Request for a Conditional Use Permit to renovate the existing Meridian Office &
Convention Center into a Private Jr./Sr. High School, plus a new gymnasium for

These conditions shall be considered in full, unless e~essly modified or deleted by motion of the
Meridian City Council:
APPLICATION SUMMARY & BACKGROUND
The applicant is requesting a Conditional Use permit to renovate the site of the existing Meridian
Office & Convention Center into a Private Jr./Sr. High School for Cole Valley Christian Church.
Approximately 70% of the existing structure (29,640 s.f.) is proposed to be renovated into
classrooms. The remsining 30% (13,150 s.f.) will remain as office space. Phase two of the project
will include construction of an 18,466 s.f gymnasium northeast of the existing Convention Center.
The subject property was originally used as a high school and later as an intermediate/middle
school. The school was built in 1912 and later expanded and remodeled in 1937. Around 1986
the property was abandoned as a school. After sitting vacant for about 10 years, it was renovated
into the Office & Convention Center it is today.
LOCATION & SURROUNDING USES
The subject property is located at 200 E. Carlton, at the intersection of Carlton Avenue and E. 2 ~A
Street. The address for the proposed gymnasium site is 1225 E. 2 'A Street.
The following uses surround the subject property:
North - Single family residences, zoned R-15
South - Crafts by Nature and a church, zoned O-T
East - Vacant pasture and single family residences, zoned R-15
West - Post Office, zoned R-15

STANDARDS FOR CONDITIONAL USES
The Commission and Council shall review the particular facts and circumstances of each
proposed conditional use in terms of the following and may approve a conditional use permit
if they shall find evidence presented at the hearing(s) is adequate to establish (11-17-3):

That the site is large enough to accommodate the proposed use and all yards, open
spaces, parking, landscaping and other features as may be required by this ordinance;
The site is not large enough to accommodate the required number of parking spaces. 215
spaces are required; 159 spaces are provided on the subject parcel. An additional 33 spaces
can be accommodated through a cross-parking agreement with the Apostolic Bible Church.
This would bring the total provided to 192 spaces, leaving a deficit of 23 spaces.
For the project to be approved as-submitted, a Variance application will have to be filed to
accompany this application to City Council.

That the proposed use and development plan will be harmonious with the Meridian
Comprehensive Plan and in accordance with the requirements of this Ordinance;
The Comprehensive Plan shows the subject property as "Existing Urban". Current zoning is
L-O; private schools require a CUP in the L-O zone according to the Zoning Schedule of Use
Control. Staff finds the proposed use and plan to be in Compliance with the Meridian Zoning
Ordinance and the Comprehensive Plan, as long as the conditions of the staffreport are met.

That the design, construction, operation, and maintenance will be compatible with
other uses in the general neighborhood and with the existing or intended character of
the general vicinity and that such use will not adversely change the essential character
of the same area;
Staff finds that the proposed development will not adversely change the essential character of
the general vicinity and will be harmonious with the intended character ofthe same area. The
property has been used as a school in the past; the proposed project will revert the site back
to its prior use as a school.

That the proposed use, if it complies with all conditions of the approval imposed, will
not adversely affect other property in the vicinity;
The Council and Commission should rely upon public testimony to determine if the
development will adversely affect the other properties in the vicinity.
That the proposed use will be served adequately by essential public facilities and
services such as highways, street, police, and fire protection, drainage structures, refuse

disposal, water, sewer or that the person responsible for the establishment of proposed
conditional use shall be able to provide adequately any such services;
Staff finds that the proposed development will be adequately served by the essential public
facilities and services listed above.
That the proposed use will not create excessive additional requirements at public cost
for public facilities and services and will not be detrimental to the economic welfare of
the community;
Staff finds that the proposed use would not be detrimental to the economic welfare of the
community, nor would it create the need for any new facilities or services to be paid for by the
public.
That the proposed use will not involve activities or processes, materials, equipment, and
conditions of operation that will be detrimental to any persons, property, or general
welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors;
The proposed use will certainly increase traffic on adjacent streets, especially at the beginning
and end of the school day. However, the use is relatively small when compared to public
schools in Meridian~they are proposing 7 classrooms for Jr. High use and 7 classrooms of
High School use. Staff does not anticipate that the proposed use will be detrimental to the
general welfare of the community by means of increased traffic, noise, smoke fumes, glare or
odors generated by the use. The applicant should be prepared to address traffic and parking
concerns with information about anticipated enrollment and parking needs.
That the proposed use will have vehicular approaches to the property which shall be so
designed as not to create an interference with traffic on surrounding public streets;
Staff finds that the proposed use will not create significant interference with traffic on the
surrounding public streets. The applicant has not proposed any new curb cuts onto existing
streets.
That the proposed use will not result in the destruction, loss or damage of a natural,
scenic or historic feature considered to be of major importance.
Staff finds that no natural or scenic feature will be lost, damaged or destroyed by issuance of
this conditional use.
SPECIAL CONSIDERATIONS
The following items are special issues with the project that warrant discussion with the Commission
and/or Council. They are not conditions of approval, unless so moved by the Commission or Council.

Parking: The applicant has proposed a site plan that provides 192 parking spaces. 215
spaces are required by the ordinance. The applicant should come to the hearing prepared to
address issues related to anticipated enrollment and parking needs for staff and students. If
the Commission finds that the proposed parking configuration is acceptable, a Variance
application will have to accompany this CLIP application for the hearing with City Council.
Since the Commission does not officially act on Variance requests, the Commission would
recommend approval of the project, conditioned on Council's approval of the Variance
request. If the Commission finds that the proposed parking configuration is not acceptable,
either the site plan will need to he modified, or the project would have to be recommended for
denial. StatFs initialjudgment isto recommend approval ofa Variance to ailow the proposed
parking configuration, but reserves final judgment until after the anticipated parking needs,
based on the school's past experience, are presented.

Gymnasium Design: The proposed gymnasium presents a large blank wall with few
architectural features. The first floor of the structure is concrete block; the second floor is
solid metal panel siding; the roof is also metal. On one hand staff feels that the blank fagade is
not very friendly on a site so close to Old Town. Recently, the Thornton Four-plex project in
Old Town was required to redesign their faqade facing the street to include windows and
dormers for visual interest and pedestrian friendliness along the street. The CLIP process
gives the Commission and Council an opportunity to require such improvements if they are
deemed to he in the best interest ofthe City. On the other hand, staffrecognizes that this is a
gymnasium, and gymnasiums rarely have windows, dormers, or other such architectural
features. Still, staffwould like to see some type of architectural treatment along E. 2 ½ Street
to make the street scene more appealing to pedestrians and others, and simply raises the issue
for discussion.
SITE SPECIFIC REQUIREMENTS
Trash Enclosure: The proposed site plan does not include a trash enclosure on the
gymnasium lot. The only trash enclosure shown is the existing enclosure at the office
building, which is over 250 feet from the proposed gymnasium~ Staff finds that a trash
enclosure should be added to the gymnasium lot and screened in accordance with Ordinance
11-12-1.C.
Signs: No information regarding planned signage was provided with the application. The
applicant should present information at the hearing regarding the number, location, and
maximum size of any proposed signs--wall-mounted or freestanding. All such signs will
require a separate sign permit and will be subject to design review by P&Z staff. Given the
historic nature of the structure and its relationship to Old Town, context-sensitive signage is
important to blend with the character of the building.
3. Parking: The proposed use requires 215 parking spaces, but only 159 spaces are provided on

the subject property, with an additional 33 available via a cross-parking agreement, leaving a
deficit of 23 parking stalls. Either a Variance application must be filed with the P&Z Dept. to
accompany this application to Council, or the site plan must be modified to show the required
number ofparking spaces. On the day this report was written, staffvisited the site and found
the parking lot surrounding the existing Office & Convention center to be completely full,
including adjacent on-street parking. The existing lot adjacent to the proposed gymnasium
was largely vacant. The applicant should address the anticipated parking demand for the
office uses that will remain, as well as the proposed school. Upon satisfactory resolution of
the parking demand versus supply issue, staff would support a Variance to the parking
requirements. Also, the applicant should supply written verification that the Apostolic Bible
Church is amenable to the cross-parking agreement.

Planters/Parking Lot: The proposed site plan does not include planters within the interior of
the parking lot. The parking lot is existing and is being modified less than 50%. Therefore,
staff finds that the requirements of Ordinance 12-13-11-4.B apply to this project, which
means that the perimeter landscaping and street buffers are required, but the internal islands
are not required until the parking lot is replaced or altered more than 50%. The perimeter
landscape strips shown on the proposed landscape plan are sufficient to meet this requirement.
Existing Trees: The existing large maple trees along E. 2 ~ Street, adjacent to the proposed
gym, shall be protected during construction as noted on the proposed plan. Applicant should
verify that the proposed new trees are sufficient to mitigate for the one existing tree proposed
for removal. The existing trees surrounding the Meridian Office & Convention Center shall
also be protected and retained.
Additional Landscaping: Many of the existing landscape strips contain trees, but the ground
surrounding them is left as weeds. Additional landscaping must be added to all such areas so
that all landscape areas are fully vegetated with grass, shrubs, and/or vegetative groundcover.
A pressurized irrigation system will be required to all landscape areas. This willrequire some
modifications to the existing pressurized irrigation system, as the current system provides
bubblers to the trees only, but does not currently water the ground.
Existing Structures: The proposed gymnasium site contains two existing structures, which it
appears will be demolished as part of this project. The applicant should verify whether or not
the existing structures will be demolished when the gynamsium is built.
Handicap parking: Staff questions whether the single handicap parking space adjacent to the
proPosed gymnasium meets the requirements of the Americans with Disabilities Act (ADA).
The applicant's architect (CTA Architects) shall verify at the next public hearing whether or
not the proposed site plan meets the requirements of ADA, and if not, provide a revised site
plan showing how the parking will be modified.
9. Building Height: The proposed gymnasium shall not exceed thirty- five (3 5) feet high per the

Maximum Building Height shown in Ordinance 11-9-1. Building elevations were submitted
with the application, but the height is difficult to read, though it appears that it may be 33 '-6".
The applicant should verify the actual height during the public hearing.
10.
Setbacks: The proposed structure is subject to all required setbacks of Ordinance 11-9-1 for
the L-O zone. The submitted site plan appears to meet all of the required setbacks.
11.
Water/sewer: This facility is currently served by the City of Meridian's sanitary sewer and
water systems. Existing sanitary sewer and water assessments will compared with the
anticipated impact, to determine whether additional assessments are warranted. If additional
assessments are warranted, applicant shall pay for them with the issuance of his building
permit for tenant improvements.
12.
As part of a conditional use permit, the City of Meridian may impose additional
restrictions/conditions.
STANDARD REQUIREMENTS
Existing trees sba.ii he protected and retained in accordance with Meridian City Code 12-13-
13.
Off-street parking shah be provided in accordance with the City of Meridian Zoning and
Development Ordinance and/or as detailed in site-specific requirements. All parking and
areas of circulation shah be improved with a hard surface in accordance with Meridian City
Code 11-13-4.D, and shall be installed and striped in accordance with the approved site plan
and Ordinance 11-13-4.F.

All construction and site improvements shall conform to the requirements of the Americans
with Disabilities Act.
A drainage plan designed by a State of Idaho licensed architect or engineer is required and
shall he submitted to the City Engineer (Ord. 557, 10-1-91 ) for all o fi-street parking areas. All
drainage water is to be maintained on-site. Storm water treatment and disposal must be
designed in accordance with Department of Environmental Quality 1997 publication Catalog
of Storm Water Best Management Practices for Idaho Cities and Counties and City of
Meridian standards and policies. Off-site disposal into surface water is prohibited unless the
jurisdiction which has authority over the receiving stream provides written authorization prior
to development plan approval. The applicant is responsible for filing all necessary
applications with the Idaho Department of Water Resources regarding Shallow Injection
Wells.
All exterior lighting, whether attached to the building or located within the parking lot, shall
be down-shielded or otherwise altered so that the light does not spill over onto adjacent

properties or right-of-way. All parking lot fighting shall be in accordance with Ordinance 11-
13-4.C.
All signage shall be in accordance with the standards set forth in Section 11-14 of the City
Zoning and Development Ordinance or as specifically approved. All signage is subject to
design review and shall require separate permits.
Provide five-foot-wide pedestrian walkways in accordance with City Ordinance.
Screen trash areas on at least three (3) sides. Coordinate screened trash enclosure locations
and construction requirements with Sanitary Service Company and provide a letter of
approval from their office when applying for a Certificate of Zoning Compliance (CZC).
Per Ordinance 11-17-4.B., a conditional use permit, when granted, shall be valid for a
maximum period of eighteen (18) months unless otherwise approved by the City Council.
During this time, the permit holder must acquire building permits and commence the
construction of permanent footings or structures. Time extensions are allowed per the
ordinance.
RECOMMENDATION
Staff recommends approval of the project with the conditions stated in this staff report and upon
satisfactory resolution of the issues memioned, including parking, signs, gymnasium design, tree
mitigation, trash enclosure, building height, and handicap parking.

A. Findings of Fact
1. Trip Generation: This development is estimated to generate 96 additional vehicle trips per day (472
existing) based on the Institute of Transportation Engineers Trip Generation Manual.
2. Impact Fees: No impact fees are due for schools.
3. Traffic Impact Study: A traffic impact study was not required with this application
4. Site Information: There is currently an operational 42,790 square foot, two-story office building and
convention center on this site.

Roadway Improvements Adjacent To and Near the Site
2 ¼ Street is currently improved with two lanes of traffic (no center turn lane) with curb, gutter and
sidewalk abutting and across from this site. Carlton Avenue is currently improved with two lanes (no
center turn lane) including curb, gutter and sidewalk adjacent to this site.
Existing Right-of-Way
There is currently 50:feet of right-of-way (25-feet from centerline) on 2 ¼ Street abutting this site. There
is currently 60-feet of right-of-way (30-feet from centerline) on Carlton Avenue abutting this site.
Existing Access to the Site
There are currently four access points into this site, three on 2 ~ Street and one on Carlton Avenue. The
access point on Carlton Avenue is a curb-cut type driveway that is currently paved 25-feet wide and
located approximately 140-feet west of 2 ~ Street. The southern most driveway on 2 ¼ Street is a curb-
cut type driveway that is currently paved 33-feet wide and located approximately 130-feet north of Carlton
Avenue. The middle driveway on 2 ~ Street is a curb-cut type driveway that is located approximately
120-feet north of the southern driveway, is currently paved 35-feet wide and appears to be shared with
the out parcel just to the south. The northern most driveway on 2 % Street is a curb-cut type driveway
that is located approximately 70-feet south of the north property line and is currently paved 20-feet wide.
10.
Site History
Part of this site was previously used as a school facility prior to converting to an office and convention
center as part of MSPR-03-97. With this application the owner was required to replace broken curb and
install sidewalk along Carlton Avenue. The driveway on Carlton Avenue was also approved as it was in
alignment with 2nd Street.
11. Five Year Work Program
There are no roads in the general vicinity that are currently in the Five Year Work Program.
B. Findings for Consideration
Right-of-Way
District policy 7204.4.1 and Figure 72-F1A require 50-feet of right-of-way on local streets. This right-of-
way allows for the construction of a 2-lane roadway with curb, gutter and 5-foot wide concrete sidewalk.
There is currently 60-feet of right-of-way for Carlton Avenue and 50-feet for 2 ~ Street. The applicant
should not be required to dedicate any additional right-of-way with this application.
Sidewalk
District policy requires 5-foot wide (minimum) concrete sidewalk on all local streets, except those in rural
developments with net densities of one dwelling unit per acre or less (7204.4.7).
Damaged Improvements
District policy 7203.6 requires the applicant of a proposed development to make improvements to
existing damaged sidewalk; curb and gutter construction or replacement; replacement of unused
driveways with standard curb, gutter and sidewalk; installation of pedestrian ramps; pavement repairs;
signs; traffic control devises; and other similar items in order to correct deficiencies or replace
deteriorated facilities. Therefore, the applicant should be required to fix any damaged curb, gutter and
sidewalk and replace any curb cuts that are not being utilized.
Access Points/Driveways
District policy F2-F4 (1) and 72-F4 (2), requires driveways located on local residential roadways to offset
a controlled and/or uncontrolled intersection a minimum of 50-feet (measured near edge to near edge).
Graveled driveways abutting public streets create maintenance problems due to gravel being tracked
onto the roadway. The applicant is proposing to utilize the four existing paved driveways on this site.
These driveways meet District policy for location and design and should be approved.
Driveway Widths
District policy 7207.9.3 restricts commercial driveways with daily traffic volumes over 1,000 vehicles to a
maximum width of 35-feet. Commercial driveways will be constructed as curb-cut type facilities if located
on local streets. The applicant is proposing to utilize four curb-cut type driveways that are approximately
35-feet wide, 33-feet wide, 25-feet wide and 20-feet wide. These driveways meet District policy for width
and should be approved with this application.
6. Special Recommendation to the City of Meridian
The applicant should provide a recorded cross access easement for parcel No. 1=,7745460020 (Apostolic
Bible Church) to use this parcel(s) for access to the public streets.
C. Site Specific Conditions of Approval
1. Replace any existing damaged curb, gutter and sidewalk and any that may be damaged during the
construction of the proposed development. The applicant should replace any unused curb cuts on 2
~ Street or Carlton Avenue with standard curb, gutter and concrete sidewalk to match existing
improvements. Contact ConStruction Services at 387-6280 (with file number) for details.
Comply with all Standard Conditions of Approval.
D. Standard Conditions of Approval
1. Any existing irrigation facilities shall be relocated outside of the right-of-way.
2. All utility relocation costs associated with improving street frontages abutting the site shall be borne by
the developer.
3. All design and construction shall be in accordance with the Ada County Highway District Policy Manual,
ISPWC Standards and approved supplements, Construction Services procedures and all applicable
ACHD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall
prepare and certify all improvement plans.
4. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other
required permits), which incorporates any required design changes.
5. Construction, use and property development shall be in conformance with all applicable requirements of
the Ada County Highway District prior to District approval for occupancy.
6. Payment of applicable road impact fees are required prior to building construction in accordance with
Ordinance #195, also known as Ada County Highway District Road Impact Fee Ordinance.
7. It is the responsibility of the applicant to verify all existing utilities within the right-of-way. Existing utilities
damaged by the applicant shall be repaired by the applicant at no cost to ACHD. The applicant shall be
required to call DIGLINE (1-800-342-1585) at least two full business days prior to breaking ground within
ACriD right-of-way. The applicant shall contact ACHD Traffic Operations 387-6190 in the event any
ACriD conduits (spare or filled) are compromised during any phase of construction.
8. No change in the terms and conditions of this approval shall be valid unless they are in writing and
signed by the applicant or the applicant's authorized representative and an authorized representative of
the Ada County Highway District. The burden shall be upon the applicant to obtain written confirmation
of any change from the Ada County Highway District.
Any change by the applicant in the planned use of the property which is the subject of this application,
shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and
legal restrictions in force at the time the applicant or its successors in interest advises the Highway
District of its intent to change the planned use of the subject property unless a waiver/variance of said
requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is
sought.
Conclusions of Law
1. The proposed site plan is approved, if all of the Site Specific and Standard Conditions of Approval are
satisfied.
ACHD requirements are intended to assure that the proposed use/development will not place an undue
burden on the existing vehicular and pedestrian transportation system within the vicinity impacted by the
proposed development.

Appeal Guidelines
Request for Appeal of Staff Decision
Appeal of Staff Decision: The Commission shall hear and decide appeals by an applicant of the
final decision made by the ROWDS Manager when it is alleged that the ROWDS Manager did not
properly apply this section 7101.6, did not consider all of the relevant facts presented, made an error
of fact or law, abused discretion or acted arbitrarily and capriciously in the interpretation or
enforcement of the ACriD Policy Manual.
a. Filing Fee: The Commission may, from time to time, set reasonable fees to be charged
the applicant for the processing of appeals, to cover administrative costs.

Initiation: An appeal is initiated by the filing of a written notice of appeal with the Secretary
of Highway Systems, which must be filed within ten (10) working days from the date of the
decision that is the subject of the appeal. The notice of appeal shall refer to the decision
being appealed, identify the appellant by name, address and telephone number and state
the grounds for the appeal. The grounds shall include a written summary of the provisions
of the policy relevant to the appeal and/or the facts and law relied upon and shall include a
written argument in support of the appeal. The Commission shall not consider a notice of
appeal that does not comply with the provisions of this subsection.
Time to Reply: The ROWDS Manager shall have ten (10) working days from the date of
the filing of the notice of appeal to reply to the notice of the appeal, and may during such
time meet with the appellant to discuss the matter, and may also consider and/or modify
the decision that is being appealed. A copy of the reply, and any modifications to the
decision being appealed will be provided to the appellant prior to the Commission hearing
on the appeal.
Notice of Hearing: Unless otherwise agreed to by the appellant, the hearing of the appeal
will be noticed and scheduled on the Commission agenda at a regular meeting to be held
within thirty (30) days following the delivery to the appellant of the ROWD$ Manager's
reply to the notice of appeal. A copy of the decision being appealed, the notice of appeal
and the reply shall be delivered to the Commission at least one (1) week prior to the
hearing.
Action by Commission: Following the hearing, the Commission shall either affirm or
reverse, in whole or part, or otherwise modify, amend or supplement the decision being
appealed, as such action is adequately supported by the law and evidence presented at
the hearing.

affected by the remodeling process per National Fire Protection Standm'd ! 3.

We wish to submit our written comments in .response to the public hearing notice
regarding the application of Jeffrey L. King, for a conditional Use Permit

Sr. High School for Cole Valley Christian Church, located at 200 East Carlton.
We oppose the approval of said permit for the following reasons.
There are no details given as to size of sc'hool,.or number of
students or limit of students to be involved.
The congestion of traffic in this general area during hours the
Post Office is open.
Parking area for students as well as faculty. Business in the
surrounding areas take most of the street parking.
There is not an area for outside activities for students, There
.is no need for students to be roaming about because of lack of
activity space.
Also, we don't understand how this building can now be used for a school
facility when it had to be abandoned without notice, unfit for use as a
school a few years ago. If it was unfit then, what has transpired to
make it fit now. Not to mention that the play fields and tennis courts
were done away with.
The bottom line is we do not feel that this location is in the best interest
of the students or those of us who live, or work in this area.
Please conMder our concerns when making a decision on this issue.

renovated into classroom spaces. The remaining 13,150 sq. ft. is
proposed to remain as office space. An 18,466 sq. ft. gymnasium is
proposed in the northeast corner of the property. This gymnasium would
be constructed as Phase II of the overall project. Next year an estimated
225 junior & senior high students would be in attendance.

A j'anior/senior high school does not requke activip/space as would be needed
for a grade school application. Outside athletic activities such as track, football,
etc. would take place offside. Inside a~iettc activities such as basketball,
volleyball, etc. would take place in the proposed gymnasium.

This facility was ~lly renovated and brought up to code in 1998. Handicap
acc,ssible ramps, elevators, fire sprinkler and alarm system were added as a part
of this previous renovation. Any additional code related requirements related to
-~chool type o~cupancy would be addressed prior 1o the school occupying thc
space.
