He indicated that I should update you and provide some alternative language for the Development Agreement. The (65) acre Bews parcel south of the proposed Lochsa Falls City Park now has a client approved layout. I brought the layout into the City for a pre -application conference. The plan adds an additional 4.6 acres to the City Park and provides a collector roadway off Ten Mile Road. This provides direct access to the additional park area and a local street connection to the stub street in Lochsa Falls. It is the determination of Brad Watson that this is the preferred route for the North Slough Sewer Trunk and the 12" water main. The sewer and water facilities would be constructed within the proposed streets of the Bews parcel. If this is the preferred route and the easement is granted by Bews, then one of the conditions needs to be altered to allow this new option. Page 11 of the Development Agreement (D2) "The Developer shall be responsible for a 14' wide hard surface pathway or section of parking lot over the utility easement running along the south boundary of the park site. The developer is responsible for coordinating the location of the easement with the Parks Department." May I recommend inserting after park site "or the developer may construct the utilities south of the subject property within the future street alignment of the Bews parcel. If the developer chooses to construct the utilities along the south boundary of the park site, the developer shall be responsible for coordinating the location of the easement with the Parks Department." Item I. — Cherry Lane Christian Church The Applicant's representative, Lary L. Woodard, submitted a letter dated 12-6-02 proposing two changes to the Findings. Staff is in agreement with these proposed modifications. Item K. — Salmon Rapids No. 5 Staff has attached a copy of a section from the minutes of the 12-3-02 City Council hearing on this item. It shows that Mr. Bird's motion was amended by Mr. Nary, amending the motion to include "engineering compliance with the Master Grading and Drainage Plan. Staff recommends the following section of the Order be amended to incorporate this change in the motion: Pg. 5, new #A.8: Add the following condition: "Prior to issuance of a building permit for any new dwelling unit, a licensed engineer shall certify compliance with the approved Master Grading & Drainage Plan for this subdivision." North of East Victory Road and west of South Locust Grove and it be noted that the site plan is revised as of November 26, 2002 and that all staff and applicant comments be included. That the Drainage Site Plan be shown on the Final Plat, also that it be noted on the Final Plat and also in the restrictive covenants of this subdivision and for the attorney to draw up Findings of Facts and Conclusions of Law and Decision and Order.
