Request £or a Variance from Meridian City Code (MCC) l l-14-9F.3 (Wall
Signs), to Permit Two (2) Wall Signs on the Same Side of a Building Located
at 2929 E. Magic View by Imaging Center Radiologists, LLP (File No. VAR-02-
008).
The Planning and Zoning staff has reviewed the applicant's submittal, and we offer the following
comments and recommendationS:
APPLICATION SUMMARY
The Applicant, Imaging Center Radiologists, LLP, has requested a variance from the City of
Meridian's Sign Ordinance that prohibits more than one wall sign on each side ora building used
by a single tenant.
The Applicant would like to install a second wall sign on the east side of their building that
would be visible from S. Allen Street. Their existing wall sign is visible only from E. Magic
View Drive. An office building built on the southwest comer of Magic View Drive and Allen
Street eliminates the visibility of the existing wall sign from traffic driving on Allen Street.
The primary driveway access and parking lot for the Applicant's building is located on Allen
Street, and the Applicant would like to have signage visible on the building from both driveway
locations. The Applicant feels that the signage will alleviate any confusion the Applicant's
clients may have trying to find the building's entrance.
MCC11-14-9F.3 reads as follows:
"Number Allowed: Each business in office, commercial or industrial zones with exterior
frontage shall be permitted one wall sign. One additional wall sign shall be permitted per
exterior building wall under the conditions below, provided there is no more than one
wall sign on each side of the building:

The sign background area may he borrowed from that allowed on the
building wall facing the street;

b. The sign background area is a maximum of 9% of the building wall; and
c. The adjoining property is zoned commercial or industrial."
LOCATION
The Applicant's building is located at 2929 E Magic View Drive. The building is located
approximately 160' west of the southwest comer of the Allen Street and Magic View Drive
intersection.
SURROUNDING PROPERTIES
North - Lincoln Plaza Office Building, zoned L-O.
South -Hubble Engineering, zoned C-G.
East - Commercial/Office Building, zoned C-G.
West - Rural residential/agricultural, zoned RUT (Ada County).
REQUIRED FINDINGS
According to Ordinance 11-18-1, Variances, the Council may authorize in specific cases a
variance from the terms of either the Zoning or Subdivision Ordinance. Specifically, the
Ordinance lists the following Findings, all of which must be determined before granting a
variance:

That there are such special circumstances or conditions affecting the
property that the strict application of the provisions of this Title would
clearly be impracticable or unreasonable;
Staff finds that there are no special circumstances affecting the property that
would make the strict application of the sign ordinance impracticable or
unreasonable.
The Applicant already has the ability to place at least four signs on the property;
free-standing signs on both Magic View Drive and Allen Street and wall signs
(existing) visible from Magic View Drive on the east side of the building and the
north side of the building.
The applicant can re-locate the existing wall sign to the north side of the building
and that would allow for a new wall sign to be placed on the east side of the
building as requested. And apply for two free standing signs if they need more
signage.

That strict compliance with the requirements of this Title would result in
extraordinary hardship to the owner, subdivider or developer because of
unusual topography, the nature or condition of adjacent development, other
physical conditions or other conditions that make strict compliance with this
Title unreasonable under the circumstances, or that the conditions and

requirements of this Title will result in inhibiting the achievements or the
objectives of this Title;
Staff finds that the "L" shaped configuration of the subject lot does restrict the
visibility and identification of the Applicant's building when viewed from Allen
Street. However, staff does not find that the shape of the lot, or the physical
conditions affecting the property is an extraordinary hardship. The Applicant can
apply for a free-standing sign on Allen Street that should alleviate any confusion
with finding the Applicant's building.
Staff does not fred specific circumstances and conditions that make strict
compliance with MCCll-14-9F.3 unreasonable, or that the conditions and
requirements of this Title will result in inhibiting the achievements or objectives
of the Zoning Ordinance and Sign Ordinance.

That the granting of the specified variance will not be detrimental to the
public's welfare or injurious to other property in the area in which the
property is situated;
Staff finds that the requested variance will not be detrimental to the public's
welfare or injurious to other properties in the area. However, the goals and
objectives of the Sign Ordinance will be compromised should a variance be
granted.
The City Council should listen to any public testimony offered concerning
whether or not the surrounding property owners feel that the requested variance
will affect their properties.
That such variance will not have the effect of altering the interest and purpose
of this Title and the Meridian Comprehensive Plan.
Staff f'mds that the issuance of a variance for the additional wall sign will have the
effect of altering the purpose and interest of the Sign Ordinance.
The Sign Ordinance provides for additional wall signs and free-standing signs that
could be placed on site without the need for a variance. Staff fails to see the
justification of allowing a variance to the Sign Ordinance when several options
that comply with the Sign Ordinance exist.
STAFF RECOMMENDATION
Staff recommends denial of this variance request. Staff recommends the use of directional signs,
additional freestanding signs, and/or the relocation of the existing east elevation wall sign to the
north elevation in order to allow the proposed wall sign on the south end of the east wall.

The Ada County Highway District (ACHD) staff has received and reviewed the application and site plan for the item
referenced above and is submitting this no review letter in response to the lead agency's request for comment.
Based on the submitted information, it has been determined that the proposed development will generate less than 10
additional vehicle trips per day (VTD); or improvements exist adjacent to the site and ACriD has no site improvement
requirements attributable to this application.
ACHD policy states that no site related improvements will be required for developments generating less than 10
additional VTD. If the site plan or use changes in such a manner that more than 10 additional vehicle trips per day are
generated, then ACHD will review the site plan and may issue requirements based on the ACHD Policy Manual.
ACHD policy requires that before any improvements of any kind are constructed or installed within the public right-of-
way, a permit or license agreement permitting the improvements must be obtained.
All future design plans and construction shall be in accordance with the Ada County Highway District Policy Manual,
ISPWC Standards and approved supplements, ConstrUction Services procedUres and all applicable ACriD Ordinances
unless specifically waived in writing by the District. Meet District drainage requirements per section 8000 of the ACHD
Development Policy Manual. Contact District staff at 387-6170 for details.
Please contact the office for determination of possible road impact fees, prior to obtaining a building permit. These fees
are collected in accordance with Ordinance #195, the Ada County Highway District Road Impact Fee Ordinance.

NOTICE OF HEARING
NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian
and the Laws of the State of Idaho, that the City Council of the City of Meridian will hold
a public hearing at the Meridian City Hall, 33 East Idaho Avenue, Meridian, Idaho, at the
hour of 6:30 p.m. on July 2, 2002, for the purpose of reviewing and considering the
application of Imaging Center Radiologists LLP for a Variance to add an additional
sign on a large medical clinic and radiology center building generally located at 2929
East Magic View Drive.
A more particular description of the above property is on file in the City Clerk's
office at Meridian City Hall, 33 East Idaho Avenue, and is available for inspection during
regular business hours, Monday through Friday, from 8:00 a.m. to 5:00 p.m.
A copy of the application is available upon request. Any and all interested
persons shall be heard at said public hearing, and the public is welcome and invited to
submit testimony. Oral testimony may be limited to three (3) minutes per person.
Written materials may be submitted seven (7) days prior to the above hearing date so
that all interested parties may examine them prior to the hearing. All materials
presented at public meetings shall become property of the City of Meridian. Anyone
desiring accommodation for disabilities related to documents and/or hearings, please
contact the City Clerk's Office at 888-4433 at least 72 hours prior to the public meeting.
