CLAIMS MUST BE BASED ON THIS COMMITMENT Any claim, whether or not based on negligence, which you may have against us concerning the title to the land must be based on this commitment and is subject to its terms. Title Risks: • that are created, allowed, or agreed to by you • that are known to you, but not to us, on the Policy Date -unless they appeared in the public records • that result in no loss to you • that Flrst affect your title after the Policy Date -this does not limit the labor and material lien coverage In Item 6 of Covered Title Risks 4. Failure to pay value for your title. 5. Lack of a right: • to any land outside the area specifically described and referred to in Item 3 of Schedule A, or • in streets, alleys, or waterways that touch your land This exclusion does not limit the access coverage in Item 5 of Covered Title Risks. 11. The failure of Your existing structures, or any part of them, to be constructed in accordance with applicable building codes. codes if notice of the violation appears in the Public Records at the Policy Date. The right to take the Land by condemning it, unless: a. a notice of exercising the right appears in the Public Records at the Polley Date• or b. the taking happened before the Policy Date and is binding on You if You bought the Land without Knowing of the taking. 3. The easement granted herein is granted for the purpose of allowing Grantee, or its agents, assigns, representatives, or contractors, at Grantee's sole cost and at no expense to Grantor, the right to connect to, and extend underground electrical lines through the easement property extend same to the dominant tenement. 5. Restoration of Servient Tenement. Within a reasonable time upon the completion ofthe installation of the underground electrical line as set forth above, Grantee, shall restore the surface of the servient tenement as near to its original condition as may be possible. In addition, Grantee agrees to re lace and/or rebuild any and all improvements located upon the servient tenement that may been damaged as a result of any work performed by Grantee or Grantee's employees, contractors, agents, or assigns. 6. Hold Harmless, The Grantee shall save and hold Grantor harmless from any and all liability far personal injury and property damage resulting from, or in any way connected with, any work performed upon the servient tenement as set forth in this Easement, or any related facilities or activities conducted or located within the servient tenement by Grantee, except liability for personal injuries or property damage caused EASEMENT -Page 2 solely by the negligence or wrongdoing of the Grantor. 7, Protection and Maintenance of Fences. Grantee shall have the right to cross any fence located upon the servient tenement whenever the crossing shall be necessary in the construction, maintenance, or operation of the above -described road or utilities; however, Grantee shall maintainproper enclosure at ail times and shall restore any fence as promptly as possible to the condition prior to the crossin . 8. Relinsuishment of Easement. In the event that electrical service is either extended to dominant tenement, or is available within a public right-of-way adjacent to the dominant tenement, at such a location that the owner ofthe dominant tenement shall agree that this Easement is no longer necessary, the owners of the dominant and servient tenements agree tv execute and deliver for recording a written document which will relinquish and release the Easement from the servient tenement. This Easement shall not be released under any circumstances without the written agreement of the owner of the dominant tenement. g. Term. Unless relinquished as set forth in section 8, above, this Easement Agreement, and the covenants, conditions, and restrictions contained herein, shall run with the land and be perpetual. 10. Warrantkof Title, Grantor covenants that Grantor is the owner of the servient tenement and has the right, title, and capacity to grant the easement granted in this agreement. 11. Authority to Grant.
