I apologize for the tardiness of my response, however I did not receive the finalized staff report until May 1, 2002 was not able to meet with staff until this morning. All in all, we are pleased with staff s report and have only a few concerns or points of clarification for the Planning and Zoning Commission hearing. Site Specific Comments (Preliminary Plat) Condition 3: A revised preliminary plat showing the proposed phasing plan has been submitted to the Planning Staff and to the Commission. • Condition 4: A revised preliminary plat showing the minimum housing sizes that constructed on each lot has been submitted to Planning Staff and to the Commission. • Condition 5: The cross-section of the I-84 landscape buffer proposes a six-foot (6') high vinyl fence on top of a berm. With the revised preliminary plat that has been submitted we have revised the buffer width along Interstate 84. We realize the Zoning Ordinance requires a 50-foot wide buffer along the interstate, however we are requesting to reduce this width to 35-feet. We are proposing this change for a variety of reasons. The proposed berm illustrated by the landscape plan was constructed in such a way as to provide a more aesthetically pleasing view from Interstate 84 and for the homeowner's who abut the Interstate. The berm has landscaping and a proposed six foot (6') high fence on top of a six -eight foot (6'-8') berm. This would provide some sound barrier for the residences of Marlin Subdivision and an attractive consistent view from the Interstate. We met with staff this morning and they felt this could be a feasible solution if the Commission and Council is agreeable. Staff is also recommending trees every 25-feet which is an increase in density from what is required by the landscaping ordinance. We are in agreement with the increase in density because it contributes to our solution regarding the noise and aesthetic issues we are facing by developing along the Interstate. With this request, we have included a note on the plat per staffs request that no structure shall be situated within 50-feet of Interstate 84 in order to preserve the intent of the 50- foot buffer. • Condition 11: ACHD is requiring the dedication of 48-feet increasing to 100-feet to the Interstate 84 right-of-way. As staff has noted, the 25-foot landscaped buffer will encroach into the additional right-of-way. The applicant's representative has met with ACHD staff regarding the timing of the proposed Linder Road overpass and at best, it may be constructed in 2020. ACHD staff did not have any hesitation into the possibility of entering into a license agreement for the encroachment of the landscape buffer into their right-of-way. We are also working with ACHD on their design of the potential future overpass. Most likely some landscaping will be a part of their design. We are requesting the Planning and Zoning Commission allow the landscaping encroachment into the right-of-way. The applicant is requesting this because one, the overpass may or may not be constructed, and if it is, it is far into the future, and two, the applicant is trying to preserve as much open space as possible for the proposed southern park. • Condition 12: The applicant will file a land use application with the Nampa -Meridian Irrigation District once preliminary plat approval is granted by the Meridian City Council and an encroachment agreement for the building lots encroaching into the Kennedy Lateral easement will be submitted with the final plat application. • Condition 13: A revised preliminary plat has been submitted with the corrected plat note of 5-foot side yard setback, no additional setback per story. Condition 14: A revised preliminary plat has been submitted showing the set aside areas for drainage retention and detention. The drainage for this project is proposed to be handled through subsurface drainage systems or a combination of surface swales and subsurface drainage systems as the site dictates once design is completed. Any historic drainage from parcels adjacent to this project which enter this project will be directed through this property. Site Specific Comments (Conditional Use Permit) • Condition 3: The applicant agrees with staff recommendation to reconfigure Lot 6, Block 3 and has submitted a revised preliminary plat to provide a view corridor into the park. This has revised the minimum house square footages slightly. A revised colored drawing has been submitted as well to illustrate this change. Condition 4: A revised preliminary plat has been submitted showing the correct net open space calculation. Condition 5: The applicant is providing two park sites which are amenities to Marlin Subdivision/Planned Development. Each park will have landscaping. A landscape plan was provided for each site, however due to the reconfiguration of the northernmost park as per staffs request, the landscaping plan will need to be revised slightly. The northernmost park will also provide a picnic area with a pad site made either of stone or concrete with tables and a barbecue pit, while the southernmost park will be more of an open field for children to play soccer, play pitch and catch, etc. We believe in this development and believe we have met the intent of the appropriate ordinances and the conditions of approval.
