RE: Inglenook Sub. FP 02-003
My understanding is that the City can proceed with signature, yes. Bill
Nichols' earlier memo to the Mayor provided two options - either re -open
the hearing on the application or have this neighborhood meeting and see
if the neighbors appeal. Then proceed as normal. I think the ball is in
the neighbor's court now and the City can finalize it.

We have been holding the order of approval on this FP file pending
outcome of the meetings with neighbors / Hubble.
Status? Can we go forward & pursue the Mayor's signature on this order?
Please let me know. Thanks.
Sharon

know it's not in the ordinance, but I thought that a notice of public
hearing for the final plat at the City Council level would cover the due
process issue. Is this wrong? The applicant has been made aware that
this is not the best way to go and this process would still leave it
open to a challenge. This was just an option we suggested.

My information is the developer does not wish to re -notice this matter
for an additional hearing. Is there a legal need to do so?

Conversation w/ P & Z today led me to think we would be redoing
(therefore re -noticing) Inglenook AZ, PP & FP hearings all at once to
cover all the bases, since FP is not a public hearing, and the notice
issue goes back to the AZ & PP hearings. Does that make sense to you
Bill & Will?
As soon as I hear "GO" I will notice it for the 21 st of May and let
I
Ashley R. know. New transmittals required? Include info on noticing
problem? Let me know.

Bill Nichols is out until Monday. Marlene said that Bill Nary is
handling it & should be in touch with your office hopefully today.
Sorry, that's all I know. I do have a new property owner list on that,
I'll bring it to you.

I never received the corrected list or any response to do anything with
this today, so I will work on it for the 21 st of May. Thanks for your
input Bill.

If it can be done May 7th that would probably be fine. I don't think
the applicant should pay to re -notice since the error was the City's not
theirs.

P &Z , Please provide a current property owner list since that was the
cause of this notice issue. Have you discussed w/ applicant re: paying
for re -noticing? (Today is the deadline for May 7th, otherwise it goes
on May 21 st.)
Questions from the Clerk's Office:
1. Final Plat before Council is NOT a public hearing, and is not
noticed. So does the notice issue go back to PP? How for do we have to
back up on this one?
2. Is there documentation of this issue? Correspondence w/ P & Z
Department & Applicant?
Please advise. Thank you.
