Regular meeting of the Meridian City Council called to order by President of
Council, Grant Kingsford.

Minutes of the previous meeting held August 1, 1983 were approved as written.
Resolution #82 - Adoption of Tenative Budget 1983/84 Fiscal Year
President of Council, Grant Kingsford presented RESOLUTION NO. 81 "A RESOLUTION
AUTHORIZING PUBLICATION OF AN ESTIMATE OF THE EXPENSES FOR ALL PURPOSES FOR THE
CITY OF MERIDIAN, ADA COUNTY, IDAHO, FOR THE FISCAL YEAR BEGINNING THE 1ST DAY OF
OCTOBER, 1983, AND ENDING THE 30TH DAY OF SEPTEMBER 1984, AND GIVING NOTICE OF
PUBLIC HEARING PRIOR TO THE PASSAGE OF THE ANNUAL APPROPRIATION BILL."
The Motion was made by Orton and seconded by Tolsma that the Council adopt
Resolution #82 Tentative Budget and to give notice of Public Hearing for Final
1983/1984 Fiscal Year City of Meridian Budget to be held September 6,1983.

PUBLIC HEARING - Conditional Use Permit for Janice Love to Operate Day School
~ Mrs. Love was present to request a Conditional Use Permit to operate a day school
at 1001 Meridian Street. This is presently a Church. Love explained that only
the top floor will be used. Love told the Council that this will be a licensed
facility, and that there will be less than 50 children.
Kingsford: "I will now open the Public Hearing regarding the Conditional
Use Permit request to operate a Day School by Janice Love."
There was no response.
Kingsford closed the Public Hearing.
Councilman Brewer inquired on if the yard would be fenced.
Love said that the entire back yard would be fenced.
Councilan Tolsma questioned if Love had any problems regarding the Fire Codes.
Love said that they are following all codes very strictly and will be adding an
additional fire exit and a fire alarm system to the building.
Building Inspector, Vern Schoen stated that he had gone over the preliminary
drawing and that everything seemed in order.

Police Chief Doug Nichols had no comment.
There was discussion concerning the sewer and water charges on the building.

WasteWater Sup't. Earl Ward såid that there would probably be no change in the
billing as the Church is going out and the Day School is going in.

Request for Conditional Use Permit by Janice Love for Day School. . . . . . .
The Motion was made by Orton and seconded by Brewer to approve the Findings of
Fact and Conclusions of Law prepared by the City Attorney as -ai!1opted by:,:bhe P&Z "
Commission concerning the request for a Conditional Use Permit by Janice Love to
operate a Day Care/Day School at 1001 Meridian Street. (On file with these Minutes)

The Motion was made by Orton and seconded by Tolsma to accept the recommendation
of the Planning & Zoning Commission to approve of the requested Conditional Use
Permit by Janice Love to operate a day school at 1001 Meridian Street, upon the
conditions as listed in the Conclusions of the Findings of Fact and Conclusions
of Law. (On file with these Minutes)

Larry Hellhake - Rocky Mountain Development corporation
Larry Hellhake, a representative of Rocky Mountain Development Corporation was presen
in reference to 120 acres they want to subdivde into five acre tracts.
Several months ago the Meridian City Council restructed the Boundary of the
Meridian Urban Service planning Area by eliminating that portion South of the
Ten Mile drain and adding these densities to other areas. The future
use of this general area south of Ten Mile drain east of Ten Mile Road North of
Overland Road has been left in limbo due to this restriction.
There was discussion.

Due to the property not being in the proposed Meridian Urban Service Planning
Area, and the problems involved using lift stations for sewage the Council will
not consider Annexation.
Hellhake requested a statement to Ada County indicating the approval of the
concept. Hellhake said that he has been tabled by the County Commissioners pendiñg
a clarification of the Urban Service Planning Area Boundary.
Hel1hake said that the covenants that will be placed on the property will stipulate
that all houses are to placed at specific locations on the five acre tracts to
enable future subdivision of these tracts after appropriate application, study,
and approval by the City of Meridian. Hellhake stated that right now they are
only asking for a density of 21 units for the 120 acre tract. Hellhake also
said that the developer will install dry line sewers sufficient to handle present
and potential future residential growth on the 120 acre site.
Councilman Brewer said that he feels this is a "nice size project that makes sense
and has a practical value."

Brewer said that annexation of this property may be a long time in comming, and
it would benefit everyone to find a way to use the property now, especially
if someone wants to develop it.
The Motion was made by Brewer and seconded by Orton to direct the City Clerk to
draft a letter to be discussed and approved at the next regular meeting of the
Council, generally in favor of the concept making certain provisions as discussed.
