Watertower, Ste 202 Meridian, ID 83642 Re: The Shops at Victory — Annexation/Rezone, Conditional Use Permit, Alternative Compliance and Preliminary Plat for approximately 4.79 acres on the southeast corner of Eagle and Victory Roads Dear Ms. Canning: LDR-II/DMG, LLC propose to develop approximately 3.68 (net) acres at the southeast corner of Eagle and Victory Roads in Meridian. The proposed development is planned and designed to include neighborhood commercial retail uses such as freestanding drugstore, and complimentary retail shops, services, office and restaurant components. The final mix of these uses will be dependant on market conditions at the time of development. The site is in the City of Meridian's impact area and its Comprehensive Plan designation is Mixed Use — Community. Our proposed zoning and development comply with the Comprehensive Plan. The proposed project is intended to fill a need for neighborhood services on the southern boundary of the City. Due to it's proximity in the surrounding trade area, the proposed project will reduce trips out of the area for daily consumer needs and services. Attached to this letter are our applications for: • Annexation of parcel S 1128223075 consisting of approximately 4.79 acres owned by The Axelrod Living Trust. Rezone of same parcel to CC. • Preliminary Plat — consisting of three parcels. • Conditional Use Permit — to approve a drive thru pharmacy use. • Alternative Compliance — Six foot high landscape wall for reduced landscape buffer adjacent to residential use. The gross site (to centerlines of Eagle and Victory) consists of approximately 4.79 acres, and is located on the southeast corner of Victory and Eagle Roads. We have submitted a Boundary Line Adjustment (BLA) with Ada County Planning to modify the Axelrod parcel S 1128223075 so that it is consistent with our annexation legal description (a copy of the BLA is included for your reference). With the BLA the Axelrod parcel is reduced from 3.92 acres to 3.69 acres; the Aldridge parcel is enlarged to 5.07 acres to conform to the Ada County requirement for RUT zoning. The BLA will be completed and recorded prior to the annexation ordinance approval. The owner of parcel R3193250010, Aldridge, does not wish to annex the balance of their property at this time. Eagle Road defines our westerly property line; Victory Road defines our northerly property line. A newly planned residential subdivision called Harcourt Subdivision (we believe to be in pre -plat stage) is the eastern boundary and a single family residence (Aldridge parcel) on 5 acres, (still in the County) is to our south. It is our intent to obtain general project approval through Planning and Zoning and City Council and to work with City staff on the final planning and construction details. As with most commercial developments that are tenant driven the development and construction may be completed in phases. Since this development will be required to extend both water and sewer mainline facilities from beyond its frontage, it is expected that reimbursement via sewer and water connection and/or impact fee credits will be available. Both a proposed conceptual site plan and conceptual elevations are included with these applications. The project consists of three pad sites adjacent to the main roads. It is our intent that the pharmacy use and associated drive-thru be principally approved. The offsite improvements on both Eagle Road and Victory are in ACHD's 5-year Capital Improvements Plan. ACHD has indicated that the intersection and frontage improvements will be constructed in 2010 (see attached email from Gary Inselman). ACHD acquired the necessary right-of-way along both street frontages in 2006. This property will pay its share of ACHD impact fees but will not be required to construct the offsite improvements. Access is critical to our drugstore and other retail tenant's success. This particular site was selected for this project due to an access/compensation agreement agreed to between the current owner, Axelrod, and ACHD. On Eagle Road we propose a right-in/right-out only access at approximately 216 feet and a full turns access approximately 423 feet south of the Eagle and Victory Roads intersection. On Victory Road we propose a right- in/right-out only access at approximately 216 feet and a full turns access approximately 438 feet east of the Eagle and Victory Roads intersection. All three parcels will share this access; cross access easements between the parcels will be granted. Due to the unique property constraints around Pad B we are proposing a six foot high landscape wall and reduced landscape buffer as an alternative compliance to the 25' CC zone landscape buffer adjacent to residential uses. We are proposing reducing in one area to 22.5' and in one small area off the southeast corner of Pad B to 10'. The total lineal footage of the landscape wall is 185 feet. In this area we propose a six foot high solid landscape wall as an alternate buffer. Additionally, landscape plantings in these areas will be installed and maintained. No deed restrictions or covenants exist that would effect this development application. We appreciate staff s assistance and cooperation in processing our applications.
