As the results have been most satisfactory, we propose to contlnue through 1961 wlth the prognam as lnltltated. The County and the townr s cost w111 ::eam1n tlr e same. However, bocause of the matchlng fllnds,lapproved by the Federal Gover.nrnent fon thelr actlvlty we hope to be able to double the servlces to the resldents of t he C ounty. FIJNDS are avallable to pay the costs of care and handLlng, inci- dent to donatlon, including packing, preParatlon for shipplng, loading, and transporting such property. THERE will also be applicable such other terms and conditions as are contained ln the Regulations of the OCDM, Tltle 32, Code of Federal Regulations, Subtitle C, Part L702, as in effect on the date hereof. ALL property havlng a single item origLnal acqtrisltion cost of $2500.00 or more shall be restricced and during the period of res- triction, be properly malntalned in good operational conditLon and stored, installed or utillzed only as necessary to achLeve a state of operational readiness as required by the civil defense missions asslgned to the donee ln accordance'with the civll def- ense operational plans of the' state and, where appllcable, local gover-rdnent (whtch shall be consistent wlth the National Plan for Ctvil Defense and Defense Mobillzatlon as nort or hereafter amended). Operational readiness shall include necessary use in tralning under a civiL defense training program approved by the State Civll Def- ense Director as being in accordancc with the civil defense oper- ational plans of the State. EXCEPT as otherwise expressly provlded hereinbelow and unLess and until expressly waived in wrlting by the Dlrector, OCDI'I, on a case basis, the period of restrlction for all ltems of property donated for civil defense purposes shall be four years from the date such property ls flrst used or put in stockpile ln accord- ance with thls subsection. The specific excepEions are as follows: MOTOR VEHICLES, Federal Supply Classiftcatlon (FSC Group 23). for whlch a two year period of restrlctlon shall apply. 5 a b ) CD-SP-I BOATS (FSC t roup 19), Tractors (FSC Group 24), Construction, MinLng, Excavating and Highway Mal,ntenance Equlpment (FSC 38 r p2 Fireflghting and Rescue Equlpment (FSC Group 42), Prefabrlcated Structures (FSC Group 54), and Generators (f5c GrouP 6115), for all of which a sLx year perlod shall apply. 7 B c. AIRCRAFT (FSC Group 15), for which the special terms and condl- tions provided in the DHEW Conditional Transfer Docrnent (Air- craft) covering the Eransfer shall apPly. RESERVE stock storage and lnstallatlon of equipment for operational readiness shall-, in addition to meeting the above criterlar meeE all applicable criteria establlshed by the OCDM. DURING the period of restrictLon, the property sha1l not be sold, leased, traded, loaned, bailed, encumbered, or otherwise dlsposed of wlthout the speciflc, prLor, rtritten approval of the Director, OCDI,I. IF, during the period of restrictlon, Property is no longer sult- ab1-e, useable, or further needed for the Purpose for whlch acqulred, the donee shall promptly notify the OCDI'{ through the State Civll Defense Director and shall , as directcd by the OCDM, either re-transfer the property to such department or agency of the United States of America or such other donee as may be deslgnated, or sell the prop- erty at a public sale. 9. IN the event any of the terms and condltlons set forth ln this sectlon are breached, all rlght, title and interest in the Property Lnvolved, at the optlon of the DLrector, OCDM, shall revert to the United States of America. In addition, where there has been an unauthorized dlsposal or improper use of any kind, the donee, at the option of the Director, OCDM, shall be llable to the United States for all damages. Where the property is not returned to the United States Government or where property ls Lmproperly used, the donee shall be 1iab1e to the Unlted SEates for any proceeds from the disposal or improper use of for the fair market value or renEal value of the property at the tlme of such disposal or Lmproper use, at the option of and as determlned by the Director, OCDM. 10. TJHEN the period of Federal restricElon explres, the property ls sttll subject to restricttons of the State Civil Defense Office. IT IS RESOLVED THAT certification and agreement for participatlon ln the Federal Surplus Property Program, noted herein, shall- be spread upon the minutes of this.meetlng and that the following named rePre- sentatives raith their signatures shaI1 be and are hereby authorlzed to obligate the funds of the above named clviL defense unit, and to obtain transfer to it from Surplus Property Agency upon and subject to the terms and conditions relating to transfer of property for Civil Defense Purposes set forth above.
