The ri8hEs, benefits, memberships, payments, duties and obligations wtth respect to membership and participation in the Public Employee Retirement System of Idaho (TiE1e 59, Chapter 13, Idaho Code, as amended) sha11 apply to the employees of the Contracting EmpJ"oyer upon the identlcal terms and conditions as set forth in said Act made and entered into this _ag*_. dal of for other employees effective as of the r-^ day of such date being stipulated as the date of SiiaUlish*'i*fi-",...en r said Contracting 2. The C1erk, or other like offi.cer, of the Contracting Enployer shall deduct and withhold from the salary payments earned and paid to each of the employees of the Con- tracting Employer, who are eligible for membership in the Retirement System, and al1 eligible en::loyees employed after the contract date, the monthly contributions provided by 59-1304 and 59-1305; deductions to be made on each and every salary payment made for services rendered by the employee member from and after the date of establishnent set forth above. 3. On the first. of each month afLer the date of establishment, the clerk, or other 1lke officer, of the Contracting Employer shall prepare and mail to the Board a full, true and complete statement, on forms provided by the Board, of aLL indivldual employees of the Contracting Employer showing the Eotal amount of salaries earnetl end paid during the previous calendar month to all of the employees of the Contracting Employer and shal1 indicate and show Ehereon the amount of contributions deducted and withheld from salaries earned and paid to the employees who are members of the Retire- ment Sys tem, 4. Any amendments nade by the Idaho Legislature to Title 59, Chapter 13, Idaho Code, as amended, shal1 immediately apply to and become a part of thls contract, and shall amend the saue accordingly. l. Prlor service credits as defined by the Act sha1l be allowed to be accumulated to July 1, 1965. Membership service from July L, L965, to date of establishment will be credited provided the employee and the ConEracting Employer make Ehe required contri- butions from July 1, 1955, to the date of establ,ishment. 8, This conFract sha11 have no effect until notice and hearlng regarding afforded to employees of fhe Contracting Enployer nor shal1 it be effective unt Contracting Enployer notifies the Board, ln wtiting, that a Eajority of the enp have voted in favor of participating in the Retirement System. 10. This contract shall not be cancelled, amended or abrogated by any act of parties hereto except as may be provided for in Title 59, Chapcer 13, Idaho Code, amended . tr 11 1o 9. If any existing retirement program presently operated in whole or in part by the Contracting Employer i.s to be superseded by thls Rdtirement System, which decisions shal1 be at Ehe sole option of the Board, the Contracting Employer hereby agrees to the appropriate funding of any accrued benefits as may be determined by the Actuary employ- ed by the Board, the expense of such determlnation and cost of funding accrued beneflts to be borne by the Contracting Employer in addition to any other contributions heretofore agreed Eo.
