Request for a Conditional Use Permit for the Establishment of a "Sports" Bar with
Pool Tables and Big-Screen TV's at 706 E Main Street (l't Street), Located in an
O-T (Old Town) Zone, by Michael McGuinness (File No. CUP-02-011)
We have reviewed this submittal and offer the following comments, as conditions of the applicant.
These conditions shall be considered in full, unless expressly modified or deleted by motion of the
Meridian City Council:
APPLICATION SUMMARY & BACKGROUND
The applicant, Mike McGuinness, has requested the approval ofa"sports" bar at 706 E. Main Street,
just to the north of Harry's Bar and Grill. The sports bar will include a number of large screen TVs
and pool tables for entertainment.
There are already three (3) other bars located on the same block as the proposed Blumacs Sports Bar
(Harry's Bar and Grill, Moetown's Rock and Roll Club, and the 127 Club). Additionally, there are at
least two (2) restaurants that serve beer and wine within a two block radius oftbe proposed location.
Idaho State Statutes (§ 23-913 ) prohibits the retail sale of liquor by the drink if the establishment
is within 300' of a church (and school or place of worship), unless approved of by the Governing
body of the municipality (City Council). The Valley Shepard Church of the Nazarene and the
Christian Science Reading Room are both within 300' feet of the proposed Bar.
The applicant owns and operates the Blumacs Bikini Bar at 6 I0 S. Vista in Boise, but he has no
intention of opening or operating a bikini bar in the City ofMeridian. A Bikini Bar would be regulated
by the Adult Entertainment Ordinance and would be allowed only with a conditional use permit in the
I-L zone.
LOCATION & SURROUNDING USES
The subject property is located at 706 E. Main Street, in the same building as Harry's Bar and Grill
(704 E. Main Street). The property is generally located on the northoast comer of Main Street and
Broadway Ave.

The following uses surround the subject property:
North - Modem Printers, zoned O-T
South - Harry's Bar and Grill, zoned O-T
East - Moetown (bar), zoned O-T
West - Farmer's and Merchant's State Bank, zoned O-T
STANDARDS FOR CONDITIONAL USES
The Commission and Council shall review the particular facts and circumstances of each
proposed conditional usein terms of the following and may approve a conditional use permit
if they shall find evidence presented at the hearing(s) is adequate to establish (11-17-3):

That the site is large enough to accommodate the proposed use and all yards, open
spaces, parking, landscaping and other features as may be required by this ordinance;
Staff finds that because the site is located in the downtown/Old Town area of the City of
Meridian, parking and landscaping will be limited to the existing insufficient parking and
landscaping. Nevertheless, the applicant has submitted a plan that indicates that he will be able
to provide the minimum number of parking stalls (12) per the Zoning Ordinance that will be
expressly for the use of his patrons.

That the proposed use and development plan will be harmonious with the Meridian
Comprehensive Plan and in accordance with the requirements of this Ordinance;
The current Comprehensive Plan Land Use Map designates the property as "Existing Urban".
Stafffinds the development plan to be in Compliance with the Meridian Zoning Ordinance and
the Comprehensive Plan.
That the design, construction, operation, and maintenance will be compatible with
other uses in the general neighborhood and with the existing or intended character of
the general vicinity and that such use will not adversely change the essential character
of the same area;
Staff finds that the proposed sports bar use will not change the essential character of the
general vicinity; however, staffquestions whether or not the intended character of the general
vicinity includes the placement of four (4) bars on one city block of downtown Meridian.
The Council and Commission should consider public testimony when determining if the
proposed use will change the intended character of the general vicinity.

That the proposed use, if it complies with all conditions of the approval imposed, will
not adversely affect other property in the vicinity;

The Council and Commission should rely upon public testimony to determine if the
development will adversely affect the other properties in the vicinity.
That the proposed use will be served adequately by essential public facilities and
services such as highways, street, police, and fire protection, drainage structures, refuse
disposal, water, sewer or that the person responsible for the establishment of proposed
conditional use shah be able to provide adequately any such services;
Staff finds that the proposed development will be adequately served by the essential public
facilities and services listed above.
That the proposed use will not create excessive additional requirements at public cost
for public facilities and services and will not be detrimental to the economic welfare of
the community;
Staff finds that the proposed use would not be detrimental to the economic welfare of the
community, nor would it create the need for any new facilities or services to be paid for by the
public.
That the proposed use will not involve activities or processes, materials, equipment, and
conditions of operation that will be detrimental to any persons, property, or general
welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors;
Staff does not anticipate that the proposed use will be detrimental to the general welfare of
the community by means of increased traffic, noise, smoke fumes, glare or odors generated by
the use.
That the proposed use will have vehicular approaches to the property which shall be so
designed as not to create an interference with traffic on surrounding public streets;
Staff finds that the proposed use will not create significant interference with any traffic on the
surrounding public streets. The applicant has not proposed any new curb cuts onto existing
streets.
That the proposed use will not result in the destruction, loss or damage of a natural,
scenic or historic feature considered to be of major importance.
Stafffinds that no natural or scenic feature will be lost, damaged or destroyed by issuance of
this conditional use.

SITE SPECIFIC REQUIREMENTS
1. Existing landscaping shall be protected and retained.
Existing sanitary sewer and water assessments will compared with the anticipated impact, to
determine whether additional assessments are warranted. If additional assessments are
warranted, applicant shall pay for them with the issuance of his building permit for tenant
improvements.
"Bikini" dancing and/or other sexually oriented business activities are prohibited at this
location.
All parking and areas of circulation shall be improved with a hard surface in accordance with
Meridian City Code 11-13-4.D, and shall be installed and striped in accordance with the
submitted site plan and Ordinance 11-13-4.F.

All exterior lighting, whether attached to the building or located within the parking lot, shall
be down-shielded or otherwise altered so that the light does not spill over omo adjacent
properties or right-of-way. All parking lot lighting shall be in accordance with Ordinance 11-
13-4C.

All signage shall be in accordance with the standards set forth in Section 11-14 ofthe City
Zoning and Development Ordinance. All signage is subject to design review and shall require
separate permits. Temporary or portable signs shall be prohibited, and will be removed upon
3 days notice to the applicant.
All construction and site improvements shall conform to the requirements of the Americans
with Disabilities Act.
8. As part of a conditional use permit, the City of Meridian may impose additional
restrictions/conditions.
RECOMMENDATION
Staff does not recommend approval of a bar at this location in downtown Meridian.

The following will be the requirements and/or concerns to provide minimum levels of fire protection for
the prOposed project:

5. This project shall be subject to a fire inspection to determine compliance with the Uniform Fire
Code and Uniform Building Code.

The building at 706 E. First St. is my building, as is the
30' x 120' parking lot with 13 spaces behind said building. Michael

The people of Meridi. an can be'assured that a lega~ contract,
written by an attorney to exclude building to be used as a bikini or
nude bar or be occupied for any unlawful purpose. That Blu~cs will
conform to and o~y all present and future laws and ordinances, rules
and regulations of government authorities
Mr. Mc Guinness will be respoasible for keeping front side-
walk and thirteen parking spaces free from debris on a daily
basis and also hose area down as needed for cleanliness.
I want the bu~iness to be something we all can be proud of
for our town. Not some~thing scuzzy.,: I will keep up my end of the
contract by overseeing Mr. McGuinness' businness as a clean and
respectable place as per contracts
As for parking, Harry Youngerman of Harrys Bar and his patrons
have used my parking lot, as has attorneys, bank personel and
numerous other business people for many years. My new signs have
dissapeared from behind Harrys Bar, so they might park there. I've
not enforced ~.the signs: ~S~:~;~,~be a, 'go~d'~i:~Jghbor'
The Ada County Hiway'~District has se~nt me a letter: April 1,02
saying the business would only increase'less than' ten 00~ cars
to the area. I have thirteen (13) spaces.
I will be present at,the Council meeting of Ju~e 6,2002. If
there should be any questions at that time I would be happy to
answer them to the best of omy ability.

Farmers & Merchants State Bank is requesting your denial of a conditional
use permit for the Blumacs Sports Bar at 706 East First Street, Meridian,
Idaho. Farmers & Merchants State Bank opposes this permit for the following
reasons:

The limited parking spaces available to service four Bars, all located in the
same city block, will cause patrons to increase the use of parking spaces on
First Street and will result in more bar patrons using our bank's parking lot
located on Broadway between East First and Meridian Road.
FRUITLAND
Many of the bar patrons also contribute to having to clean the parking areas on
almost a daily basis in order to maintain them in a respectable condition.

The proposed site of the Sports Bar will increase the concentration of bars to
four, in one city block, in the heart of downtown Meridian. It is the opinion of
the bank's management, that this could adversely affect the future re-
development of this downtown core.
In closing, Farmers & Merchants State Bank is committed to the re-
development of downtown Meridian and we do not feel that increasing the
number of bars in downtown Meridian is the appropriate enterprise to ensure
future downtown re-development.
Farmers & Merchants State Bank is, therefore, firmly opposed to the granting
of a conditional use permit for the Blumacs Sports Bar at 706 East First St.,
Meridian, Idaho.
