FP-00-026 ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT This matter coming before the, City Council for Final Plat approval pursuant to Meridian City Code § 12-3-7 on December 5, 2000, and tabled until December 19, 2000, and tabled until January 2,2001, and tabled until January 16, 2001, and the Council finding that the Administrative Review is complete which has included certain comments and conditions from Shari Stiles, Planning and Zoning Administrator, which are herein found fair and reasonable, and that Shari Stiles, Planning and Zoning Administrator, commented at the hearing, and Susan Wildwood testified on beh~alf of the Applicant, and the Council having considered the requirements of the preliminary plat the Council takes the following action: ORDER OF CONDITIONAL APPROVAL OF -- PAGE 1 OF 4 FINAL PLAT EOR AUTUMN FAIRE SUBDIVISION NO. 1 BY: GEM STAR PROPERTIES, LLC (FP-00-026) IT IS HEREBY ORDERED THAT: 1. All road and street name signs shall be installed before construction is started. The Central District Health Department requires after written approval from the appropriate entities are submitted, they can approve this proposal for central sewage and central water; that plans must be submitted to and approved by the Idaho Department of Health and Welfare, Division of Environmental Quality for central sewage and central water; that run-off is not to create a mosquito breeding problem; and it is suggested that stormwater be pretreated through a grassy swale prior to discharge to the subsurface to prevent impact to groundwater and surface water quality; that engineers and architects should obtain current best management practices for stormwater disposal and design a stormwater management system that is preventing groundwater and surface water degradation. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: LOCATION AND SURROUNDING USES The property is generally located at the southwest comer of Black Cat Road and Ustick Road. North - Several large, unplatted parcels currently being used for agriculture, zoned RT in Ada County. South ' One single-family residence on approximately 2.6 acres, zoned RT in Ada County, south of which is Tumberry Subdivision. East - Ashford Greens Subdivision, zoned R-4 in Meridian, is directly across Black Cat. West - Several large, unplatted parcels currently being used for agriculture, zoned R-T in Ada County. SITE SPECIFIC COMMENTS Applicant is to meet all terms of the approved preliminary plat and development agreement. Applicant has not indicated whether the pressurized irrigation system within this development is to be owned and maintained by the Nampa & Meridian Irrigation District. The applicant shall be required to provide a backup source to the pressurized h'rigation system. If a well or surface source is not available, a single point connection to the City of Meridian's domestic water system will be allowed for the development but not for the park area due to its size. In the event that domestic water is used as a backup source, common areas w/thin the development will be a subject to City of Meridian water assessments. Payment of water assessment fees for the common areas is required prior to city signatures on the final plat map. o Compaction test results must be submitted to the Meridian Building Department for all lots receiving engineered backfill, The design of drainage areas shall ensure that water is retained only during 25-year storm events for a period of time not to exceed 24 hours. FP-00-020 Autumn Faire Subdivision No. I Mayor and Council December 1, 2000 Page 2 Street signs are to be in place, water system shall be approved and activated, pressurized irrigation system approved and activated, drainage lots constructed, fencing installed, and road base approved by the Ada County Highway District prior to applying for building permits. All development improvements shall be installed and approved prior to obtaining certificates of occupancy. A letter of credit or cash surety in the amount of 110% will be required for all fencing, landscaping, pressurized irrigation, sanitary sewer, water, etc., prior to signature on the final plat. Applicant shall be responsible to construct a temporary trash containment fencing around the outside perimeter of th~ subdivision, except where the City has expressly agreed, in writing, that such fencing is not necessary. Fencing is to be in place prior to applying for building permits. The owner of each lot, across which passes an irrigation/drainage ditch or pipe, is responsible for the maintenance thereofi unless such responsibility_ has been assumed by an irrigation/drainage district. This sudivision is subject to the terms of a development a~eement recorded as Instrument No. , records of Ada Countw, Idaho. Add an arrow symbol to the plat legend that depicts ~ont of house orientation. Place symbol on Lot 1, Block 14, toward Willowside Avenue; on Lots 11 and 12, Block 7, toward W'flloWSide Avenue; on Lot 10, Block 6, toward Willowside Avenue; Lot 14, Block 13, toward W'fllowside Avenue; Lot 2, Block 2, toward Autumn Faire Way; Lots 1 and 22, Block 8, toward Autumn Faire Way; Lot 1, Block 6, toward Valleygreen Avenue; and Lot 1, Block 7, toward Valleygreen Avenue. Although some of these lots show "FRONT" on the lots, the arrow symbol and designation on the legend as Front of House should be more readily understandable by buyers and homebuilders. Lot 1, Block 7, is a marginal lot that does not appear to be buildable. Provide a building envelope to show how a minimum 1,400 square foot home can be built on this lot with a two- car garage. This lot would be better suited as a landscape lot due to its location and configuration. FP-00-021 Bear Creek Subdivision No. 1 Mayor and Council December 1, 2000 Page 3 10. Lot 18, Block 7, and Lot 2, Block 6, do not meet the minimum 80-foot frontage requirement for the R-4 zone. Revise plat to conform. Staff will not support a variance to the frontage requirement for these lots. 11, What is the purpose of providing 60 feet of right-of-way for Autumn Faire Way? Ada County Highway District did not designate this road a collector. If the road were a collector, no front- on housing would be allowed. This road should be designed to the appropriate standard within the appropriate right-of-way. 12. Sanitary sewer service to this site will be via a temporary lift station in the Ashford Greens development. The developer shall enter into an operation and maintenance agreement with the City of Meridian. Applicant will be responsible to construct lateral sewer mains to and through this proposed development. Subdivision designer to coordinate main sizing and routing with the Public Works Department. Once the Black Cat Sanitary Sewer Trunk fee is established and approved by the Meridian City Council, such fees would be applied to each building permit issued in this development. The current estimated fee is $1,500.00 per lot. 13. Water service to this site will be via extensions of existing mains installed in adjacent developments, as well as from the new domestic well site within this development. Applicant will be responsible to construct the water mains to and through this proposed development. Subdivision designer to coordinate main sizing and routing with the Public Works Department. 14. Applicant's engineer will be required to submit a signed, stamped statement certifying that all street finish centerline elevations are set a minimum of three feet above the highest established normal groundwater elevation. 15. Sidewalks are to provide a clear five-foot-wide walkway pathway without encroachment of mailbox structures. 16. The surveyor shall stamp, sign and date the face of the plat. 17. All lots within, this development shall be subject to the applicable latecomers fees on the existing Ashford Greens sanitary sewer lift station and water main extension. Payment of all applicable latecomers fees for this phase shall be required prior to signature on the final plat. 18. Staff's failure to cite specific ordinance provisions or terms of the approved preliminary plat does not relieve Applicant of responsibility for compliance. GENERAL REQUIREMENTS All irrigation ditches, laterals or canals, exclusive of natural waterways, intersecting, crossing or lying adjacent and contiguous to the area being subdivided shall be tiled per City Ordinance 12-4-13. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. FP-00-021 Bear Creek Subdivision No. I Mayor and Council December l, 2000 Page 4 o Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 9-1-4 and 9-4-8. Wells may be used for non-domestic purposes such as landscape irrigation. Two-hundred-fit~ watt and One-hundred-watt, high-pressure sodium streetlights will be required at locations designated by the Public Works Department. All streetlights shall be installed at subdivider's expense. Typical locations are at street intersections and/or fire hydrants. Final design Iocations and quantity are determined after power designs are completed by Idaho Power Company. Street light contractor to obtain design and permit from the Public Works Department prior commencing installations. Submit "Final" letter from the Ada County Street Name Committee, approving the subdivision and street names. Make any corrections necessary to conform. Coordinate fire hydrant placement with the City of Meridian's Water Works Superintendent. Provide five-foot-wide sidewalks in accordance with City Ordinance Section 12-5-2.K.
