The Planning and Zoning staff has reviewed the applicant's submittal, and we offer the following
comments and recommendations:
APPLICATION BACKGROUND & SUMMARY
The Applicant, Elaine Martin, has requested approval of a new, private street to serve a 13.8-acre
vacant parcel off Linder Road. The parcel is currently landlocked and, according to Staffs
interpretation of the Zoning Ordinance, must secure legal access from a public street in order to
become a legal parcel. An approved private street connecting to Linder Road is considered a form of
legal access. The proposed street is 24 feet wide and lies within a 30-foot wide easement on the
adjoining property. The Applicant intends to use the land as a contractor's yard for storage of concrete
barriers.
In a letter to the Applicant, Ada County Highway District staff has stated that ACHD will not require
the construction of a public road to access the Martin site. If private access can be obtained through the
City of Meridian, ACHD is allowing the contractor's yard use to be served only by a private street.
LOCATION
The subject property is located on the west side of N. Linder Road, approximately t/4 mile north of W.
Franklin Road, just south of the railroad, within Section 11, Township 3 North, Range 1 West.
SURROUNDING PROPERTIES
North: Two industrial development parcels, one with Haz-Tech and the other vacant, zoned I-L. The
UPRR rail corridor lies north of these lots.
South: One 2.6-acre parcel, zoned I-L, containing new Storage Cubbies project. A 10-foot landscape
strip is adjacent to the south side of the proposed private street. Cafarelli Subdivision, including
Interstate Battery, lies south of the Eight Mile Lateral on the south side of the Martin property.
East: A childcare facility, zoned L-O, and single family residences, zoned R1 (Ada Co.)
West: The 13.8-acre Martin parcel lies at the west terminus of the private street. A 42-acre vacant
parcel owned by Mr. Ronald VanAuker lies west of the Martin parcel.

ADDITIONAL CONSIDERATIONS
Haz-Tech, Inc. Parcels: The private street easement crosses two existing parcels, both of which are
owned by Haz-Tech, Inc. These parcels were illegally split. The western most parcel (Parcel
No.S1211449010) does not have legal street frontage. In addition, the existing building on the eastern
most parcel does not have a Certificate of Occupancy due to lack of compliance with the approved site
plan (landscaping). Staff is recommending a condition of approval of the private street is that these
parcels be legally subdivided prior to any future improvements of Parcel No. S 1211449010.
Use of Martin Parcel: This Miscellaneous Application is only for approval of a private street and
technically has no bearing on the use of the 13.8-acre Martin parcel to the west. The Applicant
included information on this parcel to inform Staff and Council of the need for the street. Since this
parcel is annexed and deemed a buildable lot once access is provided, the Applicant may submit
directly for administrative approval of a Certificate of Zoning Compliance if the private street is
approved.
Intersection Design: Staff has some concern about the turning radius from N. Linder Road onto a 24-
foot wide street, especially with the anticipated tractor trailers used to haul the concrete barriers.
Applicant should discuss this design at the hearing and ensure the City that the intersection of the
private street and Linder Road will not create any hazardous conditions.
RECOMMENDED CONDITIONS
I. The existing, vacant parcel owned by Haz-Tech Holdings (Parcel No. S 1211449010) on which
the ingress -egress easement lies will not be granted any building permits and is prohibited from
accessing the proposed private street until the two Haz-Tech parcels have been legally
subdivided as recorded lots.
2. The private street shall be constructed to ACHD design standards.
3. A blanket easement shall be provided over the 24-foot wide street section for City of Meridian
sanitary sewer and water utilities. The utilities within the private street easement shall be
designed to Public Works Department standards.
4. With the exception of an accessory office building to serve only the contractor's yard or similar
low -intensity use, the Applicant shall, prior to any development of the Martin parcel, secure a
public street access to said parcel. At such time, the private street shall become an emergency
access only and measures constructed on the private street to restrict public vehicular access.
5. The private street shall be clearly signed with "No Parking" signs to prohibit any parking
within the 24-foot wide street section.

6. A minimum six-foot wide landscape strip shall be provided along the north side of the private
street, to be improved with at least nine (9) trees and some vegetative groundcover the full
length.
7. The Applicant shall ensure the proposed 24-foot wide gate shown at the west terminus of the
private street (see Driveway Plan, Sheet ST-1, 4-18-02) is accessible by emergency vehicles, to
the satisfaction of the Meridian Fire Department.
8. Prior to erecting a street sign, the proposed name of the private street, W. Taylor Lane, must be
approved by the Ada County Street Naming Committee. Applicant shall ensure the Community
Planning Association has received a copy of the proposed name and submit a copy of the
approval letter to the Public Works Department prior to opening the street.
RECOMMENDATION
Staff recommends approval of the private street with the above conditions.

Application Information
The Ada County Highway District (ACHD) staff has received the above referenced application requesting
private road approval to provide access to a landlocked parcel. The 13.8-acre site is located on the
northwest corner of North Linder Road and West Franklin Road. The site has frontage on the Northern
Pacific Railroad right-of-way but not on Linder Road.

A. Findings of Fact
Trip Generation:
This development is estimated to generate additional vehicle trips per day (0 existing) based on the
Institute of Transportation Engineers Trip Generation Manual. The trips per day will be calculated
when a development application is submitted.
2. Impact Fees:
The impact fee rate from the fee tables for this will based on the impact fee ordinance in effect at this

Linder Road has 2-travel lanes with sidewalk abutting the site.

ACHD approved an application for Haz Tech's commercial building (MSPR-14-98) with a driveway
located at the south property line of the site on Linder Road. This is the location of the 30-foot
easement granted to this applicant for access to the landlocked parcel.
11. Five Year Work Program
Linder Road from Franklin Road to Ustick Road is in the District's Five-year Work Program (FY 03-
07) for a 3-lane urban street section plus bike lanes, curb, gutter and sidewalk. Project schedule is as
follows; 2005 for profession services, 2006 for the acquisition of right-of-way and 2007 for
construction and utilities.

B. Findings for Consideration
Private Streets
District policy 7205.6, requires that other jurisdictions in Ada County establish the requirements for
private streets. The District retains authority and will review the proposed intersection of a private and
public street for compliance with District intersection policies and standards.
The applicant is proposing to locate a private road (24-feet in width) over the 30-feet easement
(granted by Haz Tech) that runs from the west end of the driveway taking access off Linder Road.
ACHD does not make any assurances that the private road, which is a part of this application, will be
accepted as a public road if such a request is made in the future. Substantial redesign and
reconstruction costs may be necessary in order to qualify this road for public ownership and
maintenance.
The following requirements must be met if the applicant wishes to dedicate the roadway to ACHD:
Dedicate a minimum of 50-feet of right-of-way for the road.
Construct the roadway to the minimum ACHD requirements.
C. Site Specific Conditions of Approval
In September 23, 1998, ACHD approved the driveway located at the south property line of the site on
Linder Road, for application MSPR-14-98. The private road location is approved as proposed.
2. Comply with all Standard Conditions of Approval.
D. Standard Conditions of Approval
1. Any existing irrigation facilities shall be relocated outside of the right-of-way.
2. All utility relocation costs associated with improving street frontages abutting the site shall be borne
by the developer.
3. Replace any existing damaged curb, gutter and sidewalk and any that may be damaged during the
construction of the proposed development. Contact Construction Services at 387-6280 (with file
number) for details.
4. Utility street cuts in pavement less than five years old are not allowed unless approved in writing by
the District. Contact Construction Services at 387-6280 (with file numbers) for details.
5. All design and construction shall be in accordance with the Ada County Highway District Policy
Manual, ISPWC Standards and approved supplements, Construction Services procedures and all
applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State
of Idaho shall prepare and certify all improvement plans.
6. The applicant shall submit revised plans for staff approval,

8. Payment of applicable road impact fees are required prior to building construction in accordance with
Ordinance #195, also known as Ada County Highway District Road Impact Fee Ordinance.
9. It is the responsibility of the applicant to verify all existing utilities within the right-of-way. The
applicant at no cost to ACHD shall repair existing utilities damaged by the applicant. The applicant
shall be required to call DIGLINE (1-800-342-1585) at least two full business days prior to breaking
ground within ACHD right-of-way. The applicant shall contact ACHD Traffic Operations 387-6190 in
the event any ACHD conduits (spare or filled) are compromised during any phase of construction.
10. No change in the terms and conditions of this approval shall be valid unless they are in writing and
signed by the applicant or the applicant's authorized representative and an authorized representative
of the Ada County Highway District. The burden shall be upon the applicant to obtain written
confirmation of any change from the Ada County Highway District.
11. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other
regulatory and legal restrictions in force at the time the applicant or its successors in interest advises
the Highway District of its intent to change the planned use of the subject property unless a
waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the
time the change in use is sought.
E. Conclusions of Law
The proposed site plan is approved, if all of the Site Specific and Standard Conditions of Approval are
satisfied.
2. ACHD requirements are intended to assure that the proposed use/development will not place an
undue burden on the existing vehicular and pedestrian transportation system within the vicinity
impacted by the proposed development.

Request for Appeal of Staff Decision
1. Appeal of Staff Decision: The Commission shall hear and decide appeals by an applicant of the
final decision made by the ROWDS Manager when it is alleged that the ROWDS Manager did not
properly apply this section 7101.6, did not consider all of the relevant facts presented, made an error
of fact or law, abused discretion or acted arbitrarily and capriciously in the interpretation or
enforcement of the ACHD Policy Manual.
a. Filing Fee: The Commission may, from time to time, set reasonable fees to be charged the
applicant for the processing of appeals, to cover administrative costs.
b. Initiation: An appeal is initiated by the filing of a written notice of appeal with the
Secretary of Highway Systems, which must be filed within ten (10) working days from the
date of the decision that is the subject of the appeal. The notice of appeal shall refer to the
decision being appealed, identify the appellant by name, address and telephone number and
state the grounds for the appeal. The grounds shall include a written summary of the
provisions of the policy relevant to the appeal and/or the facts and law relied upon and shall
include a written argument in support of the appeal. The Commission shall not consider a
notice of appeal that does not comply with the provisions of this subsection.
c. Time to Reply: The ROWDS Manager shall have ten (10) working days from the date of
the filing of the notice of appeal to reply to the notice of the appeal, and may during such
time meet with the appellant to discuss the matter, and may also consider and/or modify the
decision that is being appealed. A copy of the reply, and any modifications to the decision
being appealed will be provided to the appellant prior to the Commission hearing on the
appeal.
d. Notice of Hearing: Unless otherwise agreed to by the appellant, the hearing of the appeal
will be noticed and scheduled on the Commission agenda at a regular meeting to be held
within thirty (30) days following the delivery to the appellant of the ROWDS Manager's
reply to the notice of appeal. A copy of the decision being appealed, the notice of appeal
and the reply shall be delivered to the Commission at least one (1) week prior to the
hearing.
e. Action by Commission: Following the hearing, the Commission shall either affirm or
reverse, in whole or part, or otherwise modify, amend or supplement the decision being
appealed, as such action is adequately supported by the law and evidence presented at the
hearing.

Dear Commissioners:
The Nampa & Meridian Irrigation District requires that a Land Use Change/Site
application be filed. Please contact Ms. Donna Moore, Asst. Secretary/Treasurer at the
District's main office at 466-7861.
All laterals and waste ways must be protected and all municipal surface drainage must be
retained on site. If any surface drainage leaves the site, the Nampa & Meridian Irrigation
District must review drainage plans. The developer must comply with Idaho Code §31-
3805. It is recommended that irrigation water be made available to all developments
within the Nampa & Meridian Irrigation District.

Enclosed please find a Land Use Change Application for your use to file with the Irrigation
District for its review on the above -referenced development. If this development is under a
"rush" to be finalized, I would recommend that you submit a cashier's check, money order or
cash as payment of the fees in order to speed the process up. If you submit a company or
personal check, it must clear the bank before processing the application.
Should this development be planning a pressure urban irrigation system that will be owned,
operated and maintained by the Irrigation District, I strongly urge you to coordinate with John P.
Anderson, Water Superintendent for the Irrigation District, concerning the installation of the
pressure system. Enclosed is a questionnaire that you must fill out and return in order to initiate
the process of contractual agreements between the owner or developer and the Irrigation
District for the ownership, operation and maintenance of the pressure urban irrigation system.
