(Limited Office), by Lombard-Conrad Architects (File No. AZ-02-O08).
We have reviewed the above referenced submittal and offer the following comments, as
conditions of approval. These conditions shall be considered in full, unless expressly
modified or deleted by motion of the Meridian City Council:
APPLICATION SUlVIMARY
The applicant, Lombard-Conrad Architects, has applied for the Annexation and Zoning of five
(5)-acres of land on the south side of Ustick Road, approximately ~ mile west of Linder Road.
The requested zoning designation for the property is L-O.
The property, currently in the process of being purchased by the Church of Jesus Christ of
Latter-Day Saints, is planned to have a 26,000 square foot church building constructed on it in
the near future. Churches are a permitted use in the requested L-O zone.
LOCATION
The property is located on the south side of Ustick Road, approximately ~ mile west of Linder
Road.
SURROUNDING PROPERTIES
North: Bridgetower Subdivision and Primeland Subdivision, zoned R-4 (with L-O uses
permitted in Primeland Subdivision).
South: Field Stone Meadows Subdivision, zoned
East: Tumble Creek Subdivision, zoned R4.
West: Field Stone Meadows Subdivision, zoned R4.
ANNEXATION & ZONING ANALYSIS
According to Ordinance 11-15-11, General Standards Applicable to Zoning Amendments, both
the P&Z Commission and Council are required "to review the particular facts and circumstances
of each proposed zoning amendment in terms of the following standards and shall find adequate
evidence answering the following questions about the proposed zoning amendment."

The following is the list of standards found in 11-15-11 and analysis by staff:

Will the new zoning be harmonious with and in accordance with the
Comprehensive Plan and, if not, has there been an application for a
Comprehensive Plan amendment;
Staff finds that the requested zoning designation (L-O) and land use (church) are
harmonious with and accordance with the adopted Comprehensive Plan and
Generalized Land Use Map (1993), which designates the land to be "Single
Family Residential". Although the L-O zone does not match the Single Family
Residential land use designation, churches are permitted with a conditional use
permit in the R-8 Zone. Staff feels that annexing and zoning the property to R-8,
and then requiring a conditional use permit will create an unnecessary layer of
bureaucracy that can be avoided by zoning the property L-O, where church uses
are permitted without a conditional use permit.
The City Council approved a similar annexation and rezone for the LDS Stake
Center on Black Cat in 1999 (File No. AZ-99-003, Ord No. 829).

Has there been a change in the area or adjacent areas which may dictate that
the area should be rezoned. For example, have the streets been widened, new
railroad access been developed or planned or adjacent area being developed
in a fashion similar to the proposed rezone area;
The majority of the surrounding properties are medium density residential
subdivisions. The property to the north has been approved for office development.
Staff finds that the requested zoning designation of L-O, if developed as a church,
is harmonious with the existing and planned adjacent developments.

Will the proposed uses be designed, constructed, operated and maintained to
be harmonious and appropriate in appearance with the existing or intended
character of the general vicinity and that such use will not change the
essential character of the same area;
Staff finds that the proposed use (church) will not change the existing or intended
character of the area.
Staff finds that a church can be operated, designed and maintained to be
harmonious with the surrounding area.
Will the proposed uses not be hazardous or disturbing to existing or future
neighboring uses;

The Commission and Council should rely on public testimony to determine
whether or not the proposed use will be disturbing or hazardous to the existing or
future neighboring uses.
Staff does not anticipate that the proposed use will be hazardous or disturbing to
future or existing neighbors.

Will the area be served adequately by essential public facilities and services
such as highways, streets, police and fire protection, drainage structures,
refuse disposal, water, sewer or that the person responsible for the
establishment of proposed zoning amendment shall be able to provide
adequately any of such services;
Staff finds that the property to be annexed can be served adequately by all
essential public facilities and services, however access to sanitary sewer will be a
challenge for the applicant. There isn't a sewer main in Ustick Road adjacent to
the subject site, but there does appear to be several options for service in the
vicinity. Additional study will need to be done by the applicant to determine the
best alternative.
Will not create excessive additional requirements at public cost for public
facilities and services and will not be detrimental to the economic welfare of
the community;
Staff finds that there will not be additional requirements at public cost and that the
annexation and zoning will not be detrimental to the community's economic
welfare.

Will the proposed uses not involve uses, activities, processes, materials,
equipment and conditions of operation that will be detrimental to any
persons, property or the general welfare by reason of excessive production of
traffic, noise, smoke, fumes, glare or odors;
Staff f'mds that the proposed church use not create excessive traffic, noise or other
nuisances that would be detrimental to the general welfare of the surrounding
area.
Will the area have vehicular approaches to the property which shall be so
designed as not to create an interference with traffic on surrounding public
streets;
Staff fmds that the annexation and development of the property will not create
significant interference with the existing traffic on Ustick Road.
Will not result in the destruction, loss or damage of a natural or scenic
feature of major importance; and

Staff f'mds that no natural or scenic features of major importance will be lost or
damaged by approving the annexation and re-zone: Any existing trees larger than
4" caliper that are removed shall be mitigated for, per the Landscape Ordinance.
Is the proposed zoning amendment in the best interest of the City of
Meridian. (Ord. 592, 11-17-1992)"
Staff fmds that the annexation of this property would be in the best interest of the
City.
ANEXATION AND ZONING COMMENTS
The legal description submitted with the application appears to meet the requirements of the
City of Meridian and State Tax Commission and places the parcel contiguous to existing city
limits
Access to sanitary sewer will be a challenge for the applicant. There isn't a sewer main in
Ustick Road adjacent to the subject site, but there does appear to be several options for
sanitary sewer service in the vicinity. Additional study will need to be done by the applicant
to determine the best alternatives for service. Information on the options available can be
obtained from the Public Works Department.
3. Domestic water service to this site shall be via an existing 12-inch diameter main adjacent to
the site in Ustick Road.
4. The requested zoning of L-O is compatible with City Comprehensive Plan.
5. The subject property is within the Urban Service Planning Area. Essential City services are
or will be available to the subject property.

Any existing domestic wells and/or septic systems within this project will have to be
removed from their domestic service, per City Ordinance Section 5-7-517, when services are
available from the City of Meridian. Wells may be used for non-domestic purposes such as
landscape irrigation.
A Certificate of Zoning Compliance shall be obtained from the City of Meridian prior to
construction of a church on the subject property. All other uses shall be required to go though
the conditional use permit process.
RECOMMENDATION
Staff finds that church uses typically mix well with residential uses and therefore recommends
approval of the proposed annexation and rezone.

::The following will be the requirements and/or concerns to provide minimum levels of fire protection for

1. : That a fire-flow consistent with Appendix III-A of the Uniform Fire Code be provided to service
:~the entire ~oject. Fire hydrants shall be placed an average of 400' apart. 1997 UFC Appendix III-A

3,: Acceptance of the water supply for fire protection will be by the Meridian
Water DeparUnent.
:::: 4. Final approval of the fire hydrant locations shall be by the Meridian Fire Department.
5. All radii shall be 28' inside and 48' outside radius for all intemal roads and entrances.
6. The proposed annexation will have an unknown transient population and will have an unknown
impact Meridian Fire Department requests for service. According to a report completed by Fire &
Emergency Services Consulting Group in February of 2000 our requests for service are projected to reach
2800 in the year 2005 and 3800 by the year 2010, this is up from 2069 responses in the year 2000.
7. Comply with the requirements of the Uniform Fire Code and Building Code.
