I do realize that, I just have received multiple calls from neighbors concerned about the annexation and that it is setting
a precedent of redevelopment in the area. While I do completely understand the City’s perspective when it comes to
future water service needs, based on my conversations with the neighbors, unless it becomes a requirement, none of
the others want to annex (and probably still won’t want to when it does become required). The neighbors are extremely
leery of the project, as they are assuming this is a stepping stone to some other greater development of the property
(apartments, higher density, etc.), so we’ve had to field questions, concerns, and doubts from neighbors thinking we’re
doing something different than what is proposed in the project. I know that is not a problem for the City, but there are a
lot of neighbors that seem to be lacking in trust when it comes to overall development/growth/etc. and are looking for
reasons to doubt the intentions of the owner, thereby making our process a little more difficult (beyond the county/city
back-and-forth over the last year plus). Having to install major utility lines and annex does not help our case, regardless

of the number of times and ways I have attempted to reassure them that this project is only to build a single-family
home, with the annexation and other conditions being placed on the property by the city and/or other jurisdictional
agencies. I have been with the city 12 years, and in that time the city has never force annexed anyone and has no
apatite to do so in situations like this. However, if you want city services then it comes as a package deal. That may or
may not help with the neighbors.
The owner ultimately wants to build his home, and it is understood that he will have to comply with the final conditions
of approval, it is just difficult to justify when the requirement seems to be for something that is expensive when
compared to the planned project (especially when there is no known timeframe for any further extension of the water
main to the east). I know the owner is trying to get a handle on all related costs, so please see below for some follow-up
questions from the owner:
Water Main Extension
1. Do you have any cost projections for the water main extension that would be required? No.
2. Do you know which side of Paradise Ln. the water main would run on (north or south)? North
3. Would the water connection for the owner’s home come off of the new main extension (assuming it is extended
down Paradise Ln.), so he would avoid having to connect into the main in Locust Grove? The service should come off the
new line, which is consistent with the addressing.
4. Is there the potential to extend the water main only to that connection point, or is the to-and-through going to
require it go all the way to his eastern boundary (think I know the answer, but wanted to see if there was the potential
to limit the extension to the point of his service line)? It needs to go to the east boundary.
Sewer
1. Do you know where this future sewer mainline will run? Parallel to the water line.
2. Is the owner going to be responsible for a future sewer main extension down Paradise Ln to hook up to it, or will his
hook up be to the mainline in Locust Grove? This is important, as he is planning to install a “dryline” service for the
future hook up so there is limited disturbance of the yard around his home when that hook up becomes necessary. The
sewer service should be connected in Paradise lane also.
Please let me know if you can provide any further information on those questions so we can coordinate to ensure there
are no delays in the finalization of the project.

I understand, but hope you realize the only way all the homes in this county subdivision will eventually receive services,
is if each lot one by one is required to extend the mainlines as they are needed to replace failing wells. We are not
asking for anything that will not be required of the other homes in this development at some point in the future.

Thank you for the information on the waiver request. I will review with the owner and provide feedback. I know that
the water main extension (or denial of the waiver of that requirement) will be a discussion point during the hearing, and
the owner is not going to agree with that condition, considering the nature of his project request. I understand this is a
typical requirement of annexation, but this is not the typical annexation project, which is why we feel the waiver of both
requirements is appropriate and reasonable. Again, I appreciate you getting the information back to us so we can
review. Someone will be in contact with you, as well as the planning department, to discuss further steps.

I have reviewed your waiver request for the proposed home at 1630 E Paradise Ln. There are basically two waivers being
requested and I will address each of them separately.
Waiver one is a request to allow the property to annex into the city without connection to the city’s sewer
collection system. I agree the existing sewer collection system in not reasonably available at this time. I am
willing to grant this waiver with an agreement that the owner will initiate connection to the collection system as
soon as it is available. This will include construction of required mainline extensions (if any) and all fees required
to connect.
Waiver two is a request to set aside the city’s to and through policy, and waive the requirement to extended the
water main down Paradise Ln to the eastern boundary of the property. While I understand the request, I am not
willing to waive this requirement as it is consistent with our ordinance, and it is mechanism that will eventually
facilitate the annexation and connection of all properties within the existing county subdivision.
