I Rev. 11103103 Annexation and Rezone Application March 11, 2004 TO: Meridian Planning and Zoning Department FROM: Larry Hellhake RE: 2855 Magic View Drive, Lot 9 Magic View Sub Amended This letter will outline and include all of the documents and narratives necessary to request an annexation and rezone of the subject property, The following numbered items correspond directly to those items outlined in the application. If you need any further information or documentation, please let us know. 1. Completed and signed application form is attached. 2. Recorded warranty deed showing the property in the name of Bob and Kathy Barnes is attached, 3. Notarized consent form from Bob and Kathy Barnes is attached. 4. Meets and Bounds legal description of the parcel is attached. 5. Subject property is located on the south side of Magic View Drive approximately 1000 feet west of Eagle Road. It is adjacent and west to the Medical Imaging facility, which is zoned C-G, general commercial. There is existing L-O zoning across Magic View to the north. The Meridian Comprehensive Plan calls for the Property bordering the subject parcel on the south and west to be C-G, general commercial. Rezoning the subject property to C-G, general commercial would be consistent with the requirements and desires of the Meridian Comprehensive Plan. 6. This area west of Eagle Road in the vicinity of Magic View Drive is an area in transition, going from five -acre agricultural home -sites to office and commercial use. The rezoning of this parcel to general commercial will fit very well with what is currently there or contemplated and will follow closely the desires of the city of Meridian to make a diversified economic base where all utilities and infrastructures are available. The rezone and annexation of this parcel follows closely the immediate action items as identified in Chapter 7 which calls for the implementation of the provisions of the plan regarding proposals that will promote those specific uses as outlined in the comprehensive plan. I have included with this application a co py of a what we currently believe to be an excellent use for the p pro coy c u- plan for ted . We are requesting the C-G zone under which this plan would be allowed. We have also had various parties interested in the property for uses that would require a general commercial use. It is our understanding that the tax rate on this parcel will not change until such time as a plat is recorded and/or construction commences for the development of the parcel. 7. The proposed zoning amendment follows the recommendation of the City of Meridian Comprehensive Plan as follows: A. Chapter 5: Develop policies and incentives to encourage infill and contiguous development B. Chapter 4: Evaluate development proposals based on physical, social, economic, and aesthetic criteria C. Chapter 4: Permit new residential, commercial, or industrial developments only where urban services can be reasonably provided, at the time of final approval and where the development is contiguous to the city D. Chapter 6: Identify and prioritize areas for future city expansion E. Chapter 7: Locate new community commercial areas or arterials or collectors near residential areas in such a way as to complement the adjoining residential areas 8. Civil Survey Consultants has prepared a map of one to one hundred scale as required for the zoning amendment. 9. One copy of the vicinity map at a scale of one to three hundred is attached. 10. A list of all property owners within three hundred feet of the external boundaries of the parcel being considered is attached. 11. A check in the amount of $675 made payable to the Meridian Planning and Zoning is attached. The check includes $625 for the annexation fees and $50 for the fire department review fee. 12. By this letter we affirm our agreement that the property will be posted not less than ten days prior to any public hearing scheduled for this annexation. We will follow this up with an affidavit, the form of which you may approve. 13.
