REQUEST FOR CONDITIONAL USE PERMIT FOR A GROUP Cl-llLD CARE
HOME at 924 E. Fourth Street by Voanna C. Ward dba Vo's Daycare
We have reviewed this submittal and offer the following comments as conditions of the
application. These conditions shall be considered in full, unless expressly modified or
deleted by motion of the Meridian City Council:
1.
Off-street parking shall be provided in accordance with Section 11-2-414 of the City of
Meridian Zoning and Development Ordinance.
2.
Outside lighting shall be designed and placed to not dITectly illuminate any nearby
residential areas, and in accordance with City Ordinance Section 11-2-414.D.3
3.
No signage has been submitted as part ofthis application, and none is permitted.
Sanitary sewer and water to this facility would be via existing service lines. Plans for
sewer and water service will be reviewed to see if the additional load would justifY
additional assessments. Please provide any information that you may have with regard to
your anticipated water demand. Applicant will be requITed to enter into an Assessment
Agreement with the City of Meridian prior to operation.

Zoning Certificate and Certificate of Occupancy for the daycare are requITed prior to
operation.
6.
Screened trash enclosures are to be provided in accordance with City Ordinance.
7.
The group child care home shall not adversely impact surrounding properties due to
children's noise, traffic and other activities.

of Health and Welfure-Child Care Licensing Division. Provide copy of license to the City
of Meridian. Operator's license shall be on-site for City inspection at all times.
Applicant shall ensure that immunization of all children is verified prior to acceptance into
program.
Applicant shall provide for screening of adjacent properties to protect children ITom
adverse impacts and to provide a buffer between properties.
Applicant shall provide for a fence of appropriate height/construction, to enclose play
areas. The existing fencing is not adequate to contain children or screen adjacent
properties.

If the conditional use permit is approved, Applicant is to schedule an appointment with the
Meridian Fu-e Department for inspection prior to operating. Operation of daycare without
proper approvals will result in revocation of conditional use permit.
13.
Ada County Highway District's requirements for this project are substantial. All required
ACHD improvements should be installed prior to operation of the facility, or cash or a
letter of credit deposited to ensure improvements are completed.
14.
Outdoor play areas are extremely limited and may be inadequate for the number of
children proposed.
15.
Applicant needs to remove the noxious weeds on the property; thistles at the rear of the
property are currently taller than the fence.
16.
Violation of any ofthe above conditions shall be cause to revoke a zoning certificate and
certificate of occupancy for a group child care home. The Conditional Use Permit shall be
subject to review upon ten (10) days' notice to the applicant.

RECOMMENDATION TO CITY

INTRODUCTION
1.
The property is located at 924 E. 4th Street, Meridian, Idaho.
2.
The owner of record of the subject property Voanna C. Ward of 924 E.
4th Street, Meridian.
3.
Applicant is the owner of record.
4.
The subject property is currently zoned Medium Density Residential (R~
8). The zoning district of Medium Density Residential (R-8) is defined within the
City of Meridian Zoning and Development Ordinance, Section 11-2-408(4).

The proposed application requests a conditional use pennit for
operation of a group child care home. The Medium Density Residential (R-8) zoning
designation within the City of Meridian Zoning and Development Ordinance requires
a conditional use permit be obtained for most uses including those requested by the

Applicant. (Meridian City Zoning and Development Ordinance, Section
11-2-409(A).

The use proposed within the subject application will in fact, constitute a
conditional use as determined by City Policy.

The Meridian Planning and Zoning Commission takes note of and
recognizes the concerns of Lois Garcia, 339 E. Carlton, Meridian, Idaho, dated June
8, 1999, who testified at the Planning and Zoning Commission hearing.

RECOMMENDATION
The Meridian Planning and Zoning Commission hereby recommends to
the City Council of the City of Meridian that they approve the conditional use
permit as requested by the applicant, subject to the following:
Adopt the Planning and Zoning Administrator and Assistant City Engineer
Recommendations as follows:

Adopt the Recommendations of the Meridian Fire Department as follows:
1.16 The Applicant shall not operate the daycare facility on the second floor
unless there is an automatic fire sprinkler system and two exit doors
directly from the second floor level to the outside.
Adopt the Central District Health Department's Recommendations as follows:

Department.
