PROJECT NARRATIVE
SOMMERSBY SUBDIVISION
DEVELOPMENT AGREEMENT MODIFICATION
Liberty Partners, Inc., owner of the property which is the subject of this application, hereby applies
for a development agreement modification to allow the construction of four eight-plex units, to be
known as Sommersby Subdivision No. 3. The original development agreement was crafted to
reflect the condition that the Ten Mile/Pine Avenue intersection would need to be complete prior to
platting of the office lots and the remaining multi -family units. When the development agreement
was modified in 2005, the schedule for completion of the intersection was the year 2007.
Construction was initialized in 2008, but ACHD pulled out of the project when City of Meridian
projects in the five-year work plan were re -prioritized. The new proposed completion year is 2010,
creating an undue hardship for the applicant.
Many of the requests being received by the applicant are for one -bedroom apartments. The only
one -bedroom apartments are in the eight-plex floor plans. The land is zoned R-15 and was
approved as a planned development under the conditional use permit process to allow for reduced
minimum lot sizes, parking spaces, setbacks, reduced or no lot frontage and increased lot coverage.
Lots are accessed through an internal access easement.
The applicant agrees to leave the remaining L-O property unplatted until such time as the
intersection is completed by ACHD in 2010.
We ask for the following revision to the previous development agreement amendment:
5.8 The eight (8) office buildings located on Lots 33 through 40 and -the -few
shall not receive a
Certificate of Zoning Compliance until the North Ten Mile Road widening project
and the Ten Mile Pine Avenue intersection projects are complete and operational
The term "Certificate of Zoning Compliance" is used herein as defined in the
Zoning Ordinance of the City of Meridian, Idaho.
The property was annexed in 2000 under Ordinance No.633 and approved as a planned
development called Valerie Heights. The development agreement (Instrument No. 100 103 906)
has been modified to reflect current conditions. The amendment to the development agreement,
approved by the Meridian City Council on 11/15105, was recorded in the Ada County Recorder's
Office as Instrument No. 105184653 on 12/05/05.

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11-5A-5D, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
which the sign(s) had been posted.
