Idaho Ave. Meridian, Idaho 83642 RE: Mil iron Subdivision Preliminary Plat — Letter of Intent Dear Mayor and Council; As representative for Dyver Development, LLC, please accept this application for Milliron Subdivision, located on the northeast corner of Black Cat Road and Cherry Lane in Meridian, Idaho, Section 03, Township 3 North, Range 1 West of the Boise -Meridian. Milliron Subdivision includes 25.86 acres and has been designed with 88 lots (83 residential, 5 common). An existing zoning designation of R-4 is currently on the subject parcel, and the preliminary plat is designed to meet this zoning district. A density of 3.21 dwelling units per acre is proposed. The current owners of record for the property are Ricky and Cathy Milliron. Dyver Development, LLC has this property under contract, and the property owners have provided a letter of consent (signed affidavit) regarding the submittal of this application. This letter is included with the land use application for the preliminary plat, together with filing fees and various exhibits. The enclosed applications have been submitted in accordance with the requirements of the Meridian Zoning Ordinance. The development has also been designed to be in compliance with the intent of the Meridian Comprehensive Plan. Specific Comprehensive Plan policies that support the requested zone change include: Population Growth Goal 1, Objective A, Action 6 (New residential development with provided Urban Services); Services Goal II, Objective A, Transportation, Action 6 (Street connections between subdivisions); Land Use Goal III, Ensure public services, Objective A, Action 1 (Development projects planned public services); Goal IV, Objective C, Action 1 (compatibility), 3 (usable open space), 5 (sidewalks, curbs, gutters, etc.), Objective D, Transportation Corridors, Action 2 (Restrict curb cuts/access on collectors); Goal V, Objective C, Quality, Action 1 (Require common area); Lots within this development range in size from a minimum 8,000 square feet to 26,504 square feet. This larger lot will contain the existing single family dwelling that is currently located on the site. All streets will be public and will be constructed, along with curb, gutter and sidewalks, to Ada County Highway District and Meridian City standards. Sewer and water service is readily available and will be provided by the City of Meridian. Drainage will be retained on -site and will be designed to the standards of all appropriate regulatory agencies. A pressure irrigation system will be provided for all lots within the development. The development has been designed to include landscaping at the entrance to the development and along Black Cat and Cherry Lane. A centrally located private park containing 1.24 acres is planned and the total common area landscaping totals 3.39 acres (13%), including 1.43 acres (5.51%) as usable open space. All common landscape area lots would be owned and maintained by the Homeowners Association that will be established for the subdivision. In all, Milliron Subdivision will be a quality and compatible addition to this area of Meridian. The development is adjacent to similar approved residential development to the north, south and east. The development is in compliance with the City's Comprehensive Plan and will benefit the public interest by providing desirable housing needs to this area of the City while allowing for the continued improvement and expansion of city services and an increase in the City's tax base. Sincerely, Shawn L. Nickel Representing Dyver Development, LLC DEVELOPMENT STATEMENTS FOR MILLIRON SUBDIVISION 8/15/04 1. TRAFFIC IMPACT: On August 5, 2004, Shawn L. Nickel of Land Consultants Inc. met with Andrea Tuning and Lori Den-Hertog of Ada County Highway District regarding traffic and layout concerns associated with this proposed development. During this meeting, the main discussion was on existing and proposed stub street alignment, and access and design standards. Staff indicated that a traffic study would not be necessary for this development. Staff did not indicate any negative concerns regarding the development of this project in relationship to future traffic. It is this developer's opinion that, because of Black Cat Road and Cherry Lane are arterials, traffic impact by this subdivision should be minimal. 2. VARIANCE REQUEST: The submittal of the Milliron Subdivision does not require a request for variance at this time. 3. PRE -APPLICATION MEETING On Tuesday, August 4, 2004, a pre -application meeting was held with the Meridian City Staff. Present at the meeting were Shawn L.
