I would also point out that we need some verification that "Ustick Marketplace, LLC" is a legal entity in the State of Idaho before proceeding. These conditions are an attempt to ensure the proposed development will complement, not change the essential character of, nor be hazardous or disturbing to, the neighboring residential use. 1. The applicant and/or property owner shall prepare an impact mitigation (management) plan for the residential lands to the east. It shall include berming, fencing and landscaping, noise abatement; hours of operation, and other concerns as expressed by the property owners and or Homeowners' Association. The plan shall be reviewed and approved by the Heather Meadows Homeowners' Association and also approved by the Commission before a building permit may be issued. 2. Wall pack lights mounted on the east building elevation shall direct light only downward and be placed no higher than 9 feet above the finished floor area. 3. All pole lights located outside of the public right-of-way within 150 feet of the east property line will be provided with an additional shield to prevent not only light trespass, but spot glare. 4. All pole lights located outside of the public right-of-way shall be of a type that reduces glare and light trespass by throwing light downward rather than to the sides. 5. The hours for delivery to the north, east and south sides of the building shall be limited to the hours of 8:00 a.m. to 4:00 p.m. Monday through Sunday. Sign shall be installed at the entrance of the loading docks indicating it is a noise abatement area and that all compressors and truck engines must be shut off during delivery. 6. A loading dock shall not be constructed. Trucks are required to back up to the overhead doors where deliveries will be loaded / off-loaded directly into the building limited to the hours of 8:00 a.m. to 4:00 p.m. Monday through Sunday. 7. Sweeping of dock areas and parking lots shall occur form 6:00 a.m. and 10:00 p.m. 8. All storage and unpacking will be performed inside the building. 9. Waste collection services are limited to the hours of 8:00 a.m. to 4:00 p.m. Monday through Sunday. 10. No outdoor speakers or horns are permitted with the exception of fire alarms.
