Dear Ms. Martinez:
Please find the enclosed c-opy of the requirements for" PUBLIC
SWIMMING POOLS IN IPAHO" for your information and review. I have
marked the areas that we talked about to help you. As you see
residential swimming pools are by definition exempt from regulation
(IDAPA 16.01.7004,13). ~lthouqh there are no specific rules to
cover swimming pools located in the yards of home based family or
group daycare taclllties; 1 believe tha~ ~ne proprletors of daycare
-'facilities that have swimming pools or ponds should take some
precautions to protect the children they are caring for. It has
been my recommendation in the past that if the facility has a
swimming pool or a pond, that the swimming pool or pond be fenced
off from the designated outside play area to be used by the daycare
children. I qenerally recommend that a fence from three to four
feet (~imum) in height be used for this pur~e. This fence does'
not have to be a permanent fixture. 1J>1ease note that "Type B
(semipublic)" pools are only required to have fences "... at least
(4) four feet high...". And, "Pools which are located within~
Eestricted ana-~lose~ propertles ~ b~ considered for
