II, SCOPE OF ENGINEERING SERVICES. A. Ieasibility Study. The ENGINEERS wilL make Ehe necessary studies to define the gen- eral concepts of a municipal L,ater distribution system and a municipal sew- erage sysEem to serve the CITY. This Feasibility Study will include general concepts of the water trarsmission and distribution system enlargements and extensions, fire protection considerations, water supply, \rater sEora€le, sewage collecEion system extensions, trunk lines and outfall sewers exten- sions, sewage treatment facillties modifications, rough preliminarv esti- mateg of project costs of each utility, an analysis of methods of financing same, and assistance in preparation of an application for public works advance planning loan with Ehe Department of Housing an<i Urban Development, or other agency, for financing the preliminary engineering planning of the proposeci improvenents for the CTTY. The ENGINEERS sha11 provide the CITY with six conplete copies of the Feasibility Report r^,iEhout separaEe cost to the CLTY. B. Preliminar Re ort. The ENGINEERS !ri11 make the required studies and investigations to establish a desirable nethod of providing an adequate municlpal water system and an adequate sewerage collection and treatment system for the CITY and will prepare a preliminary plan and an engineer's report compris- i-ng, as necessary, topographic data, field survey informaEion for develop- ing prelininary design and layouE, outline specifications' preliminary cost estimates, and recommendations for financinq the ProPosed improvements for the CITY. The ENGINEERS sha1l provide the CITY \rith six complete copies of the preliminary plans and engineer's report !r'ithout separate cost to the ClTY. C. Ceneral Engineerinq. I. PIans and Sreci Fications. The ENGINEERS will make "Lf field surveys necessary for the location, design, and preparaEion of contract plans and specifications and w111 prepare Ehe final designs, construction drawings, specifications, esti- mate of costs, forms suiEable for calling for contractor construction bids and proposal forms upon which bidders may submit bids on al1 water and/or sewer work proposed. The ENGINEERS shall provide the CITY with six com- plete copi.es of plans and specifications Lrithout separate cost to the CITY. 2. General En lneerln Coordinat ion of Construction. The ENGINEERS shall perform the additional general engineering services such as analyzing contractor bids, contract award recomnendat ions , preparation and approval of change orders and extra work orders, prepara- tion and approval of contracc payment estimafes, approval and/or rejectjon of contractor(s) work in progress or completed and assist in general coordi- nation of construction by perlodic visiEs to the site of construction r.rhi-1e waEer and/or sewer work is in progress, -2- \ D. Resident Dnil ineeranq and/or Inspect ion. In addition to Performing general engineering for the project(s), the ENGINEERS shall furnish resident engineering and/or inspection service. This shal1 include daily inspection, se!ting of conErol stakes, inspection of all work and materials as to the confornance lrith plans, specificatj.ons, and Engineerrs orders, keeping a daily record of contractor progress and acceptance and rejection of work, workmanship and materials, and naintain- ing a record of water and/or sewer \^rork completed for use in calculatinq contractor interim and final payments. 111. DATA AND SERVICES TO BE FURNISHED BY OI^TNER. The following data and/or services are !o be provided by the CITY wilhout cost to the ENGINEERS: a. City maps with existing utility records. b. Financial records of the CITY especially with regard to sewer and water revenue and budget, bonded indebtedness, assessed valuation, etc, c. Guarantee access to and make all provisions for the ENGINEERS to enter upon public and private lands as required for Ehe ENGINEERS to per- form such work as surveys and inspections in the development of the project. d. The CITY sha11 select and designate a right of way agent for pro- curing right of way as may be needed for the project. e. CITY equipment sha1l be used under the supervision of the ENGINEERS to make necessary subsurface and test hole investigations as may be needed for proper evaluation of the project, t, The ENGINEERS \ri1l work with the CITY'S 1egal counsel in obtain- ing the approvals of lhe agencies concerned wiEh the conslrucEion of these p ro-i ects. IV. MTSCELLANEOUS ENGINEERINC SERVICES NOT INCLUDED IN PROJECT COMPENSATION. Items of work noE within the scope of services provided in Section 11 of this contract shal1 be performed by the ENGINEERS upon specific authorization -3- /\ by the CITY and with separate compensaEion Paid lo the ENGINEERS for such services. These services may be, but not limite<i to, such items as: derailed materials or borrow source evaluation or analysis of material' test pj.t or borinB investigations, property and rights of way surveys and acquisition of same, preparation and reproduction of special data required by Federal agencies, and the preparation of 1oca1 inprovement district assessrnent rolls and map s. V. CONSIDERATION. A. Ieasibilitv Study. The ENGINEERS agree to prepare the papers and documents stipulated in Section 11-A hereinabove and perform the services recited therein for their performance for a total lump sum fee of Ei8ht Hundred Twenty-Five Dollars ($825.00), said pafment to be made to the ENGINEERS by the CITY upon submission by the ENGINEERS of the completed documents to the CITY. B. Preliminar Re ort. The ENGINEERS agree to prepare the papers and documents sripulated in Secrion II-B hereinabove and perform the services recited therein for their performance for a lump sum fee of Ten Thousand Seven Hundred Tl.renty- Five Dollars ($10,725.00), said payment to be made to the ENGINEERS by the CITY upon submitting the completed documenEs Eo the CITY. (Preliminary report fee to be prorated as $4,675,00 for water distribution system and $ 6,050. 00 for sewerage system.) C, Ceneral Engineerinq. The ENGINEERS agree to perform the field work and prepare p1ans, papers and docunents stipulated in Paragraphs 1. and 2. of Section II-C hereinabove and perform the services recited therein for a total compensa- tion of seven (7) per cent of the project costs. For purposes of establlsh- ing this compensation, project costs sha11 be defined as total costs of the project to the CITY from which sha11 be deducted Ehe fees due the ENGINEERS For engineering services, and the cost of CITY employees working less than -4- one-fourth tlme on direct proJect account. The total dollar value so cal- culated shall be nultlplled by seven (7) per cent at the completlon of the project. The resultlng amount constltutes the total enSlneerlng conpensa- tlon for servl.ces stipulated ln the foregolng Section II-C. D, Resldent Englneering and/or Inspectlon. The ENGINEERS agree to furnish the said resldent englneering and/ or inspection services as stipulated in Section II-D hereinabove and perform the servlces recited therein on a time and naterials basis. In computing the fee for such services, the ENGINEERS will be pald by the CITY at the rate of payroll costs ef all employees directly assigned to the project for resident engineering and/or inspect.ion plus 125 per cent. The CITY shall approve all personnel assigned to the resident engineerlng and/or lnspedtion of the proJect as well as their rates of pay. Expenses for t.ra- ve1, subsistence, telephone, printlng and slmllar out-of-pocket expenses directly associated with the work sha1l be pald at actual cost. E. Miscellaneous En ineerlng Services Not lncluded ln Prol ect ComDen- satlon. VI. NOTICE TO PROCEED. A. Executlon of this agreement by the ENGINEERS and the CITY will constitute written authority for the ENGINEERS to commence work as calIed for in Section I1-A hereinabove and the ENGINEERS agree that the work to be performed under this secEion of the contract sha11 be completed \,rithin one hundred twenty (120) days thereafter subject to such approved extensions of time thaE may be allowed due to unavoidable delays. At such tlme as the CITY has financing approved to proceed with the preliminary engineering report as called for i.n Section II-B herein- above, Ehe CITY shall give the ENGINEERS written notice rhat they shall proceed erith that section of this engineering agreement. At such Eime as the CITY has assurance that a proposed project as developed from the preliminary report can be developed and financed by bond elecEions, petitions, or other 1ega1 methods, the CITY shall give the ENGINEERS written notice that the ENGINEERS shal-l proceed wiEh the engi- neering work as outlined in Section II-C hereinabove. After receivinq \rritten notice from the CITY to proceed, the ENGINEERS aqree that the work to be perforned in Section II-C-l hereinabove shall be comoleEed within -6- two hundred ten (210) days thereafter subject to such approved extensions of time that may be allowed due to unavoidable delays. VII. AGREEMENT EXTENSION A.iID OR REVISION. Upon mutual agreenent of the parties hereto a part, this a€lreement may be altered, amended or extended to cover addiEional work for the ENGINEERS as addendum hereto, and upon ratification and execution there- after shall be a part hereof.
