Proposed Request: Applicant requests that a right -in only access be allowed from Eagle Road
for the convenience store located on this site. The proposed access is located approximately 315
feet south of Pine Street.
Other: UDC 11-3H-4132 prohibits direct access to a state highway, at locations other than %2 mile
between arterial (section line) roads. Further, Plat Note #6 of Porky Park Subdivision, prohibits
direct lot access to N. Eagle Road (SH 55). Also, ITD plans to construct a right turn lane on
Eagle Road for northbound traffic to turn onto Pine Street. If this access is allowed, ITD may not
construct a free right from Eagle Road onto Pine. Staff believes that granting a variance would
allow a right or special privilege that is not otherwise allowed for properties that are adjacent to a
state highway. Staff finds that granting the subject variance would be detrimental to the public
health, safety, and/or welfare.
