Broadway Avenue Meridian, ID 83642 RE: Baraya Subdivision No. 5 (H-2020-0088) Final Plat Modification—Condition 5b.—Purdham Drain Fencing Update-NMID Meeting of 3/10/21 Honorable Mayor and City Council Members: Pursuant to your request at our hearing last night,we had a meeting with NMID this morning to discuss their willingness to amend their license agreement to allow parallel fencing between the Purdham Regional Pathway and the Purdham Drain in accordance with current City code. As mentioned by Councilman Hoaglun last night and confirmed by NMID,they periodically (every few years) use large equipment to clean out and maintain the Purdham Drain from both sides. With the current offset of the pathway from the top of ditch bank,there is sufficient room to do it from the pathway side. With the addition of a fence,there would not be room for NMID equipment. In addition,they mow the ditch banks at least annually and a fence would conflict with that operation. In short,NMID has requested we pursue a revision to City Code to align with their operations and maintenance requirements relating to "Drains". The key issue being the current characterization of a"drain"in City Code in the same category of a canal or lateral with parallel fencing required adjacent to City pathways. However,NMID considers "creeks"and"drains"to fall under the same category in relation to parallel fencing prohibitions,their maintenance requirements, and the public safety considerations. We appreciate your willingness to clarify this conflict of City Code and NMID requirements in relation to "drains" and trust we can find a mutually beneficial solution while showing the public safety interest is protected.
