This week we succeeded in advancing bills to establish a state avalanche fund, and to raise sticker fees for snowmobiles to add solvency and funding to the snowmobile grooming program. After those bills, H60 and H61, passed out of committee, it was suggested we combine them within one bill, and that we provide that the non-resident snowmobile sticker be $10 higher than the resident sticker. We have heeded that advice, and today the House Transportation committee approved printing a new bill along those lines. A new bill number should be received early next week. Our bill to simplify the pay-to-play sticker administration and program awaits a hearing in House Transportation. All signs indicate H86 will be favorably received. This week House Transportation also approved printing of H129, which seeks to expand the ability of OHVs to travel on state highways. A hearing should come very soon. Today, House Transportation also printed a bill that would remove authority for cities and counties to prohibit OHV use on public roads. A bill number has not yet been assigned. We did not request this bill and are monitoring it for now. 1 Our bill to broaden landowner protection for those that allow us to travel across private land, S1020, received wide support this week, passing the Senate with 30 out of 35 votes in favor. All signs indicate this bill will be favored similarly on the House side. All-in-all, things are going very well for recreation and our bills. Please continue to keep engaged and show support. H060 – SNOWMOBILE AVALANCHE FUND: creates a state snowmobile avalanche fund; $1 from each snowmobile sticker to the fund; fund oversight by committee; funds monies must be used for avalanche forecasting warnings, awareness and education in Idaho. H061 – SNOWMOBILE STICKER FEE INCREASE: raises snowmobile sticker fee to $49.50, representing approx. 3% annual increase to sticker over life of the program; allocates $2 from each sticker to search and rescue fund; allocates $1 from each sticker to IDL for recreation on state lands. H086 – RECREATIONAL STICKER PROGRAM: eliminates need to validate ownership of OHVs and Snowmobiles to identify pay-to-play sticker to vehicle by its VIN or title; allows stickers to be sold as over- the-counter transaction and reduces other red tape to simply administration of sticker program; requires roll-out of multiple year stickers by Nov. 2021. H093 – STATE PARK FEES: increases fees for state parks for non-residents only; requires non-resident fees to be double resident fees; grants IDPR authority to set nonresident fees. Sponsor – Rep. Okuniewicz. Passed out of House Resources and awaits House floor vote. H129 – OHV USE ON HIGHWAYS: to allow OHVs to operate on all public roads that are not state highways or interstates. To allow OHVs to operate on state highways within cities and 1 mile out. To allow OHVs to operate on state highways outside cities for stretches of 5 miles to access trails, lodging and services. OHVs must follow rules of the road and keep speed to lesser of 45 mph or posted speed. Requires IDPR to be notified before any entity adopts an ordinance restricting OHV use on roads or highways. S1020 – RECREATIONAL TRESPASS: Broadens landowner immunity from liability where landowner allows public to recreate on land free of charge; clarifies definitions within statutes to broaden circumstances to provide greater immunity protection to landowners. This is legislation developed by Idaho Water Users Association. Sponsor – Sen. Harris, Rep. Boyle and Gestrin. Passed Senate 30-3-2. Pending in House Resources and Environment.
