CONDITIONAL USE — PLANNED DEVELOPMENT REQUEST FOR
PLANNED DEVELOPMENT
BY LARKSPUR LLC
LOCATED ON ALL THE PROPERTY AT 2090 SOUTH MERIDIAN RD. AND ON THE
EASTERN PORTIONS OF 2190 AND 2240 SOUTH MERIDIAN RD.
Larkspur LLC requests approval of a Planned Development for the approximately 16.89 acres
located on all the property located at 2090 South Meridian Road and the eastern portions of the
properties located at 2190 and 2240 South Meridian Road. The purpose of the Conditional Use —
Planned Development is to develop the property into mixed uses of single-family homes, a
retirement community and neighborhood offices as part of a Use Exception. There are also
companion applications for a Preliminary Plat and Rezone for this property. This application of is
the combination of two previous applications for Larkspur Subdivision and Southwoods
Subdivision. The residential portion of this proposed Conditional Use would have 98 residential
living units on 13.25 acres for a density of 7.40 units per acres.
The surrounding land is as follows:
North: Single family homes with vacant land and the proposed Southern Springs Retail
Development
East: Single Family Homes, Meridian Greens Subdivision
South: Single Family Homes, Edmonds Subdivision
West: Single Family Homes, Bear Creek Subdivision
CONCEPT
The Larkspur Planned Development is proposed to be three uses composed of single-family
homes for seniors, a senior's retirement community with a number of levels of care and
neighborhood offices. The proposed 40 single-family homes are designed for individuals who
desire small yards with a minimum amount of maintenance. Besides building the Planned
Development, the Applicant will also be constructing the single-family homes. Based on past
developments by the Applicant it is expected that approximately 60% to 70% of the buyers will be
seniors.
The Retirement Community will be owned and operated by Spring Creek with a variety of care on
a senior's campus. There is proposed to be 27 independent living units for where individuals will
have their meals and receive medical care at the Assisted Living Center. The Assisted Living
Center will have 30 beds with a higher level of care. The third component of the senior will be an
Alzheimer's Center with 16 beds. There will extensive landscaping and large enclosed Gazebo for
recreational uses, meals and a community -meeting place.
The office area on the corner of Meridian Road and Calderwood Road will allow for small
neighborhood services. It is anticipated these office spaces will be an attractive location for
dentists, insurance agents, accountants, chiropractors, and other neighborhood business.
This use is compatible with adjacent properties in the neighborhood and provides a transition from
the residential to the proposed commercial development to the north (Southern Springs).
The existing owner of the property at 2190 South Meridian Road, Lot 2 Block 1, will retain
approximately 1.15 acres will not be part of the Planned Development. Similarly the existing
owner of the property at 2240 South Meridian Road, Lot 1 Block 1, will retain approximately
1.30 acres and will not be part of the Planned Development.
CITY OF MERIDIAN COMPREHENSIVE PLAN
The proposed development meets the goals of the City of Meridian Comprehensive Plan by
providing a variety of housing as set out in Goal V: "Offer a diversity of housing types for a
greater range of choice. Objective A: Encourage quality housing for all economic levels in a
variety of areas."
The development is in compliance with the City of Meridian, Future Land Use Map by requesting
a one step increase from a zoning of R-4 to R-8 with a 19.7% use exception for the office portion.
The homes, retirement community and offices in the planned development and the subdivision will
be connected to City of Meridian water and sewer services.
AMENITIES
The Planned Development will have a number of amenities of 1) more than 10% open space 2) a
meeting/recreation room 3) two Gazebos and 4) a neighborhood pathway system that will connect
to a City of Meridian Multi -Use Pathway. The common area is 17% of the Planned Development
(126,510 sq ft of common area out of a total gross area of 735,728 sq ft for the Planned
Development). The common areas are located throughout the Planned Development. The
pathway system will allow connection from the southeast corner of the planned development on
common Lot 35 Block 1 through the single-family home areas through common Lot 8 Block 2
and up to the pathway on the southern side of the Retirement Community and then to the Multi -
Use pathway along the Ten Mile Drain. If Southern Springs is developed to the north the Multi -
Use pathway will connect to the shops, restaurants and retail services anticipated for that
development.
The large enclosed gazebo in the Retirement Community will be available for use by all parties in
the planned development. The two smaller gazebos will provides for two central gathering places
on the common lots. '
NEIGHBORHOOD MEETINGS
In the application process there have been a number of neighborhood meetings through which a
number of concerns have been brought up. To address the Applicant has reached an agreement
with a number of the neighbors. A copy of that agreement is attached.
SCHOOLS
It is anticipated that the project will have minimal or no impact on the Meridian School District
since most of the residences are expected to be seniors with no school age children. Out of
approximately 250 homes, in similar developments through out Treasure Valley, the Applicant has
only had one homeowner with school age children.
FENCING
A six-foot perimeter fence will be constructed where Larkspur Subdivision is adjacent to Meridian
Greens and Running Brook Subdivisions, except at the Ten Mile Drain. A six-foot fence will
separate the Retirement Community from the patio homes except where common Lot 8 Block 2 is
adjacent to the Retirement Community. A six-foot fence will be built along the southern boundary
of the neighborhood offices and on the east side of Lots 1 and 2 Block 1. On the South side of the
single-family homes a six-foot perimeter fence is planned for Lots 23 to 29, Lots 31 and 37 Block
1 and Lot 25 Block 2. For the backyards of the single-family homes the fences will either be a
four -foot solid fence or open pickets. The type of perimeter fence will be determined in
conjunction with the adjacent neighbors.

These variances will allow the Planned Development to provide a range of housing that is not
widely available in this area of Meridian which is one of the goals of the City of Meridian
Comprehensive Plan: Goal V. The Planned Development allows the project to develop smaller
lots with good quality with homes. In similar projects with this type of housing, the Applicant has
found that most of the buyers have been seniors wh6 were down sizing from larger homes and
who desired smaller lots with less maintenance. Even though the Larkspur development will not
be age restricted, it is anticipated that a large portion of the buyers will be seniors.

The smaller lot sizes will allow the Applicant to provide small office buildings, which should be
attractive to businesses that are oriented to neighborhood services. The parking area will be a
common lot and a private street so that the interior lots will have street frontage.
FUTURE USE LOT 20 BLOCK 1
At this time Lot 20 Block 1 will be used as an emergency access only. At some time in the future
when Blackspur Way is connected through to Rosalyn Court the emergency access will not be
needed and Lot 20 Block 1 will become a buildable lot.
PRESSURE IRRIGATION
It is planned that a pressurized irrigation system will be constructed on the bank of the Ten Mile
Drain. Once constructed, the system will be owned and operated by Nampa and Meridian
Irrigation District. A number of the neighbors who do not have access to a pressure irrigation
system will be connected to the system being installed by Larkspur.
LANDSCAPE
The Applicant has been working with the City Arborist to mitigate the impact to healthy trees.
The trees to be saved will be temporarily fenced off to protect them during construction. The
existing home in the northwest corner of the property will be removed.

We as concerned citizens of Meridian Greens and Running .13reok Subdivisions and the
developers of the Larkspur Project (founerly Southwood. Subdivision and Larkspur now
being -submitted under one application) lave -niet and are in support cif this current
application with the following understanding:
1. The developers move the Alzheimer Care Facility to the West -side of the
retirement community portion of the project.
2. The developers- submit this application for a rezone with the City approval from
R-4_to R-$_on the residential and-fetiiement portions of the-pmject, allowing
us to minimize- thedensity-of zoning that is ciose to residential homes and
from R-4 to LO on the 3.25 acres adjoining Meridian road to be used as
professional office.
3. The develoPer_s install a fend to be agreed upon by -the homeowners and
approved by the City, between Meridian Greens -and Running Brook
Subdivisions and said-deveiopment. - -
4 The develepers provide a minimum -of 25-feet of separation between side yards,
and 30 feat of separation between rear yards of proposed cottages and
Meridian Greem and Running Brook Subdivisions.
5. The developers provide additional landscaping between the development, and
surrounding residential homes, and that the affected homeowners are,
permitted to have input on the -landscaping. plans for these areas.
6. The developer agrees to work with the associations in an effort to soften traffic
concernsby meeting with ACHD and other agencies to explore options.
7. - This application is not for R-15 zoning,- and this agreement will be null and void
- if R-13_ is required instead of theft-8 and LO zoning-beingmmque.sted.
8. Developers agree to keep the undersigned informed as -the application proceeds
through the various administrative levels of government.
9. The developers agree to provide a tap to the property line of those properties
adjacent to Larkspur subdivision, for the pressurized irrigation -system being
installed by the developers.

COMPROMISE AND
SETTLEMENT AGREEMENT
Comes now the Plaintiff above named, and each of the Defendants,
above named and hereby stipulate, compromise and agree as follows:
1. Quiet Title to Real Property: It is agreed that the real property the
subject of this action and which is legally described in Exhibit'A attached hereto
shall be owned by each of the following named parties as Tenants in Common
and that the Court may enter a Decree Quieting Title to the property as follows:
13.0% Donald Minegar, as his sole and separate
property
43.5% Leonard Reed, as his sole and separate property
43.5 % Sherri Lynn Norman, as her sole and separate
property

Opal Minegar has no right, title or interest in and to the real
property described on Exhibit A, but shall have the right to reside in the mobile
home on the real property as set out in paragraph 2 below.
2. Opal Mineaar Right to Reside in Mobile Home on the Premises the
Subiect of this Action: The mobile home on the property belongs exclusively to
Donald Minegar who agrees to pay all of the personal property taxes thereon.
It is agreed by all parties that Opal Minegar may reside in that mobile home,
rent free, so long as Opel Minegar: A) is able to drive her own automobile, and
g) is able to reside in the mobile home without full time assisted nursing care.
Otherwise, Opel Minegar agrees to vacate the mobile home. So long as she
resides in the mobile home, Opel Minegar agrees to pay all utilities on the
mobile home and to keep the insurance paid on the mobile home.
At such time as Opal Minegar vacates the mobile home then Donald
Minegar agrees to remove the mobile home from the premises within 90 days
and Donald Minegar may then sell or otherwise dispose of the mobile home as
he wishes.
3. Sale of Property' Property Taxes at Closing: It is agreed that the real
property described in Exhibit A shall be sold as soon after the 1st day of
November, 2006 as practical or at such time as Opal Minegar has vacated the
mobile home on the property, whichever date is latest.
The sales price shall be cash at closing unless otherwise agreed. The price
shall be determined by an Idaho licensed appraiser to be chosen by a majority
of the owners. In the event an owner disagrees with the appraised value then
that owner may employ a second appraiser and the sales price shall be an
average of the two appraisals. Any party advancing the cost of an appraisal
shall be reimbursed at closing for their contribution to the cost of the appraisal,
together with 10% interest per annum on that amount paid from the date paid.
3.1 Property Taxes at Closing: The originalprincipal balance of all
property taxes outstanding at closing shall be paid 74% by Leonard Reed and
26% by Donald Minegar and Sherri Lynn Norman. However, it is agreed that
any penalties, fees or interest charged on delinquent property taxes shall be
paid by Leonard Reed alone at closing. All other fees and closing costs,
including but not limited to realtor's fees (if any), title insurance, escrow costs
and the like, shall be paid by the parties, and the net sales proceeds shall be
split in the percentages of ownership of the property at the time of the sale.
3.2 Leonard Reed O tion to Purchase Donald Minegar Interest in
Real Property: At any time after the mobile home on the real property is

removed by Donald Minegar (and after Opal Minegar has vacated the premises)
it is agreed that Leonard Reed may purchase the 13% interest of Donald
Minegar in the real property. The price shall be paid in cash and shall be equal
to 130% of the value of the total property as determined by an Idaho licensed
appraiser to be chosen by Leonard Reed. In the event Donald Minegar disagrees
with the appraised value then he may employ a second appraiser and the value
shall be an average of the two total property value appraisals. Any party
advancing the cost of an appraisal shall be reimbursed at closing for their
contribution to the cost of the appraisal, together with 10% interest per annum
on that amount paid from the date paid. All costs of the sale and closing of the
13% interest shall be split equally between Donald Minegar and Leonard Reed.
4. Use and Occupancy of Real Property by Leonard Reed: Until the real
property is sold, Leonard Reed shall have the right to the use and occupy the
real property the subject of this action (except the shop currently occupied by
Donald Minegar and the mobile home currently occupied by Opal Minegar) rent
free. Leonard Reed shall pay his own utilities and the 74% of the real property
taxes as set out in this agreement until the date of sale.
5. Property Taxes Until Sale: Leonard Reed agrees that the property taxes
on the property described on Exhibit A shall be paid by him prior to the time the
taxes become more than three (3) years delinquent. After Leonard Reed pays
any real property taxes he shall provide written proof of payment to both Sherri
Lynn Norman and Donald Minegar of the amounts paid and broken down into
actual taxes and penalty, interest and fees. Within 15 calendar days after
written notice, Sherri Lynn Norman and Donald Minegar Leonard shall reimburse
Leonard Reed for 26% of the actual assessed real property taxes, excluding
from that computation any late charges or interest on the delinquent taxes. Any
portion of the property taxes paid that is a penalty, late fee or interest shall be
paid by Leonard Reed alone.
6. Attorneys Fees; Successors: Each party shall be responsible for their
own attorneys fees and costs in this action. The terms of this agreement shall
be binding upon, and be for the benefit of, the heirs, successors, and assigns
of the parties hereto.
7. Notices: Written notices shall be given by certified mail, return receipt
requested, postage pre -paid, to the following addresses;
