Again referring to Antieau, the answer f believe is, that Dear Don: The City Council has asked my opi-nlon concerning certainmatters relating to the i-nstallation and distributlon of domesticwater outside the city limits. The first question propounded was, where an individual wholives outside the city linits has purchased and layed pipe at hi.s o$rn expense to connect rdith the city system and ln turn the city has been selling him water, when the plpe needs replacing whoseresponsibility is it? Based on Volume 2 of Antieau on MunicipalCorporation Law, in Chapter 19, it is my opinion that the City when it operates a water works is governed by the same principalsas though it were a private water corporation. If this situation were presented in a private water corporation the person outsidethe city purchased his pipe and installed the same originally asa condition of receiving service. This condltion would continuorithout change unless the city had agreed specifically thereafterto take over ov,nership of the pipeline and the responsibility forreplacement. In the absence of a showing that the City speeifl-cally agreed with the landowner outside the City, it is my opinionthat the persons served outside the City must replace pipe attheir own expense. to th€ide ththe ab once tto serve people outside the city, it must continue to do so and it must serve them with an adequate water supply comparable to anyother user withi.n or without the ci.ty, who pays his regular servieecharge. The cityt s responsibility is'to mainiain the iame flow of$ water as is furnished other users. 1 think that the city has .:=authority to add additional meters at the expense of additional i.' users outside the city, because by i.mpli.cation at least the line =-outside the city becomes a part of the entire systen and I believethe city would have authority to give ex0ended service from theline that was originally a private line and l do not think that the city needs to get the permission of the original ourner of the Gn.c.Nr L.
