annexation of real property in MERIDIAN (CITY), for tax year 2006. The Idaho State
Tax Commission approves the map and legal description. This approval is limited to the
acknowledgement that the map and legal description meets the requirements of Section
63-215 Idaho Code, and Idaho State Tax Commission Rule 225.

Brad during this application regarding the Lowes' loading dock and would
like an affirmative statement on the record that the proposal meets the
criteria of this condition.

REQUESTED MODIFICATIONS TO STAFF'S RECOMMENDATIONS CITY OF R-ii' ',
Item B.3.c.3: Any structure over 50,000 square feet shall require a
conditional use permit for site plan review only and not for permitted uses
which are listed separately under the application.
Item B.3.d: The following standard shall apply to all development on the
subject property: "All loading docks, compactors, emergency generators, trash collection, outdoor storage or similar facilities and functions shall be
incorporated into the overall building and/or landscape design so that the
visual and acoustic impacts of said functions are minimized. Al
activities shall be in conformance with the Cit 's Noise Ordinance."
With those few revisions, we ask for the Council's approval of this
annexation and zoning request along with specific approval of the final site
design and elevations for the Lowes facility
To accommodate the tenant's schedule, we ask that council allow the staff to
receive the construction plans for this project prior to the finalization of the
annexation and rezoning procedure.

Tara, I have also forwarded this DA to Matt Smith so that he can obtain the appropriate
signatures. He should have the agreement to you by tomorrow before 10:00. Please make sure
this is placed on next Tuesdays, July 13, 2004 Council meeting, but ONLY AFTER the Kissler
Annexation Ordinance has been approved.

Marlene and Louisa,
I reviewed the redlined DA and the P&Z Department concurs with the
changes, with the exception of the "Remedy" and "breach" paragraph
changes. I would defer to Mr. Nicholls suggested modifications to these
paragraphs. I would also point out that we need some verification that
"Ustick Marketplace, LLC" is a legal entity in the State of Idaho before
proceeding.
Tara (Clerk's Office), regarding your question about whether Market
Square DA can be on the same agenda as Kissler, Marlene asked Bill
Nicholls opinion on this matter and he said as long Kissler's AZ
ordinance is read and adopted BEFORE Market Square on the agenda, it
would meet the legal test.

RE: AZ04-009 / Annexation and Zoning request of RUT to C-G for Market Square by
Smith Brighton
Dear Planning and Zoning Commission,
The following are conditions which must be included in the Development Agreement for
the above file. These conditions are an attempt to ensure the proposed development will
complement, not change the essential character of, nor be hazardous or disturbing to, the
neighboring residential use.
1. The applicant and/or property owner shall prepare an impact mitigation (management) plan
for the residential lands to the east. It shall include berming, fencing and landscaping, noise
abatement; hours of operation, and other concerns as expressed by the property owners and or
Homeowners' Association. The plan shall be reviewed and approved by the Heather
Meadows Homeowners' Association and also approved by the Commission before a building
permit may be issued.
2. Wall pack lights mounted on the east building elevation shall direct light only downward and
be placed no higher than 9 feet above the finished floor area.
3. All pole lights located outside of the public right-of-way within 150 feet of the east property
line will be provided with an additional shield to prevent not only light trespass, but spot
glare.
4. All pole lights located outside of the public right-of-way shall be of a type that reduces glare
and light trespass by throwing light downward rather than to the sides.
5. The hours for delivery to the north, east and south sides of the building shall be limited to the
hours of 8:00 a.m. to 4:00 p.m. Monday through Sunday. Sign shall be installed at the
entrance of the loading docks indicating it is a noise abatement area and that all compressors
and truck engines must be shut off during delivery.
6. A loading dock shall not be constructed. Trucks are required to back up to the overhead doors
where deliveries will be loaded / off-loaded directly into the building limited to the hours of
8:00 a.m. to 4:00 p.m. Monday through Sunday.
7. Sweeping of dock areas and parking lots shall occur form 6:00 a.m. and 10:00 p.m.
8. All storage and unpacking will be performed inside the building.
9. Waste collection services are limited to the hours of 8:00 a.m. to 4:00 p.m. Monday through
Sunday.
10. No outdoor speakers or horns are permitted with the exception of fire alarms.
