If all storm drainage is retained on -site there will be no impact on Nampa & Meridian
Irrigation District and no further review will be required.
However, if any surface drainage leaves the site, the Nampa & Meridian Irrigation
District requires a Land Use Change Application be filed for review prior to final
platting. Please contact Donna Moore at 466-7861 for further information.
All laterals and waste ways must be protected. The developer must comply with Idaho
Code 31-3805. It is recommended that irrigation water be made available to all
developments within the Nampa & Meridian Irrigation District.

A. Findings of Fact
1. Trip Generation: This development is estimated to generate 820 additional vehicle trips per day (10
existing) based the Institute of Traffic Engineers Trip Generation Manual, single-family residential
land use designation.
2. Impact Fees: There will be impact fees that are assessed and due prior to issuance of building
permits. The assessed impact fees will be based on the impact fee ordinance that is in effect at that
time.

Roadway Improvements Adjacent To and Near the Site
• Cherry Lane is improved with 4 travel lanes and a center turn lane. There is vertical curb,
gutter, and sidewalk abutting the site.
• Black Cat Road has two travel lanes and no curb, gutter, or sidewalk abutting the site. There
is a center turn lane at the intersection with Black Cat Road and Cherry Lane.
8. Existing Right -of -Way
• Cherry Lane has 90-feet of existing right-of-way abutting the site.
• Black Cat Road has between 50-feet and 83-feet of right-of-way abutting the site.
9. Existing Access to the Site
There is one driveway on Cherry Lane located at the east property line.
10. Site History
ACHD has not previously reviewed this site for a development application.
11. Capital Improvements Plan/Five Year Work Program
There are currently no roadways or intersections in the general vicinity of the project that are in the
Five Year Work Program or in the Capital Improvements Plan.
B. Findings for Consideration
Right -of -Way and Sidewalk
Cherry Lane and Black Cat Road
District policy requires 96-feet of right-of-way on arterial roadways (Figure 72-Fl B). This right-of-way
allows for the construction of a 5-lane roadway with curb, gutter, 5-foot concrete detached sidewalks
and bike lanes.
Cherry Lane
Cherry Lane is fully improved with 4 travel lanes, a center turn lane, and curb, gutter, and sidewalk.
No additional right-of-way will be required to be dedicated with this application and no additional
improvements to Cherry Lane will be required.
Black Cat Road
The adjoining road is not listed as a proposed project in the District's currently adopted Five -Year
Work Program or in the currently adopted 20-year Capital Improvements Plan. As such, the applicant
cannot receive reimbursement for dedicated right-of-way from available collected impact fees. The
applicant shall do one of the following:
a. Dedicate by donation a total of 48-feet of right-of-way along Black Cat Road, and construct a
minimum 5-foot wide concrete sidewalk along Black Cat Road, located a minimum of 41- feet from
the centerline of the right-of-way.
b. Do not dedicate additional right-of-way, but construct a minimum 5-foot wide concrete sidewalk
along Black Cat Road, located a minimum of 41-feet from the centerline of the right-of-way, in an
easement provided to the District.
c. Do not dedicate additional right-of-way, but construct a minimum 5-foot wide concrete sidewalk
along Black Cat Road, located at the back edge of the existing right-of-way. Accomplish all
necessary adjustments to properly accommodate existing drainage and utilities.
Internal Local Streets
District policy 7204.4.1 and Figure 72-FlA requires 50-feet of right-of-way on local streets. This right-
of-way allows for the construction of a 2-lane roadway with curb, gutter and 5-foot wide concrete
sidewalks.

The applicant has proposed all of the internal streets, with the exception of the entrance road (W.
Milliron Drive), to be constructed within 50-feet of right-of-way. The applicant is proposing 64-feet of
right-of-way for W. Milliron Drive at the intersection with Black Cat Road to accommodate a
landscape median. These proposals meet or exceed District policy and should be approved with this
application.
2. Street Sections
Internal Local Streets
District policy 7204.4.2 states, "developments with any buildable lot that is less that 1-acre in size will
typically provide streets having a minimum pavement width of 32-feet with curb, gutter and sidewalks.
The total street width shall be 36-feet from back -of -curb to back -of -curb. Variations of this width may
be allowed, depending on traffic volumes forecast to be generated by the development. Concrete
sidewalks shall be a minimum of 5-feet in width unless they are separated from the curb 5-feet or
more in which case the sidewalk shall be a minimum of 4-feet in width.
The applicant has proposed to construct the internal streets, with the exception of W. Milliron Drive,
as 36-foot street sections with rolled curb, gutter, and 5-foot attached concrete sidewalks. This
proposal meets district policy and should be approved with this application.
Residential Collector (1IN. Milliron Drive)
District policy 72-F1A, 7202.3.2 and 7202.3.5, requires that residential collectors be constructed as
36-foot street sections with vertical curb, gutter and 5-foot wide concrete sidewalks with no front -on
housing. The access restrictions for these street segments should be stated on the final plat. Unless
otherwise noted, parking should be prohibited on these street segments. Coordinate the signage
Program with District staff.
The applicant has proposed to construct W. Milliron Drive with vertical curb, gutter, and sidewalk from
Black Cat Road to N. Tessa Avenue. At the intersection of W. Milliron Drive and Black Cat Road, the
applicant is proposing to construct a landscape median and provide 21-foot street sections on each
side of the median. This proposal meets District policy
3. Roadway Offsets
Milliron Drive
District policy 7204.11.6, requires local roadways to align or offset a minimum of 300-feet from an
arterial roadway (measured centerline to centerline).
The applicant is proposing to construct W. Milliron Drive to intersect Black Cat Road 500-feet south of
W. White Ash Drive. This proposal meets District policy and should be approved with this application.
Internal Local Streets
District policy 7204.11.6, requires local roadways to align or offset a minimum of 125-feet from
another local roadway (measured centerline to centerline).
All of the internal streets exceed District offset policy and should be approved with this application.
4. Stub Streets
District policy 7205.5 states that stub streets will be required to provide intra-neighborhood circulation
or to provide access to adjoining properties. Stub streets will conform with the requirements
described in Section 7204.5, 7204.6 and 7204.7.

The applicant is proposing to extend W. White Birch Drive into the site from the east property line.
This street was constructed as a stub street to this site with the development of Golf View Estates
Subdivision. This proposal meets District policy and should be approved with this application.
5. Islands/Knuckles
District policy 7202.7 and 7207.5 require islands to be constructed a minimum of 4-feet wide with a
minimum area of 100-square feet and designed to safely channel traffic. The roadway on either side
of the traffic island should maintain a minimum of a 21-foot street section. District policy also requires
any proposed landscape islands/medians within the public right-of-way dedicated by this plat should
be owned and maintained by a homeowners association. Notes of this should be required on the
final plat. The design should be reviewed and approved by ACHD's Development staff.
The applicant is proposing one landscape island at the site entrance with Black Cat Road. This island
shall be owned and maintained by the homeowners association.
The applicant is proposing to construct two knuckles within the subdivision. These knuckles do not
have landscaped islands.
6. Driveways
Offsets
District policy F2-F4 (1) and 72-F4 (2), requires driveways located on local residential roadways to
offset a controlled and/or uncontrolled intersection a minimum of 50-feet (measured near edge to
near edge).
District policy 72-F5, requires driveways located on collector or arterial roadways with a speed limit of
35 to align or offset a minimum of 150-feet from any existing or proposed driveway,
The applicant will be required to close the existing residential driveway on Cherry Lane to match the
existing curb, gutter, and sidewalk.
Widths
District Policy 7207.9.3 restricts residential driveways to a maximum width of 20-feet.
7. Other Access
Black Cat Road is classified as a minor arterial roadway, and Cherry Lane is classified as a principal
arterial roadway. Other than the access specifically approved with this application, direct lot access
to Black Cat Road and Cherry Lane will be prohibited. A note of the access restriction should be
placed on the final plat.
C. Site Specific Conditions of Approval
The applicant shall do one of the following:
a. Dedicate by donation a total of 48-feet of right-of-way along Black Cat Road, and construct a
minimum 5-foot wide concrete sidewalk along Black Cat Road, located a minimum of 41- feet from
the centerline of the right-of-way.

b. Do not dedicate additional right-of-way, but construct a minimum 5-foot wide concrete sidewalk
along Black Cat Road, located a minimum of 41-feet from the centerline of the right-of-way, in an
easement provided to the District.
C. Do not dedicate additional right-of-way, but construct a minimum 5-foot wide concrete sidewalk
along Black Cat Road, located at the back edge of the existing right-of-way. Accomplish all
necessary adjustments to properly accommodate existing drainage and utilities.
2. Construct W. Milliron Drive, the main entrance, to intersect Black Cat Road 500-feet south of W.
White Ash Drive (measured centerline to centerline), as proposed.
3. Construct W. Milliron Drive with vertical curb, gutter, and sidewalk from Black Cat Road to N. Tessa
Avenue, as proposed. Provide 21-foot street sections on each side of the proposed landscape island
on W. Milliron Drive at the intersection with Black Cat Road.
4. Construct all of the internal streets, with the exception of W. Milliron Drive from Black Cat Road to N.
Tessa Avenue, as 36-foot street sections within 50-feet of right-of-way with rolled curb, gutter, and 5-
foot concrete sidewalks, as proposed.
5. Extend W. White Birch Drive into the site from the east property line, as proposed.
6. Close the existing residential driveway on Cherry Lane, located at the east property line, to match the
existing curb, gutter, and sidewalk.
7. Any landscape islands or medians shall be a minimum of 4-feet in width, with a maximum of 10-feet
in width at the site entrance with Black Cat Road. The applicant shall provide a 21-foot street section
(back -of -curb to back -of -curb) on each side of the landscape island. Any landscape islands or
medians shall be owned and maintained by the homeowner's association. Notes of this are required
on the final plat.
8. Other than the access that is specifically approved with this application, direct lot access to Black Cat
Road and Cherry Lane is prohibited and shall be noted on the final plat.
9. Comply with all Standard Conditions of Approval.
D. Standard Conditions of Approval
1. Any existing irrigation facilities shall be relocated outside of the right-of-way.
2. All utility relocation costs associated with improving street frontages abutting the site shall be borne
by the developer.
3. Replace any existing damaged curb, gutter and sidewalk and any that may be damaged during the
construction of the proposed development. Contact Construction Services at 387-6280 (with file
number) for details.
4. Utility street cuts in pavement less than five years old are not allowed unless approved in writing b
the District. Contact the District's Utility Coordinator at 387-6258 (with file numbers) for details.y
C.
5. All design and construction shall be in accordance with the Ada County Highway District Policy
Manual, ISPWC Standards and approved supplements, Construction Services procedures and all
applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State
of Idaho shall prepare and certify all improvement plans.
6. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or
other required permits), which incorporates any required design changes.
7. Construction, use and property development shall be in conformance with all applicable requirements
of the Ada County Highway District prior to District approval for occupancy.
8. Payment of applicable road impact fees are required prior to building construction in accordance with
Ordinance #198, also known as Ada County Highway District Road Impact Fee Ordinance.
9. It is the responsibility of the applicant to verify all existing utilities within the right-of-way. The
applicant at no cost to ACHD shall repair existing utilities damaged by the applicant. The applicant
shall be required to call DIGLINE (1-800-342-1585) at least two full business days prior to breaking
ground within ACHD right-of-way. The applicant shall contact ACHD Traffic Operations 387-6190 in
the event any ACHD conduits (spare or filled) are compromised during any phase of construction.
10. No change in the terms and conditions of this approval shall be valid unless they are in writing and
signed by the applicant or the applicant's authorized representative and an authorized representative
of the Ada County Highway District. The burden shall be upon the applicant to obtain written
confirmation of any change from the Ada County Highway District.
11. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other
regulatory and legal restrictions in force at the time the applicant or its successors in interest advises
the Highway District of its intent to change the planned use of the subject property unless a
waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the
time the change in use is sought.
E. Conclusions of Law
The proposed site plan is approved, if all of the Site Specific and Standard Conditions of Approval are
satisfied.
2. ACHD requirements are intended to assure that the proposed use/development will not place an
undue burden on the existing vehicular and pedestrian transportation system within the vicinity
impacted by the proposed development.

Request for Appeal of Staff Decision
Appeal of Staff Decision: The Commission shall hear and decide appeals by an applicant of the
final decision made by the ROWDS Manager when it is alleged that the ROWDS Manager did not
properly apply this section 7101.6, did not consider all of the relevant facts presented, made an error
of fact or law, abused discretion or acted arbitrarily and capriciously in the interpretation or
enforcement of the ACHD Policy Manual.
a. Filing Fee: The Commission may, from time to time, set reasonable fees to be charged
the applicant for the processing of appeals, to cover administrative costs.
b. Initiation: An appeal is initiated by the filing of a written notice of appeal with the Secretary
of Highway Systems, which must be filed within ten (10) working days from the date of the
decision that is the subject of the appeal. The notice of appeal shall refer to the decision
being appealed, identify the appellant by name, address and telephone number and state
the grounds for the appeal. The grounds shall include a written summary of the provisions
of the policy relevant to the appeal and/or the facts and law relied upon and shall include a
written argument in support of the appeal. The Commission shall not consider a notice of
appeal that does not comply with the provisions of this subsection.
c. Time to Reply: The ROWDS Manager shall have ten (10) working days from the date of
the filing of the notice of appeal to reply to the notice of the appeal, and may during such
time meet with the appellant to discuss the matter, and may also consider and/or modify
the decision that is being appealed. A copy of the reply, and any modifications to the
decision being appealed will be provided to the appellant prior to the Commission hearing
on the appeal.
d. Notice of Hearing: Unless otherwise agreed to by the appellant, the hearing of the appeal
will be noticed and scheduled on the Commission agenda at a regular meeting to be held
within thirty (30) days following the delivery to the appellant of the ROWDS Manager's
reply to the notice of appeal. A copy of the decision being appealed, the notice of appeal
and the reply shall be delivered to the Commission at least one (1) week prior to the
hearing.
e. Action by Commission: Following the hearing, the Commission shall either affirm or
reverse, in whole or part, or otherwise modify, amend or supplement the decision being
appealed, as such action is adequately supported by the law and evidence presented at
the hearing.

• The applicant is required to get a permit from Construction Services (ACHD) for ANY work in the right-of-way, includin(
but not limited to, driveway approaches, street improvements and utility cuts:
❑Pay Impact Fees prior to issuance of building permit. Impact fees cannot be paid prior to plan review approval.

On October 13, 2004, the Ada County Highway District Commission acted on the application for the
above referenced project. At that time, the applicant had not proposed an access point to Cherry
Lane. After meeting with the neighborhood and the City of Meridian, the applicant would now like to
propose an access point to Cherry Lane in alignment with Wales Avenue on the south side of
Cherry Lane. The applicant met with District staff to discuss the additional access point on October
22, 2004. A roadway in alignment with Wales Avenue meets District policy, and District staff will
approve an additional access point for the proposed subdivision in alignment with Wales Avenue.

Just wanted to let you know that there will not be an ACHD
representative in attendance at tomorrow's meeting. For some reason we
thought we had been notified that this meeting was cancelled, and due to
the holidays we don't have staff available.
t wanted to provide you with some comments about Milliron Subdivision,
in case the issue comes up with Council. When ACHD received the plat
the applicant was only proposing one access to the site off of Black
Cat, none on Cherry, and the stub street connection. The applicant got
some negative feedback from the neighbors and added an access to Cherry
Lane, which was approved by ACHD. We received calls about the stub
street connection from the neighbors, but it was after our process, and

Lane. After meeting with the neighborhood and the City of Meridian, the applicant would now like to

Cherry Lane. The applicant met with District staff to discuss the additional access point on October
22, 2004. A roadway in alignment with Wales Avenue meets District policy, and District staff will

The following will be the requirements and/or concerns to provide minimum levels of fire
protection for the proposed project:
Residential projects shall have a fire -flow as required by the International Fire Code.
Fire hydrants shall be placed an average of 400' apart. International Fire Code
Appendix D
2. Acceptance of the water supply for fire protection will be by the Meridian
Water Department.
3. Final Approval of the fire hydrant locations shall be by the Meridian Fire
Department.
a. Fire Hydrants shall have the 4 %2" outlet face the main street or parking lot
aisle.
b. The Fire hydrant shall not face a street which does not have addresses on
it.
c. Fire hydrant markers shall be provided per Public Works spec.
d. Locations with fire hydrants shall have the curb painted red 10' to each
side of the hydrant location.
e. Fire Hydrants shall be placed on corners.
f. Fire hydrants shall not have any vertical obstructions to outlets within 10'.
4. The phasing plan may require that any roadway greater than 150' in length
that is not provided with an outlet shall be required to have an turn -around.
5. All entrance and internal roads shall have a turning radius of 28' inside radius and
48'outside radius.

7. All portions of the buildings located on this project must be within 150' of a paved
