Hi Bill,
I agree with Dave Bailey and Laren Bailey’s comments. I have not had the opportunity to get an official response from
the BCA yet, but will do so an our next meeting in April.
The one additional comment I would add is regarding natural vs. man-made waterways. Laren suggested possibly
splitting them out into different sections of the code and I’m not sure there is enough clarity to know the difference? If
there is a desire to split these out, clear definitions would help.
Additionally, I know that engineer designers and planners will appreciate the clarity being offered.

common drive standards – requirements may include them being placed in a common lot and not an
easement and potentially requiring 30 foot wide common driveways when 4-6 dwellings take access.
The Commission and Council may want other changes.

Laren thanks for leading on this. My thoughts were similar.
On the common driveway question, the City Engineer should provide guidance for approval by the
council instead of leaving it up to their discretion on a case basis. I.e. a matrix for extra widths specified
for adding sewer mains, water mains, shared access to common areas or other considerations.
Also should include maximums for drive pavement width (26’?) adjacent landscape (10’ on one side, 5’
on other?) and total lot/easement width that could be required. (30’/40’).

We are concerned that some of the proposed changes have not
been vetted by the UDC Text Amendment Advisory Group. We have
reviewed the proposed changes and we have the following comments:
11-2D-4 – We do not have any concerns.
11-3A-6 – We appreciate the intent of the changes in this section,
especially removing the notice to surrounding property owners for
easements that often fell only on development property and did not affect
any other property owners. However, this section of code is very
convoluted and has created much confusion for staff and the applicant in
the past. We believe that better clarification on what waterways should be
left open and what waterways should be piped is required. Leaving it up to
Director Determinations can be seen as arbitrary and does not help
applicants to plan.
We suggest separating natural waterways and manmade irrigation and
drainage facilities into separate sections. This would clean up the text and
make it easier for the public and staff to understand the code and what
the requirements and expectations are.
11-5B-7C.3 – We do not have any concerns with this change and agree
that it was discussed with the UDC Text Change Advisory Group.
11-6C-3D – We are concerned that the width of the driveway is being
confused with the easement requirements for the utilities under the
proposed common driveways. Are you intending to require a wider
driveway or a wider utility easement or both? We feel that there needs to
be more thought and discussion on this issue so that it is complete and
does not cause more issues in the future.
11-5C – We agree that the change makes sense from a clarity standpoint,
and that the duplicate code section should be removed.

11-7-4C.3 – We agree that removing the Density formula from the UDC
makes sense, due to the fact that comprehensive plan dictates densities
not the UDC.

Good Afternoon All,
I am currently preparing an application to expedite a small number of UDC changes to
hearing as requested by the Mayor’s office. I wanted to give you all an update, so you
are aware of the City’s intentions. A second application will follow shortly after this one.

Council on May 11. Please note that I have made changes to the common driveway
