 500-person capacity with less than one-fourth of the parking needed for patrons. The nearby neighborhoods will be forced to have overflow parking from club-goers at all hours. The community is ill-equipped to 4 support this business; ultimately the business and community will suffer.
