Re: Development Agreement Modification — Verona
To Whom It May Concern:
On behalf of Primeland Investments Group, LLC and Primeland Development Company,
LLP; we are submitting this request to modify the development agreement governing the
Verona Subdivision. The details associated with this request are outlined below:
1 • Primeland Investment Group, LLC and Primeland Development
Company, LLP are the current owners of the property which is being
affected by the proposed modification. They are the successors to the
original parties to the agreement.
2• The original development agreement was approved by the City of
Meridian on May 29, 2003.
3 The original development agreement was recorded on June 13, 2003 as
instrument number 103097612.
We would like to modify the development agreement so that the area which was planned
for office and office -related uses can be subdivided. We are not proposing that the actual
area being used for offices be increased, only that more lots can be created inside that
approved office area.
To date, six office lots have been created and zoned appropriately at the northeast corner
Of Cortona Way and Ten Mile Road. This is the maximum number of office lots allowed
under the development agreement. We would like to create additional office lots at the
northeast corner of Cortona Way and McMillan Road and at the northeast corner of the
"bend" in Cortona Way. (These lots are identified as Lots 1 and 24, Block 1 of the
approved conditional use permit.) Since six office lots currently exist in the project, we
would like to increase the number of office lots allowed under the development
agreement from six to twelve.
We would also like to modify the development agreement to allow for general retail uses
on a small, 1.6 acre parcel at the northwest corner of Cortona Way and McMillan Road.
(This lot is identified on the project's approved conditional use permit as Lot 1, Block 3.

This modification would allow general retail uses on all the property surrounded by
Cortona Way, McMillan Road and Ten Mile Road.
The appropriate rezoning applications are being submitted concurrent with this
application.
We would therefore like to modify Paragraph 4.1 of the original development agreement
as shown below:
Construction and development for a Planned Development consisting of 146
detached single-family homes, 20 townhomes, 6-12 office lots, and 16 open space
lots, one general retail lot and16 open space lots, including addition to
Community Park.

incorporated herein by reference.
TOGETHER WITH all and singular easements, licenses, permits, water rights, the tenements,

reversions, the remainder and remainders, rents, issues and profits thereof, and all estate, right, title

that previous to the date of this instrument, Grantor has not conveyed the same estate to any person
