Dear City Clerk, This is in response to the proposed draft of Title 7 Chapter 5 Section 7-5-2 Sub-section D We are in agreement there needs to be an ordinance concerning golf carts, atv, and utv, etc on city streets. However, there needs to be modifications to sub-section D Original text reads as following D. Residents of Spurwing Heights subdivision shall be allowed to operate golf carts to travel within the subdivision, which is located north of Chinden Boulevard, between N. Black Cat Road and N. Ten Mile Road. The problem here is this Sub-section D is too narrow as it is currently written. If one were to look at a map they would notice that Spurwing Heights sub-division does not extend to Ten Mile Road. Furthermore, there is no mention of the other Spurwing sub-divisions in the same area. Let's start with The Club at Spurwing and surrounding sub-divisions: Spurwing, Challenge, Spurwing Estate, Spurwing Reserve, Spurwing Greens, and Spurwing Heights which most of these would be precluded from the wording of D above. One could argue that Spurwing Estate/Reserver/Greens/Heights are included but because Heights is called out this would technically preclude these except Heights. Suggested wording: D. Residents of Spurwing subdivisions shall be allowed to operate golf carts to travel within the subdivision, which is located north of Chinden Boulevard, between N. Black Cat Road and Linder Road.
