AN ORDINANCE FINDING THAT CERTAIN LAND TO BE KNOWN AS SILVERSTONE CORPORATE CENTER PHASE II LOCATED AT THE SOUTHEAST CORNER OF E. OVERLAND ROAD AND S. EAGI.E ROAD AND WHICH LIES CONTIGUOUS ORADJACENT TO THE CITY LIMITS OF THE CITY OF MERIDIAN, COUNTY OF ADA, STATE OF IDAHO; AND FINDING THAT THE OWNER HAS MADE A REQUEST FOR ANNEXATION IN WRITING TO THE COUNCIL; AND THAT SAID LAND BE ANNEXED TO THE CITY OF MERIDIAN AND ZONING DESIGNATED GENERAL RETAILAND SERVICE COMMERCIAL DISTRICT (C-G); AND DECLARING THAT SAID LAND, BY PROPER I.F~AL DESCRIFrION AS DESCRIBED BELOW, BE A PART OF THE CITY OF MERIDIAN, COUNTY OF ADA, STATE OF IDAHO; REPEAl .lNG ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THERF~F IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF MERIDIAN, IDAHO; AND DIRECTING THE CLERK OF THE CITY OF MERIDIAN TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREAS TO BE ANNEXED WITH ADA COUN'~ RECORDER, AUDITOR, TREASURER AND ASSESSOR, AND THE STATE TAX COMMISSION OF THE STATE OF IDAHO, PURSUANT TO IDAHO CODE SECTION AND SECTION 63-~m15. BE IT ORDAINED BY THE MAYOR AND THE COUNCIL OF THE CITY OF MERIDIAN, COUNTY OF ADA, STATE OF IDAHO: SECTION I. FINDINGS: That the following described land is contiguous and adjacent to the City of Meridian, Idaho, and that the City of Meridian has received a written request for annexation to the oty of Meridian, Idaho, by the owner of said Property to-wit: A parcel of land being a portion ofthe Northwest V4 ofthe Southwest 1/4 of Section 9~x, Township 3 North, Range ~ East, Boise Meridian, Ada County, Idaho. Said parcel being more particularly described as follows: ANNEXATION AND ZONING ORDINANCE (AZ-01-025) - 1 BEGINNING at the Quarter Comer common to said Section 21 and Section 20; thence along the East-West centerline of said Section 21, South 89007'33" East 48.00 feet to the proposed east right-of-way line South Eagle Road; thence continuing along said East-West centerline South 89007'33" East 1212.36 feet; thence leaving said East-West centerline South 00000'08'' West 19o.o5 feet; thence South 23°O1'17" East 91.35 feet; thence South 21°57'16" West 6o.oo feet to the centerline of Ridenbaugh Canal as shown on Record of Survey 453, Instrument No. 8316509, Ada County records; thence along the centerline of said Canal through the following courses; North 680o2'44" West 276.97 feet; thence 505.36 feet along a curve to the left, said curve having a radius of 500.00 feet, a central angle of 57°54'34', and a chord bearing and distance of South 82059'58'' West 484.12 feet; thence South 54002'40" West 156.2o feet; thence 174.94 feet along a curve to the fight, said curve having a radius of 12o.oo feet, a central angle of 83031'45'', and a chord bearing and distallce of North 84°11'22' West 159.86 feet; thence North 42°25'2o" West 87.1o feet; thence 18o,93 feet along a curve to the left, said curve having a radius of 400.o0 feet, a central angle of 25°55'Ol", and a chord beating and distance of North 55022'5°" West 179.4o feet; thence North 68°2o'2o" East 47.61 feet to the west line of the Northwest 1/4 of the Southwest V4 of said Section 21; thence along said west line North oo°oo'o8' East 196.2o feet to the POINT OF BEGINNING. Said parcel contains 35o,873 square feet or 8.o5 acres more or less. SECTION 2: That the above-described real property be, and the same is hereby annexed and made a part of the City of Meridian, Ada County, Idaho. SECTION 3: That the real property herein by this ordinance annexed to the City of Meridian hereinabove described shall be zoned General Retail and Service Commercial District (C-G). ANNEXATION AND ZONING ORDINANCE (AZ-01-025) - 2 SECTION 4: That the City Engineer is hereby directed to alter all use and area maps as well as the official zoning maps, comprehensive plan and all official maps depicting the boundaries of the City of Meridian in accordance with this ordinance. SECTION 5: All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. SECTION 6: This ordinance shall be in full force and effect from and after its passage, approval and publication, according to law. SECTION 7: The Clerk of the City of Meridian shall, within ten (lo) days following the effective date of this ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman manner plainly and clearly designating the boundaries of the City of Meridian, including the lands herein annexed, with the following officials of the County of Ada, State of Idaho, to-wit: the Recorder, Auditor, Treasurer and Assessor and shall also file simultaneously a certified copy of this ordinance and map with the State Tax Commission of the State of Idaho, all in compliance with Idaho Code ' 63- 2215 and ' 5o-223.
