On behalf of W.H. Moore Company, I would like to respond to the Site Specific and General
Requirements for Marlin Subdivision No. 1 as requested by Bruce Freckleton and David
McKinnon.
SITE SPECIFIC REQUIREMENTS
I. Applicant is to meet all terms of the approved preliminary plat, conditional use permit
and development agreement.
Response: The applicant shall meet all terms of the approved preliminary plat,
conditional use permit and development agreement.
2. If the pressurized irrigation system within this development is to remain a private
homeowners association system, complete plans and specifications shall be reviewed by
the Public Works Department as part of the development plan review process. A draft
copy of the pressurized irrigation system O&M manual must be submitted prior to plan
approval. The City of Meridian requires that pressurized irrigation systems be supplied
by a year-round source of water. If a creek or well source is not available, a single -point
connection to the culinary water system shall be required. If a single -point connection is
utilized, the developer shall be responsible for the payment of assessments for the
common areas prior to signature on the final plat by the Meridian City Engineer.
Response: The pressurized irrigation system within this development will be owned
and maintained by the Nampa -Meridian Irrigation District.
Street signs are to be in place, water system shall be approved and activated, pressurized
irrigation system approved and activated, drainage lots constructed, fencing installed, and
road base approved by the Ada County Highway District prior to applying for building
permits. All development improvements, including playground equipment and
landscaping shall be installed and approved prior to obtaining certificates of occupancy.
A letter of credit or cash surety in the amount of 110% will be required for all fencing,
landscaping, pressurized irrigation, sanitary sewer, water, etc., prior to signature on the
final plat.

4. Modify the plat to include the minimum house size that can be constructed on each lot
within the subdivision (pursuant to Condition 45, pg. 4 of the Findings of Fact and
Conclusions of Law for the Preliminary Plat).
Response: The minimum house size that can be constructed on each lot within the
subdivision will be reflected as approved by Council and will be placed on the final
plat prior to its recordation.
Sanitary sewer service and municipal water to this site shall be via extensions from
existing mains installed adjacent to the proposed subdivision. Applicant will be
responsible to construct the sewer and water mains to and through this proposed
development. Subdivision designer to coordinate main sizing and routing with the Public
Works Department
Response: Sanitary sewer and municipal water will be constructed to and through
this proposed development and will coordinate main sizing and routing with the
Public Works Department.
The soils investigation report submitted with the application indicates that groundwater
was encountered at some fairly deep depths within the project site. Design engineer to
provide a statement of compliance, prior to the approval of development plans, that
certifies that the centerline finish grade of the streets, public or private, is at least three
feet above the established normal ground water elevation. This is an effort to ensure that
the building footings are at least one foot above the high groundwater.

7. Correct the numbering of Block 3 to include the now missing Lot 13.
Response: The lot numbering of Block 3 shall be corrected prior to the signing of
the final plat by the City Engineer.
8. The following notes shall be added to the face of the plat:
7) Fencing adjacent to the micro path adjacent to Lots 9 and 10 of Block I shall be
limited in height to a four (4) foot tall solid fence.
8) This plat is subject to the Right to Farm Act Idaho Code 22-4503.
9) A 10 foot wide permanent public utilities, drainage, and irrigation easement is
designated to be centered on all interior lot lines, unless otherwise dimensioned.
Response: The above plat notes shall be added to the face of the plat prior to the
signing of the final plat by the City Engineer.
9. Complete the Certificate of Owners and accompanying Acknowledgment.
Response: We will comply with.
10. The Land Surveyor preparing the plat shall affix his official seal, signature and date to the
face of the plat and Certificate of Surveyor.
Response: We will comply with.
11. Staff's failure to cite specific ordinance provisions or terms of the approved preliminary
plat, conditional use permit or development agreement does not relieve Applicant of
responsibility for compliance.
Response: We will comply with all requirements of the preliminary plat,
annexation, rezone and planned development.
12. Applicant shall be required to pay Public Works development plan review, and
construction inspection fees, as determined during the plan review process, prior to
signature on the final plat per Resolution 02-374.
Response: The applicant will pay all appropriate plan review and inspection fees
prior to signature on the final plat.
13. Any drainage areas (detension/retension basins) must be designed to ensure that water is
retained only during 25-year storm events, and for a period of time not to exceed 24
hours. Side slopes within drainage areas shall not exceed 3:1.
Response: The design of the drainage areas will meet or exceed all requirements of
the Public Works Department and side slopes will not exceed 3:1.
14. Submit page two of the plat to the public Works Department for review.
Response: This shall be submitted to the Public Works Department.
15. Place the missing'/z-inch pin symbol on the northeast corner of Lot 32, Block 5, and the
misplaced %2-inch symbol on the southeast corner of Lot 6, Block 5.
Response: These corrections shall be made to the final plat prior to the signing by
the City Engineer.
If possible, please provide a written response to each of these comments, both site specific and
general, by noon on Thursday, August 1'.
I will be happy to answer any questions at the August 6, 2002 City Council hearing.
