(PI88M .... the attached map) The map outlines 39 acres, of which 30 + ectal are owned by Berbera Wøterfield. The remaining 6.33 Acres as Waterfield Subdivision (Approved for construdion but not recorded) Is owned by DJJ L.L.C. (Ed Jenkins, Bill Jenkins & Ed DeCouto). Thank you for the opportunity to voice our opinion on the Comprehensive plan amendment (CPA 05-004). Approximately 2 yen ago we started a process to develop Waterfield Subdivision. \M1øn we reœived our final approval in 2005 to proceed with our construction meeting we lOon had a new Comprehensive plan to deal with and questions on how to proceed. At. a matter of fact we war. told that we would probably not be allowed to proceed. Attached is also our DJJ L. L. C. lettsr dated October 19, 2005 to planning Bnd Zoning, In rasped of your time and consideration, we would like to recap and make the following points: 1. Although we have been diligent in pursuing 'Waterfield Sub" The Comprehensive Plan Amendment has caused greet strain and concern 815 to how. when or even if we can proceed, 2. We understand that the homeowners of Peregrine Heights Sub do not want their :toning changed to mix use, but to remain "Residential", 3. Besides requesting Peregrina Heights Sub zoning to be changed from the master plan, they are also requesting that approximately 112 the distance of our property from their Western property boundary to McDermott road also be changed. 4. The buffer zone that P9"'9rine Heights Sub is requesting is greater in width than their own subdivision! This 18 øxœsslve and without thought and consideration for the property owners West of their property, 5. If Peregrine Heights Home Owners Aslocietíon is granted III change from the original "Mixed Use - Interchange" deaígnøtion, then a raasonable buffer on our property of no more than 250 Ft would be ecœptable to us. At this point, changing of the zoning of the 250 ft atrip to either "Medium" or "High Density" Residential would be acceptmble to us. 6. It is unreasonable for Peregrine Heights HOA to requUlt that the 8.33 Acres of Waterfield Subdivision be split into 2 different zoning classifications. In closing, we would recommend that if the comprehensive plan is adopted, leave the whole 39 acres as "Mixed Use- Intarchange". If Peregrine Heights is granted "Residential" zoning, then we are in agreement with a 250 Ft buffer zoned "Medium" or "High Density" Residential on our property. This 250 ft buff&r would line up approximately 1/2 way between the end of the cui de sac for VVaterfield Sub and the w88tem border of Peregrine Heights Sub. A cluster subdivision of 6 - 1 Acre lots was the result of the meetings and the procca was started. 2. The next approximately 1 ~ years Barbara Wøterfield sought approval for her subdivilÓOU. 3. After the required public meotings and approval process thru ADA County, initial approval was givun. 4. In April200S, Barbara Wararfield sold 8.33 Acres to DJJ L.L.C. for personal reasons. S. With fiDal approval. of ADA County Highway District requin;ments., final approval to have pro-coDSb'UCtion meetings. was giVCD on July 19,2005. 6. On September 20, 200S Barbara Waterfield infonned me of a çompreheosive plan meating for the North Meridian area. 1 picked up a set of documents and maps fOl" the September 22,2005 meeång which I attended. 7. Aftor this meetins and review of the written material we have gatbucd, it appears that we may or may not be able to ptoceed with our su.bdivíaion. Another change fi"om the plan map that bad indicated our propeny was to be "Mixed Use Interchange" is discussed between Brsd Haw.ldna-Clark ofPJanni"8 & ZooiDg and the 3 commissioncr5. The result oftbis t414Ç1u1.Qìon was unclear. The minutes of that meeting may help elarify. I believe Brad said that he teCOIDIIleDded tbat the commkc:iGn approve the change in use &0111 "Mixed Use Interchange" to "ResideatiaJ.. Just as tbe letter dated October 14,2005 &om Peregrine HOA had outlined. I believe Brad HawIåns-C1ark also stated that the residential decÏgJlHrion would extend all tbc way to McDermott. Residential right up to au interchange is poor plAnning- Transitions are needed. 3.
